Yes but if you must talk I guess it’s best if you deny and all no no no I haven’t a clue 😂 I realize it’s best to be cordial and explain that you cannot talk when I was 17 and got arrested for intent to distribute marijuana. They asked me to snitch and I looked at them and politely said I’m sorry but you know I can’t do that and that was it. They stopped asking 😂 .. but yea definitely don’t talk if u can

i would not remain silent. No way. I like to recite this law I'll share with you here. This law is easy to remember, It is Title 18 US Code Section 242 and it is call "Deprivation of rights under color of law." This law says that it is unlawful to threaten, intimidate, or coerce a US citizen from exercising any constitutional right under the color of authority. Cops violate this law over and over again. Recording them is well within your legal rights. Never blindly follow their commands. Ask "is that a lawful order sir?"

@@toomanydonuts like it or not, police ARE the law. They have authority over you, and you're obligated to follow their orders whether you think they're lawful or not. The time to defend yourself is in front of a judge, not on the street in front of a cop.

Best advice I've ever heard - answer any question (answer EVERY question): "I wish to cooperate with you FULLY, officer. Please provide ALL questions in writing, so I may give a COMPREHENSIVE response via legal representation". Repeat, over and over and over.

One time I was walking my dog at night and a cop stopped me to ask me questions about my dog and where I was walking. I didn’t realize what he was doing until he asked me if I walked past a gas station about 30 minutes ago. I immediately told him I’m no longer comfortable talking with him, then he detained me for an hour. A male who only shares my skin tone had robbed a gas station and had a dog in his car. They thought I was their guy. *Do not speak to cops* !

Blame your culture not good police work. Let me share my experience. My work truck was broken into. My neighbor saw that it was two blacks driving a red car. On the way to my house the police pulled over two black males in a red car. They were not involved but fit the description. I was please police did their job in investigating. Now the real problem was two black men breaking stealing.

Yes, as it was explained to ME, the 'am I free to go' part lets you know if you're officially being 'detained.' If not, walk away. If so, THAT is when you state your right to remain silent under the 5th Amendment. Because even if you are not officially under arrest where they have to read you your Miranda rights, they will still take down everything you say and use it.

I made mistake of allowing the police to search my car 20 years ago in vidor Texas on interstate 10. They proceeded to take my suitcases and everything but the spare tire out and they dump it all out on the shoulder. He found nothing. Left everything sitting there and drove off leaving me to repack my car in 100 degree June summer. Never again will I voluntarily allow that or even interact. Where ya going? Where ya coming from? Same place Noneya, none you damn business

About 40 years ago, I had US Customs tear apart the rental car I was driving from Canada back into the US (Vermont). The car was so disassembled it was undriveable. I had to call the rental agency (a major agency) and they came and brought me a new car and picked up the pieces of the old one. No apology. No nothing. Just said "you're free to go" and walked away from the mess.

What you can do is just not talk to them. Not hostile, not anything. Give them your license, reg, and insurance info. Get out of the vehicle when asked. But, you don’t have to talk. That’s the 1st Amendment. If you’re not doing anything, you have nothing to worry about. If you ARE, then just face it in court. Not at the roadside.

I have sadly come to the conclusion that modern law enforcement exists to collect revenue or evidence. If they're interacting with the public (other than PR purposes), they are trying to collect at least one of the two.

They've always been like this. You do know they work for corporations. What do you think the manucipal police are? They work for an incorporated city or town. Its a corporation. Don't let anyone tell you any different. State police the same. Only the Sheriff who's elected actually by law is supposed to work for the people. Remember all that. @@cad4060 I've known many cops over the decades and on the surface they appear good but get to really know them and they are very dark creatures deep inside. The moment you think you can trust them to do the right thing they will turn on you if that right thing goes against one of them or their family members. They have an unspoken code exactly like the mob. Judges also fall right into this mix!. The term JUST-US definitely applies to the purveyors of the division line known as the Thin Blue Line. This lines intention is to psychologically divide tyranically trained police from Constitution loving patriots. If they were even remotely honorable they would have imprisoned the original creators and promotors of such a defaced atrocity as a molested American flag which represents ONLY THEM A.K.A. JUST-US! Our beautiful old glory of the Red White and Blue is good enough for the millions of people who have died for this nation and it's Constitution but not for some militant trained clowns in costumes pretending to even be in the league of actual soldiers who fight for freedom in actual foreign wars!!! Y'all.. look for a video called, "Dont talk to the police" which goes into some greater details of why you shouldnt talk to the police. Professor Dwayne does a great job and is an asset to The Constitution. He gives a cop equal time as well. It's very educational and interesting. My job would be a lot easier if schools actually taught students what their rights *mean* as opposed to what they are facially.. A law school professor taught us that people want to tell their story, it's human nature to want to defend yourself. Our job is to teach our clients to resist that urge, shut up and call your lawyer...

