There was absolutely no reason for his bad attitude from the very beginning. An A+ is simply absurd. At best, he deserved a C. The lady officer deserved an A because she expressed the very beginning that he hadn't done anything wrong.

I wish more officers thought like you do. All the officers have to do is inform and move on. By constantly questioning and threatening, it turns it into "an issue" where citizens are fearful and quite literally "shake like a leaf". We do not live in a time where laws are followed and justice is served, from cops to citizens to courts. Because of this, citizens are fearful for exercising their rights. Today, only one side is allowed to exercise their rights, both in public and on the internet. Cops can be the ones to stop this as they could have here. YOU are taking that step and making a difference by educating cops. Thank you! Cops should only threaten a citizen with arrest if the citizen is in danger of being arrested for a particular action. Otherwise, inform the citizen of the complaints others are making and then move on. Quick, easy and peaceful. Quite literally, To Protect and Serve.

She’s marginally better. She didn’t threaten with arrest, but still felt the need to back up her partner. I feel this is a problem with training more than it is her attitude. Her partner was eager to escalate and she split the baby.

There's no such thing as "free speech". You can't say "bomb" on a plane. You can't shout "fire" in a crowded theatre/cinema. You can't incite violence, can't spread misinformation, can't share national secrets with the foreign agents. Your 1st Amendment will not protect you if you do any of those things. Your "free speech" is tolerated at best and is policed and censored, regardless of how you feel.

The two officers should be graded separately. The lady was pleasant, the guy was terrible, went as far as to accuse him of being on something.

Yeah, the woman did nothing wrong. She got a call and asked, person to person, without threats or use of authority, if he could bring it down. He said no (in what was perhaps not the best way he could have) and she was like " yeah you have the right". The male officer was the problem here, threatening baseless disorderly conduct and drug charges, escalating the situation for no reason, trying to cause a problem. At least from what we see in the video.

@@fatsidekick Yes, as stated here, her initial approach would lower her grade, she was not a model officer. However, after initial contact it seems pretty clear she is attempting (and successfully) restraining Officer Arnold, who obviously would have liked nothing more than to escalate the situation and have an opportunity to "exercise his authority." It really seems like every time she repeated they were not going to arrest him nor were they threatening to, she was more telling Arnold than trying to assure him (obvious because Arnold clearly did threaten to arrest him.) Honestly, I'm not entirely sure it wouldn't have been better if she hadn't done that. He is obviously going to be a problem once given the opportunity.

Very true. I myself have been convicted of this 3 times in my life. It was years ago but it was exactly like you stated. They just didn't like me and used it as a way to retaliate. I could say that if I had been living life differently at that point of my life I probably would not have been charged. However that isn't how things are supposed to work. Live and learn I guess.

He was trying to intimidate the auditor but the female cop was being diplomatic with him. That's what makes these things so stupid because one cop can be decent while the other cop is a dickhead undermining the whole thing.

