Hisoutensoku is cool and all, but what about a Touhou-styed Smash Bros. fangame? That was supposed to happen, but it failed. Why did it fail? Was it sheer incompetence at it again? Was it failure to do duties? Was it because the programmer was a Yoshi main? I will explain to you why this fangame was supposed to exist... but suddenly didn't!!

it remind me of that guy who completely remade touhou 5 to be in the style of windows games but was scared of zun and kept the game to himself idk why then posted 2-3 videos about the game for a april fool joke thing THEN completly died after that for no reason

Indeed, that is JynX, who went on to work on the Len’en games instead afterwards. I think the reasoning behind it is that since he is copying the patterns, dialogue and gameplay, even though everything else was technically his assets, it could constitute copyright infringement.

Yeah that's JynX (repeating point) There are more stuff here, such as demo version of Re:PoDD (fools rush in, which was also published in April fools) and video of Rin Satsuki's battle using BPoHC engine (the engine used for their own Len'en project) At least it's not the shitshow that was shown in the video lol. It's not like JynX tried to make money out of these remasters (not counting soundtracks) without TSA's permission On tangentially related note, while JynX (Trick Nostalgie) holds the rights to Len'en project, the og Len'en was made by doujin circle Lapxus (who consisted of JynX's "upperclassmen") called "Emergency Everyday" which was basically Touhou but with guys who are self-inserts of circle's members. There exists a footage of the game, but that's about it (JynX said the game was almost finished) - no one knows why game wasn't released in public, there wasn't even a demo released with that video. Daijin (the leader of Lapxus) did eventually gave rights to JynX under the condition that JynX will keep the name (Japanese title at least) and that JynX will have to erase the trace of characters and locations, thus giving birth to current Len'en (which imo was a better decision, Len'en has a much more immersive lore while EmEv was just about dudes fucking around in 2D world). Suffice to say that EmEv is dead and is part of lost media. There is a footage of remaster of the third stage of the game made by "Retrograde Road" (formerly "Team Gaijin Alex") using GameMakerStudio, but as of now, the game itself wasn't released, only remastered soundtrack. And while JynX had been in contact with Daijin who served as a playtester, as of 2021 to the current day - Daijin went under radar completely. So yeah... It's not the first time it happened kek

Mokou/Kaguya would be perfect for an MK style game. They could get brutally murdered and still be fine afterwards.

and now years later a really impressive trailer for a Touhou platform fighter called Touhou Fractured Transience was shown which has really nice sprite work and music. Its really worth it to check it out

As far as I understand, ZUN is totally cool with fangames, as long as you credit him with for Touhou itself and declare you're a fangame, you don't steal assets from the official games, and offer your game on a platform that Touhou is offered on (e.g. steam). Given this, I don't see the issue here with needing permission. Is the issue because the crowdfunded, or was this game being planned before ZUN had his current policies in place? I can find the source for ZUN's policies if needed.

What did put a halt to the game was the crowdfounding was done before Zun gave permission. If they had the greenlight to make the game before, it would be completely different. in a nutshell: you're free to do any sort of fangames based on Touhou Project, under the strict rules that are: 1) Zun must be aware about your fangame project before you actually make it. 2) Zun / Team Shanghai Alice must always be credited in any fangames.

Alright I found three sources, I'm modifying the links since Susan keeps shadowbanning my comments. Just delete the spaces, and replace slash and dot with the symbols. 1. From 2011: first guidelines, probably out of date by now: kourindou dot exblog dot jp slash 14218252 slash 2. From team Shanghai Alice official website. More up to date, but still hasn't been updated since 2019. The link that supposedly links to the derivative guidelines is dead. www16 dot big dot or dot jp slash ~zun slash html slash sbbs dot html 3. The most recent guidelines, from 2020. These are the ones I take as current: touhou-project dot news slash guidelines_en slash My conclusions: I'm going based off the most recent guidelines. From a legal perspective, these are written/translated horribly, and if I theoretically took this to court against ZUN, and he tried to defend himself with this document, then ZUN would probably lose. However, he does say if you're "a legal person creating a game as a business activity, then contact [ZUN]". Which would squarely apply to this studio and this game in the video. However, I'm not sure based on this video alone if Touhou smash was created before or after these guidelines were implemented.

