That's Not Very Neighborly

The plaintiff claims he told his neighbor, the defendant, about a large tree hanging over his property. The defendant didn’t do anything about it, and the tree collapsed on the plaintiff’s fence and damaged it. The plaintiff is suing for repairs. The defendant argues that the tree fell due to a hurricane, and he can’t control the weather.

The defendant is a very smart and sharp person , a perfectionist . Very sharp in not doing anything wrong, and expresses that verbally many fold, and likewise many fold does not do any wrong. Every tree is going to fall eventually - whats the law going to say; not have any trees? I am sure all those desis can conciliate and get along with each other and be good neighbors .

35 MPH is hardly a hurricane, we get those kinds of winds weekly. Hurricane winds are listed in categories. A Cat. 1 is 74-95 MPH, a Cat. 2 96-110, A Cat. 3 111-129, and a Category 4 Hurricane has winds from 130-156 MPH. 35 MPH is a breezy day dude.

You would have to own the air rights to prevent drones or even airplanes from flying over your property so yeah, judge is wrong on that one.

Its a bunch of bureaucratic nonsense. I do own the airspace up to 365 feet and that isn’t regulated by the federal government or FAA. Drones and paragliders don’t need to be regulated or registered either. So pretty much anyone who wants to can fly them. The issue is when those objects encroach within that 365ft bubble of property. No one seems to care… it’s not like I can go out and chop it down or take it out of the sky like branches. That’s destruction of property, but trimming the tree isn’t destroying property, even if the tree dies. You just have to stay on your property and only trim what’s over your property. Basically I should be able to go outside and take down drones and other small craft when they’re zinging over my property at 200 feet. Or just a drone hovering 12 feet off the ground in my backyard.

In the country I am from the neighbour can cut my intrusive tree branches away from their property and dump them on my lawn for me to dispose of. They are both from a very petty minded culture. One sues with no ground to do so and the other wants to talk about people not involved in the litigation and how they hate the plaintiff. Meh.

I definitely do not defend the plaintiff. a busybody who also exaggerates (and probably lies) However, I found the defendant a little condescending. Yes he was very well organized and is clearly a very good public speaker - but much of the way he speaks (and lauds himself for being 'friends' with his neighbors) is coming off as something that I wouldn't want directed at me. i feel bad for the plaintiff but its his responsiblity to have insurance that covers this kind of thing.

Marilyn was correct in her judgement, however she was wrong in one thing she said. She stated that if my neighbors tree is growing over my property, I CANT ASK them to cut it, but I can cut it without asking them. True, I can cut it without asking them. But she was wrong in stating that I can’t ask my neighbor to cut it. You can most certainly ask your neighbor to take care of it, however, they are not legally responsible for it, nor do they have to cut it. So I can ask them while having no expectation of them to say yes. And her chainsaw impression is horrible, she must use an electric chainsaw. No powerful gas chainsaw would sound that weak, lmao!!!