They are ALL, SPECIFICALLY trained to do this $#!T. It's part of an elaborate "investigative tactic", commonly known as a "fishing expedition" it's a clumsy, transparent and ridiculous intimidation tactic. They stop you on some fabricated pretext.... they say "someone said" you were weaving while driving or you didn't signal early enough, or no seatbelt. From that stop alone they immediately begin looking for ANY excuse to turn their flimsy, catch all, elastic, "probable cause" bull$#!T stop into a felony arrest... Barney Fyfe gets a felony bust logged on his employment jacket, the city makes bucks from the fines, the "legal" apparatus makes even more bucks prosecuting/defending you and YOU (If Black, Latino or other non-white), gets brutalized, injured, criminalized, incarcerated and put into the prison industrial complex where even more "revenue" aka profits are generated for bond holders and investors. Personal experience; I am walking to the post office with a box under my arm. A box I packed myself. Someone had called the cops. I guess they thought I had stolen the box off someone's front porch... Two cops get out of their cars. I stop and all I did was drop the box at my feet. 1st cop; "Dude, dude, aaattituuude..." My response; "Define attitude" No reply. He shuts up 2nd cop "What's your name?" My response; "What can I do for you?" That set the tone for the whole interaction in which I got asked for ID, where I lived, where I was going, am i on medication, had I been drinking (I have never consumed alcohol), why am I looking around - well, 8 more thugs with badges had shown up by then so I am going to LOOK at ALL of them. One walked around behind me. I turned to face him. He goes back with the others. One asked could he look in the box - I said; "You know you need a warrant for that, right? But go ahead..." He unsealed the box looks through it, finds my personal belongings, closes it and looks at the other cops. Fishing expedition failed! The next "probable cause" pretext question came from a cop on the verge of obesity. She asked; "what's your social security number", To which I ALWAYS answer; "Are you with the IRS or, do you have a subpoena with a judge's wet ink signature that I can read?" Chubby female cop; "Well we need to see if you have ANY warrants" My response; "I don't (which is true), I will NOT give you my SSN and if you continue to harass me about it, I am going to request that your supervisor come down here with a complaint form." Chubby female cop - voice getting elevated and "authoritative"; "It's the law, you have to provide your social" I said; "Could you show or cite me that law? Lady, codes, statutes or policy is not law." 1st cop; "Are you a lawyer?" My response was to look him in the eyes, smile and deliberately say nothing. They all looked around at each other shuffling their feet - cars werevsholing down, drivers looked on, some guy across the street had started a video recording - they noticed him and somehow decided I was free to go. See, they ALWAYS try to get you intimidated, flustered, overwhelmed and talking. Unfortunately most people fall for this cheap parlor trick, get scared, talk way too much shake, stammer and provide these thugs with exactly what they are after. Information on which to arrest you or fabricate a case against YOU. Shut up!! When you get scared adrenaline rushes into your system. That causes your hands, lips etc to shake, your eyes tend to dart, your pupils dilate, your nostrils flair. This is all a normal, natural, non-drug induced response to adrenalin. Here is how to counteract that. 1. Realise you are in a state of fear 2. KNOW the fear response is coming, it WILL be visible and WILL be used as pretext 3. BREATHE - slowly and deeply. This is important. 4. Focus, engage your mind, LOOK at each and every one of them for - features, marks, scars, tattoos, eye color voice tone, mannerisms etc etc When stressed your brain appears to slow down events. Use this to memorize EVERY detail. Trust me it works. 5. If your voice quivers or stutters, if these mutts cause you that much fright. Say NOTHING. That's right become a wall of silence. They can ONLY go on what you give them and when you are under duress say NOTHING. 6. If you are focused and confident. Take charge of the situation - NO, that does NOT mean yell, scream, posture or become belligerent - quite the opposite. Become calm, breathe slowly, speak softly, answer their questions with questions of your own. Example; Cop; "Have you had any alcohol today/tonight?" You; "No, but thanks for asking, have you.... what time was your last drink... what time did you start your shift... do you often drink before your shift... is alcohol a substance you abuse... do you get blackouts? Oh, YES... look them dead in the eyes.... quietly and deliberately GO there!! Understand that many of them have substance abuse issues. They are stressed, fearful. Sign could have legally been placed there. Many cities have permits you can buy which allow you to install the signs for X number of days. Just have to pay the fee and then cleanup when done. source: I used to pick them up late at night. Part of my report was to inform the city the signs were removed prior to the date. And to Taddy, they are super effective and finding motivated home sellers. When someone just wants their house gone fast, they generally call these signs are the junk mail they receive. They get only 60% of the value of their home, but it is fast, hassle free and almost never any issues. Just boom, bang, boom, done! Cash in hand. So great for many people. Home owner gets rid of their house they don't want. And the buyer now has a cheap home they can sell, flip, rent, or bird dog to someone else.

In reality, they had no reason to even bother getting out of their car. It is quite clear that no crime has committed and no crime is in the process of about to be committed when you pull up and see a lone protestor holding a sign. If they weren't trying to waste their own time, they would have just immediately pulled away instead of getting out and trying to deprive someone of free speech.