I remember this. I even tried to warn the developer when he posted the first video showcasing the project and the kickstarter for it. His responses were so childishly contrarian and argumentative that it was obvious that the project would fail. He, among other things, tried to argue that ZUN's guidelines wouldn't apply to him *because he wasn't Japanese/in Japan.* Basically every concern I brought up, from the crowdfunding and the spirit of doujin culture, to possible copyright issues and the legality of derivative works in Japan (Look up "Author's Rights" under Japanese copyright law, and you'd understand), were handwaved away, claiming that they had everything under control. At some point you just have to step back and settle for watching the ensuing trainwreck from a safe distance. Honestly, their past projects were sub-par at best, so I don't think much was lost, either way. It looked, to me, like a cheap attempt at a crowdfunding cashgrab, using the popularity of Touhou and Smash Bros to sucker people out of their money.

I got involved in the argument with the developer when all this went down. Feels like years ago. We found him editing articles on one of the wikis in regards to ZUN's guidelines I think it was... He edited something on the wiki. I remember that much. Aside from that, he spent a ton of time backpedaling on why ZUN was wrong about his own guidelines, made video responses to accusations, etc. Guidelines aside, I don't think it would have turned out well anyway. Both the designs and their gameplay philosophy were pretty terrible. People only started taking notice of the game when a gameplay trailer was showcased and mostly found it 'lacking,' in kinder words. From there the crowdfunding aspect became a lot more public upon which ZUN got involved. You could honestly say that the trailer doomed them, because otherwise it all might've fallen under people's radar long enough for nobody to bat an eye.

"Wrong about his own guidelines" This guy effectively says go ham with my IP and do as you please, just get my blessing and give credit. Compared to almost all copyright which take up the most of the budget in securing rights and this guy still found a way to get upset, fucking hell.

i had some similar arguments with the dev about balancing in anotber game she was making. There was an area where an enemy would chace you and youd have to crawl through this hole to escape, but the wall was short enough for it to hop over so it would just cut you off at both sides by going back and forth, so you couldnt get out without taking damage, and she just dismissed me pointing that out as a problem and her argument was essentially "well have you made a game before?", not really saying why letting the enemy behavior be that way is a good thing, just an excuse why my feedback doesnt mean shit, even though you dont need to know how to fly a plane to tell when someone is doing it badly.

You have a good eye for Touhou controversies. Would you at all be familiar with the Cookie community? That Touhou subculture has so many weird characters, memes, inside jokes and controversies that you would have to make an entire series to explain it all.

@@akiradkcn cookie is a subculture that came from a Touhou voice drama called "Marisa and Alice's Cookie Kiss" that had amateurish voices, arr and animation. The Japanese internet made fun of this video in a "so bad it's good" way with remixes of their own, much like KZbin Poop in the states. If you search for these videos, beware. Half of them have clips from Japanese gay vids. A very effective way to keep out the normies.

That's why ZUN's policies are mostly centered around Doujin in Japan and not directly the world. As I understood from this video the amount of miscommunication is just too damn high.

I was there for this whole debacle, outside of the boring forum stuff I really wish there was a happy ending to this story, even if it still went down the route of Nansei releasing instead. I actually remembered and went back to it a few months ago. FromSoySauce is basically dead now, though, and the only brother who still works on games is doing something completely different, now. I think there was a statement somewhere that Nansei is effectively dead, too. Very unfortunate.

Hey, im actually close friends with the developer behind this. Shes still doing well, and still making games actually (although, under a new company name). Shes definitely improved alot since this, and shes doing pretty well off now, if you all wanted any closure or updates on the matter. The whole TSSB thing was a big mistake she wants to move on from and do better stuff with original ideas, and i think shes doing good on that.

