It always irritates me when people say "it's only property, it can be replaced" as if I didn't have to spend part of my life working to earn the money to buy that item. By stealing my property, you're stealing part of my life.

I try to make that point all the time and you'd be surprised how many people still don't get why stealing is bad. Time = Money = Property. If you steal my stuff, you stole my money that I earned with my time which was a part of my life. If I make $15/hr and buy a TV that costs $700, that thief is literally stealing 62 hours of my life once you account for income and sales taxes.

@@milesmccall2301 If they don't want to get shot, all they have to do is stay out of my house. In fact, it would probably be a good idea not to be a crook at all if you don't want someone to shoot you for breaking into their house. It's really not that hard to avoid getting shot.

My nephew lives in the state of Washington, used his rifle to get an intruder to lie face-down, and held him there until local police came. But while waiting for the cops, my nephew talked to this intruder to get his story and found that the guy was receptive to some ideas for improving his life. By the time cops arrived, my nephew had basically become the intruder's mentor, and 9 months later this former criminal had graduated from a skills-trade apprenticeship program and started his career as a welder with a commercial construction company. Happy ending

What a genuine story I’d like to hear nowadays instead of hearing about people against people out for blood. That's good to hear! Though, one has to wonder if he would have been as receptive to changing his life if he hadn't had a rifle pointed at him. Which I've heard can have a sobering effect on some.

Im from Texas. Yes, in Texas the default is your justified. You may use deadly force for theft in the nighttime, and criminal mischief in the nighttime. You may use force, like pointing a weapon in this daytime situation.

We should imprison thieves and make them pay back their debts for what they stole. We should also publicly execute rapists and murderers like the good ol days rather than give them 10-40 years in jail as a slap on the wrist.

Just remember guys, if the DA tries to ever charge you for aiming that firearm at the criminal, take no plea bargains and request your jury trial. The DA already knows they will never get 6-12 people to unanimously convict.

They have to pose a threat of death or grave bodily injury before you can point a gun at them (with some exceptions such as in your home or if you live in a retro-grade state like Texas which has some exceptions). For instance, some guy picks up your bike and tries to ride off and you point a gun at them, that's aggravated assault. And hopefully you will be charged. And so your advice of taking no plea bargains and hoping a jury doesn't convict is insanely bad advice. Bordering on criminally stupid bad advice.

And you wanna sit here on your high horse and act like you know what you're talking about when you can't even get the charge right? 🤦🏻‍♂️ the charge would be "pointing and presenting a firearm" now, as soon as you shoot at them or shoot them its aggravated assault or attempted murder. Me personally I got charged with 2 attempted murders in a situation where I had to defend my self and they tried to get me to plead to aggravated assault. He does sound kind of silly saying let a jury completely hold your life in their hands but still. If you gonna talk shit at least know what you're talking about.

That seems like a valid point to me.How come so many cops are being shot for the last 2-3 years? i blame part of it on the running of our country and part on our liberal justice system that feels the need to let criminals off to easily only to have them repeat the crimes.WE are literally seeing the decay of the USA in real time.

@@joepublic2894 i don't know about where you live. but here in Arkansas. how the criminal justice system works is = if said offenders crime suggest that they we reoffend soon they will slap on the wrist( minimum sentence ). if said offenders crime suggest it's a one time thing. they throw the book at them( max sentence ). the reasoning behind this is = if you commit crimes often. the prosecutors, the public defenders, and the judges make more money. ( whether its over or under the table ) if you made a mistake and have a low chance of breaking the law again. the longer they can keep you in jail or prison. the more money said jails and prisons get from the federal government. its all about the money$

In my state, you car rob people, their homes, the grocery stores, pretty much anywhere and as long as it less then 1k you’re ok to go home. Oh you can also molest and be a pedophile & get lighter sentences now. Best part is, is when the police get theses monster and the civilians cry and criticize the police, but the monster? Should be the case, at the same time it's a Grey area. A guy stealing a TV doesn't by default deserve death for that action alone. At the same time though, we are only legally allowed to pretend we can shoot so it's a false defense and the law just can't expect everyone to be able to go hand to hand or simply let the guy walk with our property for them to "handle it", law enforcement can also attest to non lethal measures not being reliable so its just Grey all around. This is where situational awareness and preventative measures come in.

