Ernesto Miranda is buried at the city of mesa arizona cemetery - Mesa is a huge suburb right outside of phoenix and where I grew up. Back in 2008 After going to a funeral for a relative at the cemetery, I found his grave, and on it was a laminated miranda warning card. He has fans out here still, apparently lol.

Yes, at that point the "reading of rights" was a indeed a formality. Nonetheless, it was a very confusing incident for the police, that released the alleged perpetrator -and ultimately, he disappeared. It's uncertain if he was following the Miranda ruling or simply refused to talk.

Fun fact, the Miranda rights ruling by the Supreme Court was decided on my birthday, which is June 13th, 18 years before I was born. Also Timothy McVeigh received the Death Penalty on my birthday too in 1997.

Very interesting case. When I was in junior college studying Criminology and Criminal Justice, our instructor made sure that the class understood Miranda rights. Before Miranda, the police used intimidation and coercion tactics against people who were in police custody. The television show Crime Story, produced by Miami Vice’s own Michael Mann set the show’s setting in 1960’s Chicago after the Miranda ruling. Actor Dennis Farina was a cop during that time before he became an actor. Great narration, as always. Stay safe. Stay Reel.😎

The problem is, your Miranda rights only begin when you are officially arrested. They can ask you anything they want before that, and you don't have to answer then either, but they have ways of making it seem like cooperating is how to keep yourself FROM being arrested. If you knew me, you'd never think I'd been arrested, but I was because of this trickery b.s. I had terrifying heart palpitations in the middle of the night and called 911, and when EMT's were trying to figure out what was wrong they asked if I had taken any medications. I had a cold so I had taken cold medicine. Even though the palpitations went away on their own (I now know it was my first major panic attack), the cop on the scene decided it wasn't safe to leave me home alone with my 2-year-old daughter. He told me if I didn't call a family member to come and get her, and that I go with him to the e.r. to make sure I was okay, he would call Child Services and have them come get her. So I called my only near-ish relative, my cousin, who luckily answered the phone at 3 a.m. and was willing to come from 35 miles away to get my daughter. I had to ride with the cop in his patrol car to the e.r. and he stayed in the exam room with me, mostly just waiting in silence (we were there a few hours!). I became desperately thirsty but he wouldn't let me have any water. Turned out he had ordered a urinary analysis on me, and didn't want 'whatever' to be flushed out of my system before I peed in a cup, and even then he didn't say it was about drugs, just some kind of health clearance so I could go home. Understand, I hadn't acted 'high' or anything the whole time, was perfectly alert and normal, and forgot that I even told the EMT's I had taken cold medicine. I honestly believed this cop that he just wanted to make sure I was okay. Looking back, I should have found it odd that they only did a UA on me, not hook me up to an EKG or anything specifically about my heart. Welp, lo and behold, a nurse eventually comes in and says I tested positive for ... get this ... PCP!!! Obviously I was beyond flabbergasted, I said (truthfully) I didn't even know exactly what PCP was, never knew anyone who had even tried it (still don't). But again, he acted like I didn't have anything to worry about, just needed to go with him to the station ... I can't remember how he worded that, but it was another vague promise of being cleared to get my kid back and go home. But on the way to the station I asked, "Officer Prince ...... am I ...... under arrest?" And said, "Well, technically yes" (but didn't state a charge). I asked if he was ever going to read me my Miranda rights, and he said "Well, they'll take care of that at the station." There I was handcuffed to a table in a tiny cinder block room for a couple more hours before a woman came in, FINALLY gave me the right to remain silent, and told me I was charged with FIRST DEGREE ENDANGERMENT (I later found out, this is usually only applied when someone has DIED, and it's akin to manslaughter!). I was then taken to a jail and put in a drunk tank for a few hours and fingerprinted, then to another jail for a few hours, photographed. Cops talked about me in front of me, "This one o.d.'d alone with her kid" like I was guilty before proven innocent. Meanwhile my cousin was a effin BADASS, found out what was going on and arranged bail for me. I had to wait three months of agonizing worry for a court date, and guess what? --I was in my second year of grad school to become a TEACHER, a job I could never have if convicted of a crime involving a child! In that time, I was never contacted by my court-appointed defense attorney, couldn't even find out what his/her name was. But on my own, I learned that urinary analysis wasn't even a legit test for PCP, that common cold medicines could give a false positive for it, and only a BLOOD test (which was never done) could give real results. I wanted SO BAD to talk to an attorney about this, but couldn't get hold of anyone on my side until my court date. I sat in a room full of people charged with all kinds of things, with a judge up on a bench. When my name was called, a guy in a suit comes out of nowhere to stand next to me, and when the judge asked how I wanted to plea, this guy says "Not guilty" before I could even open my mouth (apparently this was my attorney). The judge was reading my case file quietly, making weird faces, and asked, "So did she give drugs TO her kid?" and the attorney said no, that I was accused of endangering my child by taking drugs myself. The judge made another weird face, said some legalize stuff really fast, and the attorney told me to to fill out some paperwork at a window in the hallway. I had NO IDEA WHAT THE H was going on. I asked the lady at the window what my paperwork was about, and she explained the judge had ruled 'Null Pros' ("we will not prosecute"), meaning I was FREE! ...BUT ... this was not the same as having charges officially DROPPED, DISMISSED, nor EXPUNGED. The judge only did the 'Null Pros' because he didn't think my circumstance warranted Endangerment 1, but I didn't even get to prove that the circumstances THEMSELVES were bullsh, that I DIDN'T TAKE PCP!! I got to finish grad school and become a teacher and to my knowledge that horrible night has never come back to bite me, but for all I know it could. And all because a cop who just wanted an arrest that night used my kid and my freedom against me, to get that arrest, without giving me any kind of rights as a citizen.

