Does the Wash sale rule apply for tax gain harvesting? Do I have to wait for 60 days to buy back after-tax gain harvesting?

If taxable income is 104,050 - and that includes $20,000 in long term capital gains: is 10,000 taxed at 15% and the other 10,000 is at zero tax?
