My employer had a house that he rented on a cul de sac, which had been redone and driveways put in. One day, a neighbor had a survey done, and the boundary line was not where it should be. The house is owned by a Polish guy, and the neighbors were using it as a drug house for dealing meth. The house was vandalized, and I was hired to rebuild it. The contractors didn't notify the city about the charges before the driveways were built. The neighbor destroyed the slab that the garage and workshop sat upon after removing the supports underneath the building and pushing the building onto the driveway. My employer had to go to court to get his property back and won in court.

I have had a septic tank put in. You are paying for the tank, the materials to properly install the tank, and the labor. The contractor brings more than enough gravel, sand etc to complete the job. If there is no gravel missing from his install, then the extra on her driveway was never his.

BUT there allso suposed to take the report for records (Report = comoplant and info of the complaner. A Request talk with the other side to get there end of the story IF they want to give it. At no time should an id be demanded of party B and if refused just write down refused id but i think this person is xxx and close out the report (in a perfict world body cam whould be on both times and the file attached to the report so exact conversation can ge gotten) no arresrts it's in the courts hands.

He said he doesn't get involved in civil matters but for him to charge them with theft it requires him to make the assumption that it's the other family's land. Otherwise it would be exactly that, illegal dumping.

@@Kelley-v7v I’m so sorry to hear that. I had a similar issue with a neighbor who was granted an ingress/egress easement that aligned with a 8” utility easement. I put thousands on dollars of gravel down when I fenced off the 330” to prevent drainage issues from my horses. Years later they put down a single load where they did a right turn from the road and later accused me of using some of that gravel. It got to the point where I threatened to remove “their improvements” and return the land to documented pre developed conditions. We never spoke again until they sold five years later. This was in AZ.

Yea but the contractor said he cleaned it up to the degree he was gona. Meaning the owner 1 got what they paid for and what the contractor left on owner 2s land was now owner 2s, unless the contractor was comming back to remove it further. Essentially saying the contractor gave owner 2 some free gravel as an apology for dumping on their land. And if owner 1 thinks they didnt get the full tonnage thats between them and the contractor. Not owner 1 and 2.

The problem I see is the neighbors property may be landlocked and this is why they are forced to use her driveway to access their land in that case, they may have an agreement with the previous owner and the driveway was setup as an easement where she owns the driveway they are allowed to use it under the previous owners agreement. Because the material was dumped on the easement, it was technically on her property but it could be a shared easement between them, and that could complicate the matter. In that case, she would be in the wrong to move the rock as where she owns the land, the neighbors have a right to cross or otherwise use her land for a specified purpose. Because the rock was the neighbors and placed on the easement, they had a right to use her land. If she didn't want the rock there, she should have made the contractor completely remove it or talked to the neighbors and made them remove it, instead of taking it and using it elsewhere. I understand her side and believe the contractor is mainly at fault but she really had no rights to the rock as she didn't pay for it, and it was potentially on an easement and they had a non possessory right to use the land because it was shared land between both parties in a previous owner's agreement.

Cop is wrong to say that if Rick paid for the gravel he voluntarily left on her property then it belongs to Rick. Rick gave her that gravel. He or his contractor spread it out with the intent it would remain there indefinitely. It was a completed gift. Thereafter it was hers to do with as she liked. Cop is practicing law without a license. This cop is very low down on the intelligence curve.

@@helghallen It's like a bar exam question. Lol. His contractor damaged her property. Rick promised to repair the damage but did a poor job. She could have rejected the repair and told Rick to remove the gravel and do it right, or pay her to have someone else do it. Instead she elected to accept the repair, including the materials, and do it right herself, which was her prerogative. Rick isn't entitled to both get the gravel back and not compensate her for her efforts to repair the damage his contractor caused.

Cop needs to call Rick and ask if he took the cost of the wrongly dumped stone off his customer's bill. If yes, then the stone doesn't belong to the problem neighbors and can stay where it is unless Rick wants to come get it, IMO.

