Remarkably, this cyclist was able to ride away from the scene near Vauxhall Bridge.
Despite the video evidence, the Tesco employee refused to sign the papers acknowledging he was driving.
This meant the police could not charge him for driving-related charges as he could not officially be identified.
Instead he was taken to court (in January 2020) and found guilty of ‘failing to nominate driver’.
He was given a £300 fine, plus £332 in costs and six points.
Despite the employee refusing to take responsibility for the crash, Tesco admitted liability in the insurance claim.
In a later part of the video (not included in this edit), the employee states the cyclist had been in his ‘blind spot’.
The cyclist has given permission for this video to be shown.

Oh dear, there must be a conflict in the highway code then ,as in the "rules for cyclists" section 72 states :- On the left. When approaching a junction on the left, watch out for vehicles turning in front of you, out of or into the side road. Just before you turn, check for undertaking cyclists or motorcyclists. Do not ride on the inside of vehicles signalling or slowing down to turn left.

@@nickhale2900 not really. This says watch out for vehicles in front of you. For motorists, they are required not to overtake (move from behind to in front) if cyclists before they take a left turn. The tesco driver broke that rule. Further, the cyclist was in a dedicated marked cycle lane. You can't cut across lanes in ANY vehicle unless you are sure it's clear to do so.

Whilst this was the van drivers fault, I can't get my head around the cyclists behaviour either. The road positioning of the van indicated a developing hazard long before they indicated. Even once the cyclist looked and noticed the indication, he continued and did not attempt to brake or avoid the van until it was too late. Even the following cyclist did not attempt to slow until after the impact occured. As a motorcyclist I can't get my head round the attitude of him and many cyclists. It seems insane to me that he and many other cyclists make the false assumption that everyone has seen them and is going to drive sensibly. It's totally opposite to motorcyclist mentality which is that no one can see you and everyone is about to drive like an idiot. As my motorcycle instructor told me when I was learning, "being right won't be any consolation to your family at your funeral", and my other favourite "the highway code is an ineffective painkiller". So whilst I'm not defending the van driver, the cyclist had an opportunity to avoid the colision which he chose not to take.

The cyclist was in his 'blind spot'. The driver overtook him with not much of a speed differential, and put him in his 'blind spot' 4 or 5 seconds before turning left through him. I agree with the sentiments expressed by the cyclist.

As someone who used to drive these Iveco vans at Tesco.com, the driver must have not been looking or concentrating enough on special awareness. The door mirrors, especially the wide angle mirrors, should have easily been enough to see that far out from the vehicle on either side. Though, we all make mistakes, including myself. I’ll bet, after this incident, the driver must’ve kept it in mind and will be checking the mirrors a lot more.

The registered keeper would respond to the S172 request to nominate the driver. That person then receives their S172 notice and in this case, he chose to fail to state that he was the driver. The process is rather flawed as it's a self incrimination process of admitting guilt. As per another comment, in this case, the vehicle is stopped, the driver is present, someone was injured but no police presence. They should have attended and issued a verbal NIP and not just posted off a request for confession form.

I’m a Luton van driver and I deliver daily in London, with a mere 43 years experience. I am also an ex-cyclist who has been knocked off by both an articulated lorry and a coach in my youth. Here’s where I see the problems: Hazard awareness is what keeps us all safe, that includes being aware of and anticipating the many dickhead moves the road users around you might make. To stay safe you have to do this all the time, just like using your mirrors. It takes experience and imagination. The van driver positioned himself correctly behind the advance stop box and outside the cycle Lane at the lights, so a tiny bit of credit there? He then overtook the cyclist immediately before turning across his path and signalling late. Bad driving. The cyclist probably was in a blindspot, even with the wide angle blindspot mirrors vans are now fitted with. If he had a passenger, then that would also have blocked his view to the left. A lot of these drivers are inexperienced, both in driving a large van and driving in London. This COULD have been his first day on the job. He was probably using a sat nav to identify the turning he was delivering into. They can be glitchy and give last minute instructions. They are safer in most ways than using a map but they are not perfect and are also yet another distraction. The roads are busier than ever before, and more confusing, with more things to pay attention to and make allowances for. We all need to keep each other safe by anticipating all possible bad moves by fellow road users.

What was the driver thinking about when he was overtaking the two cyclists? "Just got to overtake these two then hard left into the next street. Oh look it's a cul-de-sac!"? No planning (where's my next turn?), too impatient (MGIF), no anticipation (there's insufficient room to overtake safely so I'll follow behind them while indicating to the following cyclists). Tesco - every little helps! Well perhaps a little planning, a little patience and a little anticipation were substituted items on their driver training course. I think on second view & how it came about, potentially the tesco driver may have been following a sat nav suffering lag:- brakes & indicators at last second, turning before indicator gone off after first blink. Just because one person is at fault doesn't mean the other party couldn't have avoided the collision. I've been driving luton vans for 15 years and never had an at fault accident. The cyclist was in his blind spot when he made that move and 9 times out of 10 he would have got away with that stupid driving. However if you have just over taken a cyclist then I fail to see how it's a blind spot when you know he is there . Even so it would have been a pretty dick move as the cammer was not in his blind spot and would have had to take avoiding action. Simple case of not planning your route properly. He should have been fired. Not for the accident because accidents and mistakes happen we are all human. Should be fired for not admitting to driving and Tesco should have been massively fined as they 100% know who was driving the van. Altho the camera evidence is pretty damning evidence.

Totally drivers fault. However as the more vulnerable road user the cyclist needs better awareness and should ride more defensively. When he noticed the driver go past him his immediate action should be to check his own speed so he can stopped suddenly if needed then look up ahead at potential dangers. Knowing a left hand turn was coming up I’d had slowed right down until I was certain the vehicle slightly ahead of me wasn’t turning.