Thanks for the video reference and I'll watch. That said, the whole system is bastardized and has eroded from what I believe the founding fathers had intended. My wife falsely accused me of assault and had me arrested. I spent a night in jail, was bailed out and am now facing criminal charges. The only evidence is that she has an injury, no witnesses. She did fall but I did not push her like she claims--her word against mine. I have never been in trouble with the law, not even a speeding ticket. She's been lying about a lot of things all year and there's proof of that but no one asks for that. My attorney fees are upwards to $17K now and I'm not done having to take on part time work. I have been told that judges dole out protection orders like candy and that's what he gave my wife. The coward judge couldn't even make the decision in the court that day but took it on advisement. A few days later he gives her the protection order behind the scenes. I am now paying for an abuser intervention program on top of it then my kids have been ripped away from me because he gave her full custody. Now my narcissist wife is only letting me see them once per month if that. Having been a devoted father for 15 years, that's the worst part of all of this. Every judge and attorney knows that this abuse happens but does NOTHING about it. People are losing their jobs for these injustices. The reality of the system is that it's too damn expensive for most people to hire an attorney so they take a plea deal or higher the overworked public defender. I'm so glad I haven't used our local public defender. I've watched her in the courtroom and she cowers to the prosecuting attorney. He has her wrapped around his finger. It's sickening. The final consequence, many, many, many people plea guilty for false claims of domestic assault so statistically, the problems of abuse aren't as bad as what is reported. This snowballs the truth then the cycle keeps getting worse because why? "Look at how many people are abused in our society, judges need to protect the "innocent"". What a joke. It's not a system of truth and justice anymore, it's a system of covering one's a$$.

Excellent video! here is also one by the ACLU, I cannot remember the name, which teaches you how to handle common police interactions, such as traffic stops or a noise complaint at your house etc. They do scenarios showing the wrong way to handle it, then the right way.

Only you can make the divorce decision and it took me a while to make mine, never communicate without a witness. Any communication I did have she recorded and deleted her comments to why I was responding in the was. I finally went no communication, so much better now years later. People are WAY too trusting with officers who can legally lie to you as well as who’s LITERAL DREAM SCENARIO on the job/how they get promoted the fastest, is a felony arrest with every encounter (most of the time it they don’t even need a conviction, just an arrest to get their kudos so they ALMOST have an incentive to just arrest people and let the chips fall later). To trust someone like that to search your stuff is beyond me! Thank you for making this video💯💪🙏

Incentives. Great point I did a dui trial years ago where my theme was the Earp brothers who arrested so many people they open the equivalent of the hard rock casino. Police get ridiculous amount of over time. If they are not on duty and they have a deposition. The depo lasts 45 minutes they get paid 3.5 hours. Talk about incentive.

I saw another video where a woman told the police to come back with a warrant. They wanted to search her house. When she refused one of the officers said if we have to come back with a warrant, we will break your door in and trash your house.I used to be a back the blue guy, but now I hate them.

I worked security with an ex detective and one night he turned to me and said "I’ll tell you like I tell my sons, don’t ever, ever talk to cops. They do not have your best interest in mind’. He went on with details on how cops operate and so on but he stressed to me, no matter what, do not talk to cops. I took his advice to heart. So, even if you are 10000% innocent, exorcise your right to remain silent.

The problem with getting a dog is they can always say the dog alerted to something even if they didn’t. That’s how they get around getting a search warrant to search your car. Once the dog allegedly alerted, there’s probable cause.

However, according to what I have read, a good attorney will be able to prove, through science, that there are many things which can lead a dog to give a false alert. If you DID have something in your car or you don't but it leads to something else they end up charging you with, the attorney can suppress that dog alert in court which would lead to a dismissal of the charges.

it makes no difference when they will manufacture probable cause to search by saying they saw something or call a dog. The dog handler will then walk around the car, give it a hand gesture to sit or something and say it alerted bypassing your right to search and seizure.

