What a joke !! Another example of our insane courts . This is all about the legal profession rewarding itself . The lawyers will get most of the fees . This is why they are appealing to the high court . The judges are hearing cases from former colleagues whose interest is in getting a high percentage of the award made by the judge ! It is rotten to the core ! The public ends paying for this in higher insurance costs ! This needs to closed down !

As a person who suffers from claustrophobia I understand fully the fears of being confined in a defective lift. In fact I would use the stairs in preference to the lift. However,In most cases, I have to use every bit of courage I possess and take the lift. I think in this particular case the judge was extremely generous and considerate towards the claimant. In view of the fact that he found the courage to fly over to Rome and also confine himself , be it temporarily, to a sauna I feel there is a little bit of greed creeping into this case. This is going to be interesting. If he doesn’t win his case - he’s going to be liable for the opposing parties legal costs which is going to be more than the 8k he was awarded. Common sense gone down the lift!!

The award is excessive as is, maybe somewhere around 1000 or so to incentify the lift/elevator company to effect prompt repair efforts, but maybe only 250 to the direct victim for his time/distress and 750 to a charity involving claustrophobia and fear of flying psychological complaints. And as further incentive the lift company can keep their legal costs in their own lap. The victim also pays his costs to reinforce the overriding importance of honest dealing in the justice system context.

He failed to tell the doctor he had flown because he had forgotten all about it. Not only fear of flying, but amnesia caused by the defendant's gross negligence - aggravated damages.

Terry 👍 .I had an incident in a lift in work. The lift malfunctioned, bouncing up and down,trowing me around the lift. I suffered soft tissue damage but did not make a claim.. I did not use a lift for 3 years after the incident . The worst mistake I made was seeing a solicitor. The employer sent to an occupational health doctor, who confirmed I had soft tissue damage..