I think my comment bugged out so I’m going to try posting another, shorter one. I do remember this “drama” because my own community, centered around Nansei Project (a touhou spinoff music series made by LENK64) asked them to not use the name “Nansei Doujin Spirit (as mentioned at 7:15). They agreed to that but kept using the name “NS” for their devlogs as a placeholder, until their full work was eventually deleted from the internet.

About 7:14, the Nansei Project community, an unrelated Touhou spin-off music project, contacted Saijer and his team when he rebranded what would become the base for a new game as “Nansei Doujin Spirit” as we wanted them to avoid using the name. They did agree to it, although they kept the title as “NS” on their future videos, before taking everything down (I believe in late 2016?). I thought sharing the anecdote would be interesting! If I remember well at this point, it was supposed to be a game with its own original characters (I remember the main one being a character that was based around using paint as her ability).

Ah, I remember when this unfolded back in the day. I was swepped up in the hype. Though I do have a few corrections on some points and some tidbits not mentioned in the video: ( Wall of Text! ) The "Wii U" version was actually a misunderstanding. yes, lemme explain... So the devs were interviewed at an japanese indie website due to their previous game which were made in Unity iirc (way before it was seen as a shovelware-developement tool), with a small blurb of them talking about their next project being the Touhou Smash game... however, right after that the article talks about this studio's game coming to Wii U soon. This sadly was misread as Touhou Smash releasing on a console, which was the twitter post that Zun reponded to with "This isn't good." The game was gonna switch models for the characters later in developement, going from the more western styled designs (which made the game stand out) to generic MikuMikuDance esque Models that alot of indie devs were using (which made it blend in, but generic in my opinion). However... that didn't happen with game developement halting. Similar to Yandere Dev, FSS did release semi-regular update videos of their progress, sadly can't remember everything other than each member having a character and warbly voice filter. It seems the developement of the game had taken a toll on the main programmer as he said that he "locked (him)self in (his) room" to get a new version of the game done. As someone who casually worked on his own indie game in his spare time after work before, I know the feeling of burnout more than I want to admit. It becomes especially bad around a set deadline, but I can imagine it gets really tiring when there is also socials like Forums and Twitter to keep track off. The moment where one just shuts themselves in and drowns in their work can really happen. The C&D Situation was the weirdest. The Dev constantly responded on the forum with "We got an e-mail, we don't know what it says", instead of going "We got an E-mail, we are currently getting it translated." still hopeful that they had the O.k. But one final thing happened before the game got fully cancelled... (after C&D, during move to new IP) the main dev released a 30 minute video... in which they ranted and tried debunking the accusations, vented out their frustration with programming (as I mentioned 2 paragraphs ago), pointing fingers at a chinese indie dev using Touhou characters in an indie dev game fair over in Asia, (don't remember if japanese or china, sorry) in a "why are they allowed, but I am not" and accusing ZUN of being anti-foreigner. (IF, I remember correctly, it's been years since I remember the exact phrasing) Let me reitterate: THE DEV accused ZUN of playing favourites (japanese) and trying to expose him for not being a "single man dev team", aswell as Team Shanghai Alice being owned by another company to keep up the lie about "one-man dev". Imagine all that, with Pheonix Wright music in the back throughout most of that video. small tangent about the "not a single dev..." thing. Yeah, shock oh shock, Toby Fox had help with Undertale aswell. (Credits are there for a reason.) but with how big touhou had gotten... obviously ZUN had to made a company to protect his IP and had close friend and legal advice. It also seems to be a big misinformation that ended up blending "oh you can do whatever, if it is doujinshi" and "doujinshi is just japanese indie". Doujinshi *is* indie, but yet completely different how they see it. Oh yeah and this video ended up including doxxing the location of the "secret company" and another member of Team Shanghai Alice, which surprise surprise... was someone on the Forums who gave FSS advice to NOT do the crowdfunding/indiegogo... STRANGE, isn't it? Yeah, essentially it was common knowledge on the forum but instead of taking the hint and rethinking things, going full steam ahead on the crowdfunding (which is seen by japanese devs similar to investors and "getting paid for work that hasn't been finished"), they kind dug themselves a deep hole that could have only been escaped with an exceptionally well made game... but while I don't doubt the dev would have had the skill for it... they way they handled the situation ended up being the final nail in the coffin, (and this was after they started making the switch to unique IP). I do not want this read as an attack on the video maker. As someone coming in years later just seeing the snippits left over on the touhouwiki and shrinemaiden forum posts, there is definitely alot that this video was unable to cover, such as documing the pieces and snipits that are left now. I hope this info helps round what was shown in the video alot more, since oh boy quite alot more happened back then. Kinda sad when a project becomes too ambitious, maybe it was shown off too early and generated too much hype? I can't tell. If I were to make a big project like this, I would definitely keep it hidden until it is decent way in so it had time to be something more solid than a 1-character/1-stage demo, maybe like 4c,3s atleast? I'd also be contacting ZUN at that point in developement directly with a quick gameplay demo video to ask for approval and potential questions about what would be o.k. (like, releasing on steam was a big No-no for a while aswell for Touhou Fangames as it was seen as a storefront instead of an doujinshi-shop).