Are there some. Of course, but how many officers are planting drugs, some but not many. How many are exaggerating facts. Most. How many are using their training to grab a conviction by writing their reports with a major slant, a high percentage. But that is what a criminal defense attorney is for: during depositions and cross examinations. Weeds out the bs.

Years ago, san antonio pd pulled up behind me as I was parked and waiting for a friend to get in my car for a drive to a pawn shop. They pulled up hot. 6 squad cars. All had their guns out. 4 had body armor and m16s. Yes m16s. There was also 2 bexar county in gi joe green with their vests and m4s. A couple sapd beat cops with their fn fnx 40 caliber pistols. They ordered my friend out of the cae(he literally had 1 foot in when they pulled in hot). Then ordered me out while aiming at my head. I got out and they handcuffed me and forced me to sit down kinda rough on a parking curb. They searched my car. Found nothing. Searched again and found nothing. Then came and asked me to sign a slip granting them permission to search. I declined and declined but they said theyd keep searching anyway and will take me to jail unless I sign the slip. After I signed it(I didnt put my name I wrote fuck you). The cops got pretty mad about that. So the bexar county gi hoe had reached into his vest and pulled out a pretty hefty bag of weed. Probably a half oz or more. You know enough to be a charge and take me to jail. The cop that made me sign the paper didnt read the paper lmao. But I said Im watching them plant a bag of weed in my center console. Then about 30 seconds after the bexar county good closed the console, one of the sapd swat.guys opens it and finds the bag of weed in my sunglass case. Never did find my sunglasses after that so tells me one of them took them for themself. I brought up how I was going to sue and theyd probably lose their jobs because there were also witnesses. This was before body cams were here but cell phones had cameras and digital cameras were big. Plus you know parking lot cctv cameras. And their dash cameras. Plus the cop that was pressuring me saw them do it too. Theyre pretty much going to do whatever they want regardless of the law. They planned to setup my friend again, and whoever he texted for a ride, but little did they know, I know my rights and will sue them. Use to deter them but since they got total immunity and all for being ignorant they dont care.

I’m a teacher, and I talk to our school resource officer. He always tells me the sneaky things that they do. Then I ask, “is that legal?” He will then tell me in a round about way that it’s not legal, but necessary.

I once had about six cars of police around my house, banging on the door because of something that went on down the driveway of several houses not even near my house demanding me to open the door, and I insisted that without a warrant it wasnt happening, after about 3 hours of this they decided to get the game warden and my landlord to come in my house, and I told the Game Warden he could come in but those police best not follow him and he had to stop the officer from stepping over the threshold.. And indeed much to their surprise, whom ever they were looking for wasnt in my house just like I said they wouldnt be.. 🤬

I had a small package delivered to my house with my address but someone else's name on it, so I wrote no such person on it and put it back in the mailbox with the flag up. The next day as I left for work I got pulled over by a K9 unit that just happened to be sitting a few hundred yards from my driveway. He said my license plate light was out. I asked if he could show me. He walks to the back of my truck, waddayaknow, it's working. "Must have a short in it" he says. I refused to give my license cause I thought the stop was invalid. He calls a Sgt., while we're waiting he runs the dog around my truck and claimed the dog alerted. I refused to get out. When the Sgt. showed up I told him i thought the stop was invalid, therefore the search was invalid, and didnt answer any questions. After the Sgt. talked to the officer they let me go. So question, if the dog had actually alerted, would they have just let me go?

Something similar happened to me. I like to go to the supermarket around midnight because of all the rude people in the late afternoons/early evenings. One night, I was on my way home from it and was pulled over with the same excuse. He said my license plate light was out. I told him I have delay headlamps and make it a practice to look at my tail lights and plate light when I get out at night and it was working at the supermarket. Like you, I asked if I could get out and check. When I did and it was on, he changed his mind and said my plate was dirty and therefore, unreadable. It had snowed earlier and the roads were salted/sanded so yes, there was some road salt on it. I asked him if I should get a windshield wiper for my plate! LOL Because how would I keep the salt off it when I was driving on the wet salted roads?

