I was hoping you'd cover this case, Terry. This one struck me as very strange as it seems like such a paltry amount to risk one's career over. I've seen cases before such as Thomas Byrne who was shuffling millions around in deeds and fake mortgages, and while obviously dishonest if you walk it back to the first instance you can see how he tried to get himself out of his first hole by continuing to dig in a Nick Leesonesque fashion. One can see the temptations where multiple millions are involved, but I find it very difficult to understand why Mr. O'Higgins would do this for €400. Could it be an honest mistake? Or an error on the part of the DPP?

Well said yes it is. Judges letting off many immigrants for ‘grape’ and some judges are well known for letting off others who have committed disgusting pedo offences. Gardai also doing things like the recent Pakistani immigrant scandal and framing whistleblower Mc Cabe. Too many disgraceful incidents going on.

Solicitors usually require money up front when providing legal representation in criminal cases as otherwise their prospect of being paid could be diminished. I suspect that the €400 was the fee agreed with the client or at least that will be the solicitor's version of events.

@PB111627 D'Arcy Horan Solrs., we're originally appointed to provide legal aid but they later transferred the case to O'Higgins. I don't know whether or not O'Higgins was a participant in the legal aid scheme.

@@larrykavanagh5197 The understanding on payments to have been made between the two firms (for the case of Raul Sanz Quilis) should better come up and be explained as it's crucial (and as important is whether Cahir O'Higgins, the deputy, was told to plead Sanz guilty by instruction or not). The quick question is whether O'Higgins was then fluent enough in Spanish not to need a translator himself (of course he's had umpty years to improve that item of interest if informally gained by himself alone).

Thanks for the comprehensive coverage of this. However, i do think it's at least a small stretch to say that the legal profession hold eachother accountable. If that's the case, why is there a list of solicitors who will take cases against others? Why aren't all willing to do it? Also, if you have issues with a barrister it is very difficult to get representation too. Especially as many firms in a given area will cite conflicts of interest not to because of barristers migrating around the circuit and district court systems.

The worst crime a solicitor can commit is to get caught . As for the crime itself well its just what people in certain circles do . That said the Spaniard sounds like a bit of a chancer.

Well, of course, when discussing secondary influences on or within the justice system (the primary influences should all be somewhere in the record or public to see - call that the daylit system with sometimes a passing cloud) which involve the relationships among and between the court, prosecution, enforcement and legal societies folk and their behind the scenes daily drama (call that the fixture lit system switched on or off at need - sometimes a clear memory some topics not). At any time there are people currently on the outs in that social mixture with so many different players available. Maybe in that period the legal set were tolerably happy together but some others wanted a lawyer set to rights for various reasons rather than slide by.

Solicitors will still cover up for other Solicitors. This is a criminal case , where the Garda had no choice because he was there , when the 600 was withdrawn and he knew the figure should have been 200. What gets me is the small amount. I mean it's usually a old widow , with a fortune in the bank and only for the children noticing . First rule for corrupt Solicitors. " Go big or Go home".

So your man tried to burn down a night club? How evil is that? Higgins should have told the Garda well I’m taking €600 owes me 400 and 200 for Poor Box. The saga would never have kicked off. What I want to know is why you only have to pay €200 for trying to burn down a nightclub. O’Higgins was in a hole and he kept on digging, digging.

I think the guards don’t like him!! I know of a case where an individual robbed about 40k from the company. Never went anywhere.. interview was had at the Garda station - brushed under the carpet.. never heard anything about it. The case never brought to the DPP. Something fishy going on here with Cahir

Did i hear correct €200 fine for trying to set fire to a nightclub ??and a strike out if paid ..the judge should be charged with a crime ffs. That said its commom practice to use cash for solicitors services especially in urgent moments like that . unfortunately mr sans didnt like the fee...shame

Think he was having a mental breakdown. Wife left him, he got done after this for breaking an old colleagues nose outside court after accusing him of robbing clients. Was harassing that colleagues wife. He seems a mess.