I think he at least deserves an A, if not A+. He may not have de-escalated, but he didn't get nearly as agressive as some auditors in these videos. The female officer was very clear when she pulled up and said "I can't let you hold up that sign." She basically said "I am here to with the intent to stop your free speech." After several other encounters with cops that same day, she was the first one to pull that, and the male officer was attempting to escalate into an arrest (suggesting disorderly and intox). I think Porter handled himself very well, all that considered.

They should just start politely telling people "I apologize Sir/Ma'am, but they are acting within their 1st Amendment right and there's unfortunately nothing an Officer will be able to do unless they are trespassing on private property. iN tennessee a man was arrested in his home by a police assent chief of police for using a foul word SONOFBITCH while standing in the mans living room, he was charged with disorderly conduct and fined a 100.00 in city court, The police had no warrant or permission but didn't need them because the mans address was classified as low income or poor area and people who lived in that area had no rights except for police rules they were forced to obey, the case was appealed to the sixth circuit and they ruled in favor of police, constructional rights in tennessee not in this lifetime.

No doubt someone has already said this as this video is two years old: I realize it's easy to be nervous around the police and hindsight is 20/20, but your voice, tone, etc. was *escalating* the situation. Less said is far better. I'm sure looking back you might have said, "Hi officers, how can I help you?" "Am I guilty of committing a crime and if so, what is it?" All in a calm, respectful voice. I thought the woman police officer did a marvelous job of keeping HER cool while you seemed to be very agitated and somewhat disrespectful to them. I commend you on exercising your 1st Amendment rights and recording this video. Wow, 2.34M subscribers. It makes my 162K look like chicken feed! Congratulations indeed.

So as much as it may seem dumb, the cop probably could have arrested him for being disorderly. Although the charges would probably be dropped or overturned when it escalated in court.

i (civilian) pulled a cop over for multiple rolling infractions in a congested area today. his sergeant wrote him an honorary paper ticket in front of his FTO so he’d quote “have a tangible reminder that we’re obligated to be better”. these cops ain’t nothin but people y’all get out there and let em know they’re watched just be informed for the love of god or you will get in trouble

The female officer changed her story. Around 12:51 she says she's not there to tell him he can't hold up his sign when at 1:01 that's exactly what she told him.

After her initial confrontation, the lady cop seemed to change her demeanor, at which point, she was making more of an appeal as a request than as a legal mandate. And she was right - the citizen was discourteous to her. Asserting your rights does not require being a jerk. He did not catch that he had won her over. A better response would have been - "Thank you for respecting my rights and for your courteousness. Your request has been noted." So whereas her initial response was a C, we ought to give her credit (a B+) for doing what few cops hardly ever do - realizing on the spot that they are wrong and acting on it. In my book (the good book) that's huge.

It was a call about an offensive sign, therefore the OP was right, pull up observe then leave is the right action. If it was a call about somebody who's armed and may be a threat then that is a completely different context and requires a completely different type of response.

Exactly. Police officers have the right (and duty, IMO) to investigate behavior that may be criminal and/or disruptive. But once they determine that someone isn't doing anything illegal, then continuing their investigation becomes an attempt at intimidation and harassment. Personally, I have no problem with a police officer conducting a legitimate investigation, but I have MAJOR issues with a police officer attempting to intimidate or harass people.

They put the car on that lane so people dont use that lane to increase their safety while standing near a road on a intersection. Theres a lot of reason to dislike the polices actions, but lets be fair when doing so and only call out the (many) things they are actually doing wrong. This is the way they get trained to do

They get protective of her, but due to poor training think that a show of authority is the best way to go about that. Sometimes it might also be compensating for their own feelings of insecurity. Interestingly, female cops typically have the opposite effect on suspects. They're disarming, especially when they're as cute as this one.

I usually agree with the letter grades but A+?? He started off antagonistic and only got worse throughout. Even if he was right, that attitude alone knocks at least a few points off. It certainly has in the past

The guy was a complete asshole and behaved in an aggressive manner. The police came along talked and then left. That gets them a C. The asshole argues, shouts, was disrespectful gets an A+. Should have been given a D-.

Yeah, IMO the main reason that dude's out there IS to get his rights violated. He knows that news coverage will do a lot more than a stupid profane sign.