Stories like yours are unfortunately not isolated cases. Happens every day and is the exact reason why no one should ever speak one word with the pigs and not cooperate in any legal manner. To become a cop you have to be a psycho bully in the first place and such people are prone to abuse their perceived authority.

To this day, I can only assume that 911 crisis was a panic attack because I had several afterward, and all kinds of fears I never had before, but for all I know, it was something else that caused those palpitations. Thing is, it's impossible to separate that night from what happened as a result, and I believe it qualifies as PTSD that I endured for the next few years. Like you know how rape victims don't tell people because they feel like it was their fault? Well, I've never been raped so that seems totally nuts to me. And yet ..... I kept what happened to me secret from everyone except my cousin and a couple other family members for years, because just being in those jail cells, the fact that it was a charge involving my helpless toddler child, it felt like even though I knew I did nothing wrong, people hearing about it might assume I was leaving out incriminating truths. And even within myself ... I did feel like I had done SOMETHING wrong.

And just look at so many of these interrogations of family members we see in these crime videos. Yes they have reason to question them because close associates are often the culprits. But often the cops talk to them like they are scum of the earth, just to try to get an emotional 'shame' confession. Do they go and apologize to innocent people after they find out who was really guilty? I doubt it, and just think of how much worse they made the pain of people who lost their loved one to grizzly murder.

My brother is an attorney and he once had a friend (who had a printing business ironically) gift him a box of cards that say, “Be quiet!” on them. The attached instructions said,”silently slide across trial defense table to client as appropriate”. There is no end to the stupidity of criminals! This is just an attempt to extend their “Miranda Rights” to the court room and to make my brother live to see another day.

I guess we are all familiar with the term Miranda Rights because you hear them a lot on US police shows. Occasionally I'd wonder who or what Amanda was but never bothered researching the issue. Thanks for a great story. I wonder if Mr Miranda ever thought that, nearly 80 years later, his name would still be used as the name of these rights. Another interesting story, thank you

As paralegal students, we saw Miranda related questions on every test. In some cases, it was an arguable issue as to applicability based on whether the person was in custody or not. Sometimes difficult, nearly always interesting.

Psst when you told me about his electric door accident it triggered a reminder I once had a car door slammed shut on my hand breaking 5 bones. It was at a Farm Park as I was handing my son a bottle of water, he wasnt paying attention and slammed the door. Apparently I let out a primal scream that scared the animals and my sons. We can laugh about it now, well they can rather more than me :)

@Beyond The Pale Became a shut in basically as was shielding, so really only seen who I live with - my sons and hubby. Except for going to my Uncles funeral in Jan. So glad Ive got a garden and rescued a cat during this time though. I'm still working from home in Childrens Social Work - all virtually but I think that will change soon, will be back in peoples homes and schools. Kinda nervous about that part though...

Never knew that is how his story ended. The law is a funny thing, people are constantly chastised by judges for attempting to repeatedly seek remedy through the courts, referred to as “a second bite at the apple;” yet Miranda was back in court after the SCOTUS decision. A far more complex legal scenario that needs far more time to explain than any of us have.

Brilliant! I bet many had a huge sigh of relief when Ernesto died. How many more chances were they going to give this block? Thank goodness for the Miranda Rights. Some may disagree with me but those arrested are told of their rights, if they talk that’s their problem.

At the end of my VERY long 6 day week - it was such a treat to curl up to a TCR video before bed! This man just kept being released over and over! You have to wonder what they were thinking... paroling him after only 11 years on a 20-30 yr sentence!

OMGoodness my brain is still asleep...it's only 6am😴🥱 As I was watching I was wondering "Why does this guy need a place on TCR? He's a nasty jerk but didn't do anything heinous..." I was waiting for some horrific string of atrocities to be attributed to him or something. Hate the crimes, but so thankful of the outcome for the Miranda rights. This was groundbreaking at the time. Another story is Gideon's law which gave us the right to a free defense attorney. Many are unaware that these rights did not exist till this century. And the lack of them mostly impacted the poor and minority's. I would love to see you do a video on Gideon and Robert Elliott Burns as well.( the crime there is the absolute injustice) Oh have to share with TCR, have received my second vaccine( 0 side effects felt with #2 shot) as well as my father and my mother in Oregon. This is of course a personal choice, but I'm sleeping better now knowing my elderly parents are better protected. All have a great day😸