It is so simple, yet the cop can't seem to grasp the simplicity of it all. Rick dumped the rock at the end of the driveway after the job was done to restore the driveway. If you "dump" something on my property knowingly and don't intend to do anything with it, it's trash and it's going to the curb. It's either a littering issue or an abandonment issue at that point. It's my land, and that discretion then falls to me. Of course, the officer made a false equivalency which actually makes the point. He tried to reference a car breaking down unintentionally on someone else's land, which of course is a non-sequitur and irrelevant to the situation at hand. However, should weeks begin to pass and the car is still left delinquent and abandoned, then at that point again, I can arrange to have it legally removed from my property. I might not be able to do it myself, but at that point the law would be backing you anyway. As well, a "reasonable" person wouldn't consider a mailed package that was simply delivered to the wrong address to be a form of trash or litter. I would like to think we all have a civic duty to return said packages to the postal service so it can be delivered correctly.

the problem is that this couple is making too many assumptions. they assumed that its unwanted ( just because he said he'll fix it doesnt mean the material is unwanted. they assumed that taking it would fix it without telling the other party. She shouldnt have been nice by not bothering him knowing that they have a whole dispute going on. Also the ownership of the material argument is stupid, it doesnt matter if he paid for a job or the rocks themselves if the contractor wanted the rocks he would come get it otherwise it belongs to the person that paid for it.

Rick gave the rock to Kelly by leaving it there ON HER PROPERTY. This is a perfect example as to why people should use active listening skills. This officer wasn't listening to anything that was being said. He had his own idea in his head, and while he was communicating with them, he wasn't listening to what was being said.

From what I see and my past as a contractor I think she should simply file a lawsuit against each of the contractors that have been trespassing and causing damage or leaving material. Suing for cleaning, repairing, and emotional stress from the situation

If a contractor has to go through a neighbor's property to get to their job and fixes the neighbor's property, it's the contractor fixing the property with their own materials. This isn't rocket science officer.

It depends on how the job payment was structured. If it was a fixed contract, $5000 to complete a job, it's Rick's material. If it was time and material then the material belongs to the other property owners. That being said, it would be Rick who should be charged with theft because he took their material and used it for an unauthorized purpose. This department is either friends with the other property owners or completely incompetent and just taking the side of the people who called them and "weren't difficult". edit: I just finished the video she said it was a fixed price contract, and she's completely right, it's Rick's material. That cop is completely ignorant.

RICK dumped it to make sure any damages were corrected..... not as part of the septic system at all. As part of damages done by his trucks & he fixed the holes to make it right. If this is these people's part of the road then they can move it wherever they wish & the police are basically calling her a thief of material poured on her road to fix her road, period. It means that lets use this situation for example and just say the cop was right and the material legally was the neighbors and let’s say she didn’t want to give it up. Possession is 9/10’s just represents that it may be yours but to get it back your gonna have to go through court and then have to collect the item. It doesn’t actually have anything to do with the law it’s just supposed to represent that

All you will achieve is nothing OR incriminating yourself. Going through the motion 2 or 3 times, sure. But keep going for half an hour? Come on.

Not only that, but she said "if that's theirs, then Rick can come and take it." It's a pile of stone. It's not going to wither away over the weekend. Cop should have said "Okay, I'll talk to Rick and see whether it's yours or have him move it all" and have that be the end of it because there's no more possibility of a 'crime' to investigate. Probably would have ended the video at 6 minutes

The problem I see is the neighbors property may be landlocked and this is why they are forced to use her driveway to access their land in that case, they may have an agreement with the previous owner and the driveway was setup as an easement where she owns the driveway they are allowed to use it under the previous owners agreement. Because the material was dumped on the easement, it was technically on her property, but it could be a shared easement between them, and that could complicate the matter. In that case, she would be in the wrong to move the rock as where she owns the land, the neighbors have a right to cross or otherwise use her land for a specified purpose. Because the rock was the neighbors and placed on the easement, they had a right to use her land. If she didn't want the rock there, she should have made the contractor completely remove it or talked to the neighbors and made them remove it, instead or taking it and using it elsewhere. I understand her side and believe the contractor is mainly at fault but she really had no rights to the rock as she didn't pay for it, and it was potentially on an easement and they had a non possessory right to use the land because it was shared land between both parties in a previous owner's agreement.

@@urgreatestenemy3044She made the contractor move it and he moved all of what he was going to move. Which means whatever is left, was abandoned. And had the contractor cleaned all of the stone up, I’m sure the neighbor wouldn’t have a problem with it. So the neighbors acting like they wanted that left over stone is ridiculous. If they wanted the stone, they could have had the contractor dump it clearly on their property. They are making a stink about it for no reason. Just to complain. The bottom line is, if that stone was valued property, they never should have left it where it was. And if Kelly wants to clean the stone up and throw it away or use it, that’s her decision to make.

I think she should have pursued this angle with the officer more than arguing whether the stone belonged to Rick (the contractor) or the neighbor. It doesn't really matter in the end, it's on her property.
