Her accomplishments are amazing! Right or wrong about the deposit, the renter is so selfish, she doesn't even realize she could be hurting KIDS by discouraging people from donating to the Foundation due to a personal issue that had NOTHING to do with it. She's a real piece of work and I absolutely believe she was a miserable tenant.

@@lyric2439 Truth is a defense to defamation, yes. But truth has to be objective. When a tenant moves in or out, how much security is paid -- these are objective truths. Claims of someone being a "thief" have to be proven before they are objective truth. The defendant stole nothing from the plaintiff -- she was never charged with such a crime and certainly not convicted. She collected security deposit lawfully and withheld returning it because of damages she believed she was owed by the plaintiff, which is within her purview to do. Whether the damages are justified is up to a court to decide, which is why tenants must sue if they believe their deposits are being wrongfully withheld. That, however, does not translate into the landlord being "a thief." To make that accusation against someone on her charitable organization's page does rise to defamation when the plaintiff cannot prove objectively that it is true, and she cannot. It's the plaintiff's subjective opinion about what the defendant did. That accusation likely damaged her ability to collect donations or sponsors for her programs.

Nobody got anything. The plantiff would have gotten 1250 if she hadn't wrote those things on the charity page. So basically she would have had the defendant pay her 1250, then she would have ordered the plantiff to pay the defendant 1250 for defamation. So it was a wash, nobody got anything.

If you were my roommate and I kept your security deposit wrongfully, you could legally go on my Facebook page and post truthful or subjective statements to call me out. You couldn't go to my workplace and tell my boss I'm a dirty thief. That could cause me to lose my job, which would cause me financial harm, and you could be liable for that financial harm. The legal system lays out your method of recourse. It has nothing to do with who she is, except maybe that most people aren't board members of a non-profit. Someone steals from you: you get to sue, you don't get to steal from them in retaliation. Someone hits you: you get to sue, you don't get to hit them back. Civil society.

The plaintiff says she did not say some of the things that the defendant was claiming on the charitable website, I think the Judge should have made the defendant show the original post which she did not do, should the plaintiff have posted anything regarding that matter on her website no but the defendant blocked her she was completely ignoring her she wasn't wrong in saying that the defendant wrongfully withheld her deposit and would not give it back, the judge straight-up said she had no right to keep it.

I also believe the plaintiff when she says she did not see the hole in the ceiling, I'm guessing while she was still living there it probably looked nothing like that maybe it was just starting to leak, it was obviously from a leaky pipe or something and that's not something she would be financially responsible for so why would she care about reporting that if she honestly knew.
