All done was by her brother who is poor, and took care of parents all life.. She never cared for asking about money if we need to buy medicines.. So will this law applicable for such Greedy and selfish daughter
@chhayakant89444 жыл бұрын
This condition only applies to the situation if the girl( sister) had love marriage but it can't be possible through arranged marriage because as such conditions can't be a part of arranged marriage as "having similar status and wealth of the groom's family " is a parameter in most of the arranged marriage. So the condition of brother is poor and sister is rich is somewhat not possible in most of the cases . But it can be possible that after the marriage the girls paternal family get poor due to some reason but the possibility is still less but it is possible . In such case there is a provision that if the Father or mother or the property owner is alive he/she can write a "will" and signed in that "will" mentioning disqualification of the daughter from the property. The Hindu succession act only applies in case of unfortunate demise of the property owner ( father/mother) it can't be applied if the property owner is alive so your arguments are lacking the basic facts . Your argument is totally a absurd hypothetical situation.

Before fighting, understand this in indian culture, about 95% married daughter will never want a share of fathers property in case of having a brother. Those daughters have their own property with their husband. This is why people are ok with either one. Either daughter gets share or not. They are getting it one way or the other in the form of their husband's property. In case the wife demands property from her father the supposed Sister of her Husband will want to share the property of the Wife's husband and the chain continues. There are exceptions everywhere. Also the point about "if the father has debts and property. Then either of 2 things can happen 1) brother and sister share property and loan 50-50 equally. 2) sister forfeits the right to property and loan.... or brother forfeits the right to property and loans with mutual agreement.

Idiotic move Also make a rule if father is a loan defaulter and has a huge debt make sure that it is divided among both the son and the daughter I personally believe it is very bad move. It promotes Dowry A father has a daughter and a son. In right marriageable age the father will try to look for a suitable son in law for their daughter. And as the matrimonial sites shows they go beyond their own family income to search for one ( family income 10 lakhs p.a ..... looking for above 50 l.p.a ) Therefore daughter gets both husband's share and her father's share... There's no such scope in Son's case. Therefore son will try to make it up by taking as much dowry as possible The above case is not applicable for all individuals but a majority in rural areas where dowry is still the norm Don't come barking in with heated stuffs If you wanna debate make it a rational one
