The problem here is Mr Burke got into an industrial dispute with his employer. But instead of dealing with it through the appropriate industrial relations process he done what appears to be the family way of berating and abusing whoever they are dealing with. This is what led to his Dismissal and subsequent incarceration nothing more and nothing less.

He has been giving several opportunities to purge his contempt and get released but he chooses not to. All his own actions all resulting in him still being incarcerated.

Due to this behaviour, the Police were called and removed him. he continued to try to attend the school - further attempts to prevent him attending led to the Court order prohibiting him attending. It's his refusal to adhere to the Court Order that has led to his prison term. (and rightly so!). Having gone to a Church of Ireland school, we had half an hour of study from the bible every day. We had morning Prayer, Choir practice every week and one hour of after school games, visits from foreign missionaries . We were raised to be conscious of the suffering of others. Everyone I knew got married, became responsible parents and citizens. As got older, i saw the change in the ethos of the Church. It threw out the very mention of Christ. It now teaches children to question their sexuality!! No wonder they are confused and suicidal! The church stands for nothing. If this appearance were the case in totalitarian autocratic dictatorships, we would be up in arms, demanding thus and so…. I always understood the courts to be concerned with getting to the root of the issues in disputes between parties when the liberty of a citizen is in issue? Why not here? Is the resounding results in the recent referendums a signal that the runaway liberal train is slowing down? I have no unique insights into the rights and wrongs of this dispute. However, as a citizen, I am very uncomfortable with the reality of the status quo as we head into Easter 2024 - we are capable of much more. It cannot be beyond our political, legal and civic capacity to manage peaceful determined objectors in a manner other than indefinite imprisonment! Even our former imperial masters have more defined provisions.

Also more of the facts called for - the judge was/is trying to get E out of jail by offering him to follow the courts directive - which he has to do, he can't violate a court order and take the law into his own hands (Then if he goes bs crazy what would you say then if he acted out violently and someone got hurt - why didn't the judge keep him in....etc). He E has to abide by the courts directives not to violate and trespass on premises, he is not allowed to be on. He is violating a court order by showing up to a premises he has been clearly told, and ordered, not to. THAT - IS WHY HE IS IN PRISON(along with a lifetime of listening to the diatribes from his mother). Too sad for the children.

The Penal Indorsement on the High Court Order was given on the basis that the School would perform it's disciplinary review of the matters that led to the problem. The High Court is being used on a frequent basis in a similar way to punish others not as reactionary as Burke. What if the High Court put a Time Limit on the Penal Indorsement like Yes you can have your Penal Indorsement but it will be lifted in 6 months (or appropriate timeline) if you have not concluded your review (or what ever the Plaintiff said he wanted to do?) Burke has shown that the misuse of the Penal Indorsement to being tantamount to open ended incarceration, coning from a Civil Court and would appear that this Dog and Pony Show will continue on and on until the School preforms its statutory obligation to review the reasons why the trouble first came about. The spotlight is always on Burke who is obviously not for changing instead of the school who at some point must be apportioned at least a cameo role in this farce. The Court too has remedy, by releasing Burke and tell the Oireachtas to put a time limit on the "Lock 'em up and throw away the key" Penal Indorsement being misused on an all too frequent basis as can be seen in Burke, before Ireland are embarrassed again before the ECtHR! As no one seems to have a solution in this matter both sides need to be urged to find a solution, not just the one who throws all the toys out of the pram and can be depended upon for a headline every time.
