Batman doesn’t necessarily have a problem with killing criminals per say if it’s by the justice system but he won’t do it himself intentionally as it’s his one rule. As you said the justice system would’ve killed Joker a long time ago. Of course there are some iterations of the Joker where it’s argued he can’t really be killed as he is a supernatural permanent entity of Gotham. If that is the case even if Batman killed him he’d come back.