Yep! The great "Freedom Fighting" lawyer of South Australia represented me for Unfair Dismissal in relation to covid vaccine policy. After 23 years of being a model employee / "team player", I was asked to participate in a medical experiment (NO covid vaccines were "approved", they were only Emergency-Use-Authorised). Despite the fact I only worked from home with zero contact and was on approved (accrued) long service leave, I was SACKED for the "gross misconduct" of not having a vaccination certificate. The great freedom fighting lawyer took $$$$ from me, to get a determination that - despite all the circumstances - my dismissal was "lawful and reasonable".

If you ever watched the movie "A Few Good Men" that is exactly what Tom Cruise's character was; a Navy lawyer famous for completing cases through plea bargaining. That is why he was assigned to the case. To cover for Col. Jessup and the code red incident. They thought he would plea bargain down those two Marines and close the case.

I went thru this. The problem is the cops will say if you talk we'll just give you a misdemeanor ticket, but if you don't cooperate we'll charge you with every crime in the book including felonies. I stood my ground and they threw the book at me. This is why I don't like cops.

"If you're innocent you've got nothing to hide" is a good example of gaslighting. You may well have nothing to hide, but that doesn't mean a cop can't plant evidence. Other things can go wrong for you during the search as well. Perhaps a friend had mistakenly left something behind in your car which can serve to incriminate you once discovered. You didn't know about it, though. You only knew that you, yourself, had nothing to hide. The cop understands the potential, yet would have you believe that relinquishing your constitutional rights is a necessary step in demonstrating your innocence. So then, I'm guilty until proved innocent, and that proof lies in my forfeiture of constitutional rights. I'm sorry, but what country is this again?

For my money, I like it best when we do that with civility. On the other hand, I'm old and pissed, too. I totally get old and pissed. I was raised to trust cops. I was raised to think of them as friends and safe ports in a storm. If I should ever be lost, or of someone is scaring me, I should look for a cop for protection, then everything will be okay. My parents were lovely people, but they did not teach me the critical importance of not talking to cops under certain circumstances. "Joe citizen in the poorest place in the country is worth more in jail than anywhere else ..." Yes, that is true. I'm retired now, but my career was in occupational safety and health, before that my first love, the fire service, all in the federal government. In my latter role, I spent a great deal of taxpayer money ordering safety equipment for our employees from the prison industry system. These were safety products, steel-toed boots, safety eyewear, etc., made by prisoners. As I'm sure you know, the only thing missing in that arrangement was a paycheck for those prisoners. Some argue that the 13th Amendment left a wide-open door for their exploitation, while others might say that it's a reasonable use of their time, inasmuch as they're obligated to repay society for the crimes they had committed. One thing is certain. It's financially handy to have them around and making these various things for free.

Sir, I was pulled over two months ago because I failed to turn on my headlights when I entered the highway at night(my mistake), but after he explained to me that he asked me where I was heading to and I respectfully stated “I would like to have an attorney present when being questioned I’m going to remain silent”. All he gave me was a simple warning and off I went. I always ask for a Lawyer when I’m dealing with Police. 😂 I want to add that most people aren’t that intelligent when it comes to common sense. Your premise is right from the start, do not talk to cops.. here is how I go about and teach, being just a man with some understanding of rights.. if a cop comes to talk to you, the first words out of your mouth is, officer, is this consensual or is this investigative? If its consensual, then let him know you are not consenting.. if he either changes his mind or just says its investigative, then you need to immediately exercise your rights, officer, I invoke and refuse to waive all my natural and unalienable rights, do not ask me any questions whatsoever without counsel present, I do not consent to any searches or seizures of me and or any of my property whatsoever, and I invoke my right to remain silent at all times, Officer, you are now on the clock for your investigation, the time is ______< stating the time.. and then shut the front door.. the only thing out of your mouth is to ask if you are still being detained or free to go.. or if you wish to remove the officers qualified immunity, ask him or her questions.. but nothing out of your mouth is anything but in the form of a question.. It may be you get arrested and are taken into custody, but demand counsel for any and all questioning.. and until you have had a chance to speak with counsel, you do nothing. not even IDENTIFY.. Once I have had time to speak with counsel, then we can go on from there.. trust nothing a cop ever says to be truthful, consider everything out of their mouths to be lies.. and most of all shut the front door and keep it shut..

