Builder told that ki abhi subvension plan bhand ho gya hai lekin hamare project me aap subvension plan bhi le sakte hai... I am confused about this things.. Hi AY , In my agreement, there is a Subvention date mentioned, Subvention date = May 2021, But in the next paragraph it is also written that Builder has to pay the Pre EMI / Interest if possession is delayed. Now the question is builder MAHAGUN has stopped working on My tower after completing the floors and taken money from Bank. DO I will have to pay the EMI after May 2021, Since the project is delayed by 2-3 years.

Banks have stopped subvention scheme totally now. Hence builder now says that client may bear interest which he will reimburse. What would be income tax implications on reimbursed amount. Will this be treated as income and taxed by IT dept?

you have explained so well, thank you so much, bohot sare doubts clear ho gaye, bas ek question hai, just say if possession is mentioned in the agreement & if the delay happens for the project can the bank start taking EMI from me? stating that they cannot wait for any more & they have to charge me with EMI, I also wanted to know I have another property I want to sell that & get money out of it & I dont want so much loan how it will work in this sub-vention scheme?

I took the home loan in June 2022 and the flat was under construction but I got the flat possession with a letter on 21 March 2022 (Before 31st March). So can I claim the ROI & Principle amount in ITR for AY 2023-24 ?.

Your explanation is very nice sir. If the Builder not respected his commitments and sold the same flat to some other buyer and got to know to buyer before position. How buyer can handle this situation with builder. Banks will ask the buyer to pay the EMI's and builder is not responding to buyer. In this case Buyer to file a case and any contribution from bank in this agreement. Is Buyer to pay the EMI's without having property from builder ?

Sir, I have book a property under subvention scheme & under the tripartite agreement there is no EMI to be paid for 24 months But I also have received a MOU/side letter which states that buyer need not pay EMI uptill 30th slab or 24 months, whichever is later. So if my 24 months gets completed then i'm liable to pay EMI or not? Or once the builder complete the 30th slab my EMI starts.

I took subvention scheme back in 2019 have not seen the tri party agreement. Secondly. My bank said your insurance will be started for approved amount . So I have been paying insurance group policy provided by banker from 2019. Is this how under subvention group insurance for home loan are provided. Please confirm

Sir, मैने होम लोन लिया था sbi बैंक से। tri party aggreement भी हुआ था। पर बिल्डर ने defined time में possession नहीं दिया। RERA राजस्थान में केस किया। decision मेरे favor में आया पर बिल्डर ने पैसे नहीं दिया। में 53000 rs की किश्त pay कर रहा हूँ हर महीने। अब आप बताएँ की क्या मैं emi pay करना बंद कर सकता हूँ। क्या करना होगा मुझे...???

You can approach the concerned RERA authority for refund. On closing the EMI, your CIBIL will be adversely affected.