I, as a former NRA instructor, understand the laws and always presented facts from a legal standpoint. However, I’ve always felt it to be absurd that civilians have to wait for the criminal to get the drop on them before responding while an officer can draw his pistol on you for non-compliance.

@@joshdavis3743 most states agree it’s okay when one fears greatly for his or her safety including serious injury up to potential death. That includes pulling a gun on someone who is unarmed. An example would be a woman who is being attacked by a big strong man trying to rape her. Most states also have a castle doctrine law which states you have every right to defend yourself and your home, as the home is a private, safe intimate space where only invited guests are allowed.

In Texas It's not really true that you have to wait for the suspect to use deadly force against you.. The threat of deadly force is considered reasonable force no different as if you were to pepper spray him, cuff him or use your hands to physically stop him from stealing. This is something you're required to learn when you take your LTC and something your self defense lawyer will hammer into your head. Stand your ground and castle doctrine protect you against criminals.

I agree, but now is the best time to defend yourself at all costs despite the laws in your state. Our community is growing and we are voicing our RIGHTS. We are in a time even if we are wrongfully convicted, any new case like that will almost certainly catch a lot of attention and put a lot of pressure on the DAs and state officials to quit punishing CITIZENS who constitutionally SELF PROTECT themselves, because they know they won't hear the end of it from us if they keep up w their bullshit. Agree. In my view, the laws in other places need to be changed to allow legal defense of property with lethal force. To have to stand there , with gun in hand and the means to stop him, while the thief calmly walks off with my property, because if I shoot him I'm the one who gets prosecuted and sent to jail, while the thief, who was probably armed too, if caught by Police is out on bail the next day, if not released all together, is totally ridiculous. It's one reason there's so much crime in this country. The laws regarding this all Western countries are upside down on this issue.

These guys can get these apartment style keys easily at times and have way with your house. I worked in maintenance for years. Not hard to do. That being said, something about a shotgun puts a chill in you like not many things can.

Germany protested the use of pump shotguns in 1918 during WW1. American soldiers were using it to clear trenches, earning the nickname "trench broom" or "trench sweeper," because it would take out multiple enemy at once. They threatened to execute any POW caught with a shotgun or shells. America responded with a lengthy treatise on war, basically stating that Germany was in no position to object since they used many tools of war that could be said to violate rules established in the Hague Conventions, and that shotguns do not cause undue suffering in their ability to kill, to which they never received a response. American forces continue to use shotguns to this day.

It's the knowing that a shotgun will shred you and blow off chunks where as a rifle or pistol bullet will penetrate and leave a hole but the shotgun can literally leave you unrecognizable and unidentifiable unless they manage to find a tooth somewhere or if you have identifiable tattoos.

@@younggunner9482 That's a modern shotgun loaded with buckshot at close range. The shells they used in WW1 had nine pellets, each roughly the size of a .32 bullet. They'd take out multiple combatants at a distance due to the spread of the pellets and the Germans' penchant for grouping men close together, and the they objected to that fact. The American response countered that the Germans were using machine guns that did the same spraying of rounds into multiple enemy. You can read the response online, if you're interested.

I learned a long time ago (as a result of being a victim of a crime) the laws are often written to protect the criminal. Just think of all the things the law abiding citizen has to think about when coming in contact with a criminal in the act.

To my understanding, basically the Western law tradition (English common law?) is 'it is better to let the 10 criminals go free, than to wrongly punish 1 innocent person'. The ''assumption of innocent until proven guilty beyond reasonable doubt' is a prime example of this mind set. Especially when it come to dealy force/ death penalty. One of the rationales is, you always have a chance to catch the criminal if he continues his wrong doing, but once you punished an innocent person (taken time out of his life by throwing him into prison, or cut his hand off for stealing, for example), you can never compensate that. The opposite is to be very hard on crime but occationaly, or very often, you will punish the wrong person. Like what they do in China.

@@dickiewongtk logic is flawed. citizen level versus state level actions here. What you describe is correct for STATE level action. 100% always innocent until proven guilty. at the citizen level this is (or should) be very very different. the citizen SHOULD have some duty to avoid lethal action but not onerous duty. its pretty simple. give a reasonable order (stop) comply? NOT allowed to shoot. Don't Comply? Shoot. their choice. they could very easily comply and do as they are commanded to do and everyone gets to go home alive.

