I don’t agree on this. The term ‘Taco Tuesday’ is common household phrase that is used by everyone, therefor it shouldn’t be trademarked. Plus, the term isn’t even that creatively made up unlike other sayings, it’s just relating a food to a day of the week because they both start with T. Taco Bell isn’t even trying to keep the phrase to themselves, they think everyone should use it, not just one restaurant. Of course it benefits them as they sell tacos, but the phrase regardless of whether it hurts of helps Taco Bell should definitely not be trademarked.

It doesn't matter that you don't know Taco John's, and that everyone uses Taco Tuesday. What matters is if you create a business and a catchy phrase that you'd like the world to think of you whenever they say it, now that Taco John's lost, it doesn't matter. Let's say McDonald's wants their customers to feel free to have it their way, does that give them the right to simply use that phrase to market McDonald's. I'm pretty sure everyone can order their way at McDonald's or Wendy's, but that's Burger King's slogan. Like it or not, advertising (words) needs protected to ensure a more level playing field.

I can't stand our local Taco Bell. They have a nasty reputation for food poisoning in my town, and their food is often mushy. My local Taco Johns, however, is clean, in a prime location, and has never made me ill. Brand opinions aside though - the phrase "Taco Tuesday" should be available for anyone to use. This one time...
