@Gloria Ramos. Unfortunately, even if you are employed in Ontario, BC or Alberta, Canada, we cannot help you if you are represented by a union. You cannot retain an employment lawyer to pursue a constructive dismissal due to harassment. Only your union can take action on your behalf.

what great information as always, my friend his company temporarily laid him off, after 24 years and this is the first time, he called me and ask me for advise , he wants to wait for the company either called him back or maybe the will permanently be laid off and I advise him to contact your law firm now not after because they might not call him back, is that okay to wait? because he wants the job because they pay good, and how long legally speaking they can put him on hold before the offer him a package, appreciate your help in advance

I worked for 6 years in the oil and gas industry and I was given a severance package when my employer laid me off in 2013 in AB and I never consulted with a lawyer about the amount given and I always wonder if it was a proper severance package. I was never called back to work for them. Any chance my ex-employer could be legally obligated to fix the severance package after all these years if I was entitled to more $?

@Patricia Hernandez an individual has two years from the moment of termination to pursue their full severance rights. Because you were laid off in 2013, that two year limitation period has passed, and you don't have the ability to pursue a claim. Additionally, an individual loses the ability to secure more severance, if their employer's severance offer is deficient, if they sign and accept that severance offer. That's why it is wise to have your package reviewed by one of our employment lawyers in Alberta (or Ontario or British Columbia) first before accepting the package.