A lot of preps that are caught after a struggle say, "I thought I could take him". The homeowner's overwhelming show of force removed any hint of the burglar getting the upper hand. Kind of like how the cops will use 10 men to serve a warrant.

The homeowner did a good job. Especially when you consider that the thief had been there before. That fact alone is likely to increase the emotional response to catching the guy stealing again. Score one for the good guys.👍🏻

You should look up they guy who killed two thieves leaving his neighbor's house with an armload of stuff. 911 operator even told him not to go outside, but it was 100% legal under Texas law.

It might seem obvious, but you never actually _know_ until it's too late. A Texas conceal carrier once ran in and shot a gas station clerk while he was brandishing a shotgun at the real perpetrator.

Had a customer walking to her car when she noticed someone stealing a catalytic converter from someone's truck. As she went to go confront him, he immediate slid out and pulled a pistol on her. She ran away to get help. He ended up leaving with not only the converter, but a ton of her groceries.

Uh no? Civil rights should apply to the accused and the guilty just as much as they do to innocent people. The justice system (and its rules pertaining to self defense) should not aim to be a retributive one, but rehabilitative one. Treating people who break the law as irredeemable scum not deserving of rights only guarantees they will continue to break the law because if everyone says they are hopeless trash then they must be or no one would think so. But if you give them an opportunity and an incentive to change for the better, then they just might and that saves everyone a lot more time, work, and money.

John, I usually agree with your analysis of these videos, but not this time. If a criminal is willing to break in to my home, he IS a deadly threat. Case in point: I had a neighbor break into my townhouse and steal some guns. I caught him on video but he had a mask covering his nose and mouth. No arrest, police told me a prosecutor would not charge the criminal because a jury wouldn't convict. After they left, I found that he had loaded my shotgun in case I came in on him. The next summer he was arrested for murder during a break-in. Burglars ARE a deadly threat until they prove they are not.

I disagree with the "only" restrictions though. there are many ways the suspect can be a deadly threat, even if they appear unarmed. if it looks like a deadly threat to you or others then I'd say it's ok to fire anytime and anywhere, preferably first.

@@barjrob John is incorrect. He is misinterpreting the law, because as it is written there are no "during nighttime" restrictions regarding stopping "arson, burglary, robbery, aggravated robbery". The "during nighttime" restrictions are SPECIFICALLY and ONLY attached to "theft during the nighttime, or criminal mischief during the nighttime".

Bad argument. A sovereign state has a monopoly of violence, which is similar to the monopoly of law. It just amazes me how you make everything so complicated, saying things like, his trigger finger position, the direction he’s pointing at and so forth. This guy stopped the criminal from stealing. John's just trying to make sure people are safe in the "fight after the fight." As tempting it would be to fill immediately a thief full of holes, just remember that it could be frowned upon once the cops arrive, once the journalists arrive and put their spin on the story, and once the justice system gets involved. Unfortunately, what this man did in Texas might not be acceptable elsewhere and it's up to us as citizens to know the law and to change it if it is unjust.

Make him cornered; as bad as it sounds bad, if they run, one have potentially much bigger problem than lawsuits: one can have disgruntled, full of malice not thinking straight burglar that can attempt murder later on. It is not far fetched, I've heard NUMEROUS times that shit happened... Even under this here ASP video, scroll down and search for it. In my book defender must be as ruthless if not more than attacker and must dominate situation to such extent that attacker would not have even ground to stand on. If perp is taking your TV? Corner him before he could do anything. If perp is brandishing weapon, shoot him to neutralize before he even thinks about pointing at you. I know this is just idle talk, but being frank, it's the law that is unrealistic...

Running after suspects is police job, that I agree 100% with John. On the other hand, I don't agree on (not Johns, but general) opinion that shooting someone in the back is bad. NO, defender was/is under attack as long as there are no signs of enemy in sight and one can logically presume that the thread had ended. This is fairly easy as long as you can go away to safety from some random spot. If anything happened close to my home/house full of significant ones and family? I'm fine using effing tanks for all I care, anybody/anything can go F themselves until my side is safe so shooting potentially dangerous perps for them to go away is okay. (once again, I'm talking about perps RUNNING away full speed, which indicates they are done fighting. If they as much as flinch during retreat, smoke 'em without batting an eye.) In the defense of property conversation, I think a lot of people neglect to think of the other things lost in a home invasion. A sense of security in your own home. Restful sleep. Trust in your community. These things are stolen too.

