Top tip my friend, don't go for the body worn camera too early. Give them enough rope to hang themselves, wait until they're about to leave then ask them about it. This way you get more interaction and they have no grounds to say 'I haven't had the chance yet' because they've had the whole time. Keep up the good work though ✊

That officer needs to go home and learn the definition of “Breach of the Peace”, before he starts threatening people with arrest, absolutely laughable. He had better shape up before he gets himself into trouble, breach of the peace indeed, for a lawful activity. Knowing the exact definition of Breach of the peace Is about as basic as it gets for a police officer or special constable. Not only that but the breach has to be “Real and Imminent” , that’s from a stated case, Foulkes v Chief constable of Merseyside police. Mr Foulkes wanted to get back into his house one night to get some stuff after being locked out after a domestic earlier. It’s all on the net if you want to know what Lord Justice Beldam had to say about it all.

As for the officer he doesn't understand the law regarding section 5 of the public order act, again a master class of why the met are in special measures because they are a failing police force

Section 33 of the criminal justice act doesn't give you explicit permission to record in a public place, it only deems what is classed as a public place. But you can record nearly anything you can see in a public place which the job centre is at its material time because the public have or are permitted to have access, whether on payment or otherwise. I say nearly record anything you can see in public because there are actually certain things that would be classed as illegal if you see it and recorded it.

You have watched other audits to gain your knowledge of the legalities. Most of it is wrong. You can be chucked out for filming. I never really understand why auditors continue to target job centres, Its a no win situation. @auditpundit well simply filming in a public place doesnt make his presence a criminal matter/aggrevated trespass so its defo a civil matter, hence why the police threatened him with another crime altogether of "breach of the peace", which he wasn't actually guilty of either because to cause a breach of the peace you must be "using threatening, abusive or insulting words or behaviour with intent to provoke a breach of the peace or whereby a breach of the peace is likely to be occasioned". If you have any info to the contrary i would like to know but seems pretty cut and dry, legally he was in the right and the staff and police just got in their feelings.

@@ItsEasyJustLift The BoP would have been for attempting re-entry after being banned. Nobody is claiming filming is criminal. But if you're on private property and you're filming they simply invoke trespass law to get you off the premises. Even though it's a civil offence the security are allowed to use force to remove someone, so if you use "self defence" against lawful force, that would amount to an assault. Therefore "warning" them he would use self defence constitutes a threat.

The other cop ignored your question if you were detained and then lost his temper afterwards because you were so persistent, very unprofessional to lose your temper like that. And also this cop doesnt really listen to people so whats the point in having this job then ? A High Court Judge made a precedent in which he said any building which the public par for totally or predominantly then it is public and they can record anything from public. If it is a private building open to the public with a reception the entrance from the bopundary to reception is also public during opening yours and it is NOT the law as it is their policy and they assume their policy applies to the public and illegal/unlawful signs have some authority when they dont. Strange how a FOI request never reveals their filming POLICY as this instructs staff to try and stop it and ignore the law then they cover up their staffs unlawful actions so bring a claim against them. The irony is that they say no mobile phones and they have QR codes for your phones. That security guard needs some serious exercise and a bacon slicer and he cannot stop you entering. It is NOT a civil right as it is illegal not to wear it and actually a criminal offence under section 9 of the SIA codes which are law. Strange is not illegal but stopping or impeding a lawful activity is an indictible offence and their secure areas have key locks. They should also be checking their CCTV. They tried it with me and G4skins ended up in hospital and they are in court now. He cannot stop you from going in there as the law he is employed by the public to uphold and he is now breaking the law and trespass is a civil matter. Complaint about these also and bring a claim.

1. You shouldn't of left the building, g4s have no legal right to touch you UNLESS to self defend themselves which is in their policy! 2. Even the police cannot remove you for filming from a public place which a job center is, they may ask but they have no legal right at all.! 3. Wait untill the pigs are about to leave before asking if their cctv is on and filmed you. Its a process and learning curve but stick in there pal good work keep going 👍🏻

He's got it nailed down perfectly. The power of his argument is normally the cost to the DWP for each & every violation. Think the figure he uses is 'a maximum of €20m', which I believe is correct. He's made quite a few jaws drop. Deffo get a complaint in against both cops. Obvious for the one who talked to you, and a refusal to identify for the other (unless I missed the basturd replying).

Auditors are ok in there place but the laws needs to change, the photography law was from back in 72 when people didn't have cameras on there phones and small camera that you can wear wasn't a thing, places like job centers and anywhere someone may or could be divulging private information it should be iligal for a member of the public to record, truly UK law needs to change

The public should not be seeing anyone's private information. That onus is on the organization that holds it. For example in a job centre they have QR codes for scanning the details of a job. So how does one scan the code without a recording device? Fyi every job centre has been sent a memo regarding recording in the public area which is permitted.

Crazy how completely Incompetent the majority of Police seem to be. See it in any job, but it's worrying when they have so much power and most people wouldn't know otherwise!

Why didn't you go back inside to enforce your rights to film in a public place? If you're going to stand up for your rights, you need to go the whole hog and get it across through court action. Then you can sue the police for wrongful arrest.