Hello Mr Foley, after watching your video and many other similar ones, as a foreign tourist willing to visit USA, I feel discouraged by the behaviour of the Police and the too many weapons in USA in the hands of crazy people. I have been pulled in my homeland Italy several times by the Police, Carabinieri, Guardia di Finanza, often with colleagues handling rifles, but always got plenty of courtesy and any kind of harrassment. Neither in other European countries. Pulled, checked ID, licence to drive, car insurance, and have a nice day. Anyway I thank you for your lessons, they are surely plenty of experience in... We had a good conversation in the woods, officer Sumner and I. He was investigating the homeless, tent site that I was cleaning up after it had been abandoned. That's what I do, clean up after homeless sites have been abandoned in my community park. And yes, he was very curious as to what and why I was doing there. He relaxed and I began to like him. Afterwards he followed up on my suggestion to ask the park's department director as to the veracity of my story, which he did. I also asked him to ensure that my name was in his report. He said that he would. I take my chances with the police, rather than to see them all as the being the boogie man. Not all men are created equally.

For me the biggest problem is that some officers get irate when you don't "cooperate", even if you're Constitutionally protected. That can be frightening. Having my day in court is one thing, but doing so in a wheelchair or life-long injury because a cop had hurt feelings and didn't understand the Constitution is another. They're armed with a plethora of weapons and immunity and can seriously mess you up. I still keep my mouth shut, but it's hard when they're acting-out in an extreme manner.

I was watching a live golf match on tv, i walked across the street to the store and got a sandwich and some beer, on the way back a cop pulls up on me and bleats his siren, i turn around like "who me "? he starts asking where i've been etc, i said i was just watching the golf game "what's this all about "? and he says a peeping tom case, i said "well i can describe the whole match up untill the 14th hole and unless this person had the game on then i should be cleared, he just let me go , i never bought the story of a peeping tom.

@@retroguy9494 You're right but it was many years ago , now thanks to the brave men and women auditors i know my rights, as do millions of other Americans, it must be a culture shock for cops to see us standing up for ourselves instead of just rolling over for them, they don't what the hell is going on , well they better learn quick!

@@user-gx2yy1df6f Yes, I agree. It WAS different years ago. But lets face it. So were cops. They weren't always out to nail people no matter what years ago. We had more 'community policing.' It's a GOOD thing that we have lawyers and law school professors who make videos informing us exactly what our rights under the Constitution are, that's for sure. You're right. The cops don't like it one iota.

Why do police need consent at all? If the Supreme court says are allowed to lie they can just claim you gave them your consent when actually you never did.

NEVER Say "Go get your dog" because that can be used it court that you agreed to extend the stop to get the dog. A stop cannot be legally extended past the point where the reason for the stop is over, unless there is probable cause. The police can't hold you until a K9 unit arrives, unless you consent to stay, and police trick people into that consent by asking questions so that the person will flippantly say, "Go get your dog"

Sure a stop can’t be extended but it happens every day. The person has said I do not consent to searches. I don’t consent to being detained. I don’t consent. Saying go get your dog is not consenting. That won’t hold water. It would be like an m80 in a toilet. Destroyed.

@@retroguy9494 do not say as word. You say “why”. That cop can say you’re slurring words and get you out to take a roadside. I’ve seen it happen. When we say don’t talk to cops - we mean it. There’s always someone that thinks they’re the smartest person in the room and finds out they’re not. Don’t talk to cops.

@@karinaz8756 Well, you HAVE to talk when you need to assert your right to silence under the 5th Amendment. If the cop plans on lying and say you are slurring your words, he would do it anyway and say he observed it when you asserted your right to remain silent. I used to wear contact lenses and a couple times I've gone through those DUI checkpoints and I was also stopped and the cops tried to claim I had been drinking or was high because my eyes looked 'glazed.' I had to tell them that was the contact lenses they were shining their flashlight on. Then there was the time at the DUI checkpoint where the cop literally stepped on the running board of my SUV, stuck his head in the window and sniffed! In the worst way I wanted to say 'geez if you find me THAT attractive why don't you just ASK me out?' 😂

I always tell cops I’m recording them from a public easement, I do not consent to searches, I do not answer questions, and I’m recording them from their accountability along with my safety. In addition tell them if they violate my rights I’ll tell them they will be sued.