Texas gun laws are great, almost as good as Oklahoma where I reside. A person has the right to protect his person, his family, and his property. Seems like a pretty easy concept.

@@zoggrog8823 False. There are no "during nighttime" restrictions regarding stopping the crimes of "arson, burglary, robbery, aggravated robbery". The restrictions John mentions are specifically and only "theft during the nighttime, or criminal mischief during the nighttime".

That's awesome the neighbors watch out for each other. Same thing happened to me in Columbus GA, my neighbor pulled his gun to get the robbers that broke into my apartment before I got home and cops were called. That's what needs to be done to stop of this

The law is not defending crooks. The laws are written so that deadly force may only be used when lives are in danger. Texas is one of the states that allow you to shoot someone for infractions where your life is not at risk at all.

2:56 I’ve seen on Cops many times the Police pointing their firearms at people who they have not yet identified as a deadly threat when they make a stop on vehicles or going in to burglaries. In my opinion this is what this guy is doing to protect himself by not allowing the burglar to possibly get the drop on him. He did a great job and also stopped himself from being prosecuted for excessive force by going hands on. Just my opinion from the UK so open to discussion not argument.👍🏼

Cops drawing down on people was often not even investigated, even when it was gross negligent and completely unwarranted. Regular citizens aren't getting the benefit of the doubt from either the DA or the grand jury

The government does since you acquired it with their money. You are just a steward. I’m not advocating and behalf of thieves I’m advocating against the tyrannical nature of somebody that can put material gains over the value of another human being’s life. It’s not really your property you don’t actually own anything your bills will never stop coming and you will always have to find a way to get more money to afford anything you have or want in the future. There's something in the TPC that wasn't covered here. In Texas, if the use of force is justified so is the use of deadly force as long as it's meant only to create a FEAR of serious bodily harm or death. The principle, I believe is to defeat a disparity of force in that gray area between force and deadly force being justified. Also to prevent just such a thing IMO.

As a Texan homeowner who’s had multiple break-ins, I’m excited to see this one. I even came face to face with the perp at 4AM one time and ended up letting him go because the police took 45 minutes to show up! Great analysis. Very informative.

The argument that the defendant who kills someone that is stealing from them doesn't care about the criminals life misdirects the moral responsibility. The moral responsibility is held on the individual committing the crime, the criminal doesn't care about his OWN life. Also don't forget property and money represents your time, hard work and future ability to provide for yourself. So the robber is taking part of your life and livelihood. The people mudding the water in support of criminals are responsible for the increase of theft and violent crime. You are transferring responsibility from the criminals to the victim.

Great point and well said! But while you are 100% correct, and I wish things were like this, this is not the world we live in anymore. At one time your view was accepted by everyone (even criminals), when money and possessions were hard to come by for most, but these are the days of excess. Most people in this country have more than they need and are usually protected with insurance, so using deadly force to protect a TV is skewed in most cases. Being caught on property/in home while committing a crime, an assailant should justifiably fear for their life, but outside your home, unless you are being mortally threatened, deadly force just won't be justified anymore. It used to be the death penalty for a horse-thief bc you may not survive without your horse. Things have changed though ..unfortunately. In the past, penalties were harsh, and protecting property was justified to make one think twice before committing a crime. Now criminals have rights. Some evolved society, huh? As you said, it just creates more problems, the way we have to live now; within such a liberal society. But the reality is that we're not going to go back to the way it was, we're headed in a very left-wardly direction... : (

In Australia we're allowed to use our words to ask the burglar to kindly stop doing that. If that fails we can go inside, lock the doors and call the police, who may arrive a couple of days later to take a statement.

There was one like this in Baltimore County, Maryland and the dude was breaking into the mans truck in his driveway and in Maryland it's legal to carry on your property and you can also use force if your life is directly threatened but until then you must attempt to retreat to your house. This homeowner told the dude to fuck off and instead of doing so the man decided to attempt to stab a man holding a rifle with a screwdriver and the homeowner being confronted with a deadly threat was able to stand his ground on his property and shoot him. This suspect had believed like an idiot that since it's Maryland and gun laws there suck balls that the homeowner was in the wrong and he would go to jail for shooting him but the exact opposite happened, thief went to the hospital then to jail and homeowner was released from custody that morning and the state declined to press charges on him.