Man just imagine if Raymoo was in the real deal! She would be the first indie game character to be actually playable (not counting Steve cuz he's owned by Microsoft). Plus we would get a bunch of Touhou music, and the best part, there could be an Utsuho Mii Gunner costume! 0:14 also that Youmu plush is just way too adorable :3

Thankyou for making a video about this subject. It's been awhile since I seen the original gameplay. it looked really fun, all I can remember about the debacle is watching the FSS channel every time they uploaded something and a lot of it was dart the Droid just talking about his character iirc. I never actually tried FSS's other games but glasswing looked pretty fun. I can't recall whether or not this is accurate but wasn't there a build released/leaked at one time? I think I have false memories playing lmao

Also guys i seen lots of Touhou characters in Super Smash Bros Crusade Modding Community Game. In first version were only having 4 Touhou Characters Reimu Marisa Sakuya and Cirno. And Later versions having more characters.

funny i actually got a copy of the game on my pc lmao. Long story short i was in a team in the french touhou community where a demo of this game was given to us since we were making the website for it. the project died ofc and i left the team but i still got the game and show it to friends once in a while

I remember following FSS even after the controversy, I also remember that they added a Yandere-Chan skin from Yandere Simulator (Which will never be released, talking about Yandere Sim, not the skin) in one of their other games.

It was crazy. While the drama was going around, a common rumor was that Nintendo were the ones calling for a cease because of the game's name. It was sad the project got cancelled. But this was a firm lesson in communicating cross culturally. Fangames are still a confusing topic now.

All that stuff about dedicated wavedash buttons and Adventure Mode makes the project sound too good to be true. Nowadays, I imagine not too many indie devs would go for this concept, because AoCF is available on Switch.

Graham Holbrook look I just did not want sora in super smash bro’s ultimate because I was worried what Disney would want from Nintendo due to the fact that I was really worried that Disney would either try to buy Nintendo plus it also doesn’t help that I feel like that Nintendo and Sakurai himself is just pandering to the Disney and kingdom hearts fandoms as well as the fact that it also doesn’t help that the only character I got that I wanted in super smash bro’s ultimate since super smash bro’s melee and brawl was princess daisy and they made me feel like the fact that their was no touhou project themed sprit event or mii costume caused me to assume that they were going to have Reimu from the touhou project games as the last dlc character.😅😓😑😔🥺

You are trolling right? Zun is easily one of the most community friendly creators out there. Super relaxed with fan creations. All he asks are just basic normal things like giving credit and asking for permission if you are going to make money off of HIS work.

I don't know how I feel about what happened to this game sure ZUN is well within his legal rights to take down the game but I don't know if that was the moral thing to do seems like a very interesting topic to debate though.

Imo its morally right to take down someone trying to make money off of someone’s creation without permission. Remember, a fundraiser was used. Money was involved without the permission of the original creator (ZUN) It is very IMMORAL to make money from someone else’s creation without permission of the original creator. Zun is super community friendly. All he asks is for people to follow his simple guidelines.
