Trooper's Report:
On October 15th, at approximately 3:33 PM, I observed a silver Nissan Xterra traveling north on Hwy 9 approaching the
intersection with Hwy 9 B. I estimated the speed of the vehicle to be 65mph, which I confirmed with my radar. Due to the speed
limit being 55 mph, I attempted to conduct a traffic stop.
As I was pulling out of a private drive, I observed the only person in the vehicle was the driver, who appeared to be an older
female. The female, later identified as Carol Landers, looked at me and started waving her arms over her head, which I thought
was odd. I got behind the vehicle and I activated my emergency blue lights just before Number 9 Liquor on Highway 9. Mrs.
Landers drove past the entrance of the parking lot and continued northbound without braking, signaling, or turning on her
emergency flashers.
After we passed the parking lot for Number 9 Liquor, we passed another parking lot (1213 Hwy 9) on the
left. After a short distance, we passed another parking lot on the right (1274 Hwy 9) and kept driving northbound without signs
of stopping. We maintained a speed of approximately 55 mph as we passed East Burrow Street on both sides of the highway.
Once we got to Southside Barbell (1300 Hwy 9), I activated my sirens, but we still proceeded northbound at approximately 55
mph. Mrs. Landers kept driving past Deerwood Assembly of God (1311 Hwy 9) and again no signs of stopping. The next spots
that Mrs. Landers avoided was at Otto Lienhard Inc. (8 Sardis Road) and Farm Credit (1329 Hwy 9). We then passed Sardis
Road on the right and Crestview Drive on the left. Mrs. Landers kept driving northbound passing a private driveway to 11 Sardis
Road and still no signs of stopping. After a short distance with my emergency lights and sirens, Mrs. Landers passed the
intersection with Hollow Street and still proceeded northbound. It was at this time I informed Troop J Dispatch that the vehicle
was not stopping.
Mrs. Landers passed Pinto Trail on the right and Ward Drive on the left. As we came onto the overpass
bridge to cross over U.S. Highway 64, I informed dispatch I was in pursuit due to the vehicle not stopping. We passed the exit
to turn on U.S. Highway 64 and headed northbound on Hwy 9. We passed Branch Street and Chaney Drive with still no signs
of stopping with speeds approximately 55 mph to 60 mph at this time. Hwy 9 came to a straight stretch and there was no traffic.
I knew there was a busy intersection up the road. I did not know what Mrs. Lander's intentions were if we came to an
intersection. Because Mrs. Landers had passed 19 spots to pull over off the highway safely and to ensure the safety of other
motorist on the roadway, I conducted a tactical vehicle intervention (TVI).
Mrs. Landers exited the road to the right and traveled down the ditch. Once the ditch leveled, Mrs. Landers’s vehicle flipped
slowly, and the vehicle landed on its roof. I made my way down to the vehicle and I could hear Mrs. Landers yelling “I’m going
to sue you.” I was able to open the front passenger door and Mrs. Landers was yelling “I have the right to pull over wherever I
feel safe.” I told Mrs. Landers to get out but she did not comply. I attempted to assist Mrs. Landers out of the vehicle but she
attempted to kick me. I informed Mrs. Landers if she did not exit out of the vehicle that I would deploy my Taser on her. Mrs.
Landers again attempted to kick me and again I told her if she didn’t comply, I would deploy my Taser. Mrs. Landers finally
exited the vehicle. I had to force Mrs. Lander's left hand behind her back to place handcuffs on her. Mrs. Landers then tucked
her right arm in front of her, attempting to prevent me from handcuffing her. I forcibly grabbed Mrs. Lander's wrist and placed
her right hand behind her back to effect the arrest. Mrs. Landers screamed, “I was trying to get to the hospital to pull over so I
could be safe.” I placed Mrs. Landers in the back seat of my patrol vehicle and during this time, Mrs. Landers was screaming
and cursing at me.
Trooper Rusty Ford, EMS, and Firefighters responded to the scene. Mrs. Landers wanted to go with EMS but due to her erratic
behavior, Trooper Ford transported Mrs. Landers to Saint Vincent Hospital. Trooper Ford informed me that Mrs. Landers was
yelling and cursing at the hospital staff and refused treatment. Trooper Ford also informed me that Mrs. Landers said she was
[redacted]. After Mrs. Landers refused treatment, Trooper Ford transported Mrs. Landers to the Conway County Detention
Center.
Mrs. Landers was charged with the following:
27-51-201: SPEEDING - 1 TO 15 MPH OVER LIMIT
5-54-125(d)1): FLEEING - VEHICLE OR CONVEYANCE
5-54-103(b): REFUSAL TO SUBMIT TO ARREST
