When John Eastman suggested that Pence had the power to subvert the election and “throw out” the disputed electoral votes, Eastman referenced the Electoral Count Act. Former federal Judge Michael Luttig refuted Eastman’s misguided reading of the Electoral Count Act, and advised - via tweet - that Vice President Pence had to count and certify the votes.
But that wasn’t the only tactic that Trump and his allies tried to use to remain in office. They also attempted to exploit vague language in a fringe concept known as the Independent State Legislature Theory (ISL). Extreme interpretations of the ISL doctrine argue that state legislatures have absolute power to set election rules and to determine disputed outcomes. It would give elected state representatives the authority to redraw districts without oversight, hand pick electors and even ignore their own state’s voting laws and constitutions. It was the “centerpiece of the effort to overturn the 2020 election long before the election itself,” Luttig tells Velshi. And arguments currently being made are “not tenable under any of the normal tools of constitutional interpretation.”

Pence tried to educate the moron and get him to stop embarrassing himself. “Allow due process so no one’s rights are trampled, but the ability to go to court, obtain an order and then collect not only the firearms but any weapons,” Pence said. And, as expected the bloviating orange sh*tgibbon retorted: “ *Or, Mike, take the firearms first, and then go to court* ”

@@ehayes7849 I'm an old lady but I didn't have to learn integrity in school because things like honesty, decency, manners, responsibility, etc were things I learned at home. Since we already knew basic conduct when we started school they still had time to teach Civics back then.

Clearly, although the judge is conservative, this doesn't stop him from upholding your constitution, and, along with it, your democracy. If we're not diligent and stay alert, it could still happen. They haven't given up. We should seriously be wary of the ones he's endorsed and are on the ballot, to keep them at bey, Trump's shadow government who would lay in wait for the right time to rear it's ugly head if they're voted in. There's probably not another TV anchor in the US, if not the universe, who would have let Luttig talk that long without interrupting. There needs to be some kind of journalistic award for that level of self-restraint. Luttig is an expert and very precise orator, which is exactly why he's worth listening to, so thanks for not forcing him to compress his responses into short meaningless sound bites for the attention span disabled members of the audience.

I think everyone should read Mary trumps book on trump. Trump has just tried to open another company to skirt funds away from current case against him for tax evasion. Its being challanged also. Trump has never been held accountable for anything and has this attitude he is an untouchable diety who is smarter than everyone else . The wall are closing in on him and his cult memvers are too uneducated to understand what kind of person trump really is. The thing that got me was when they said " the judge gave pence the authority" tomdomthenright thing. Maaybe I am being pendantic, but "authority" is not the right word. The tweet gave Pence the "ability " to tell detractors he was just following the rule of law.

I took it more as Vice President Pence needed confirmation from an authoritative source. Judge Luttig is a highly respected republican constitutional authority.

@@curtisaz I somewhat agree. Sure confirmation is good, but seriously think about it. You're the Vice President and your days away from performing arguable the most important role that your position holds, and you're not 100% sure about it? A good Vice President might have gone into the role not knowing, obviously they aren't born knowing, but would have learned their duties early on in their role. Four years later and just days before is just unacceptable. But that's just my opinion and I respect yours.

I think that assumption is conjucture at best and the lack of acumen at worst. actions from great leaders in times of crisis are rarely made in a vacuum. Military Generals have legal counsel when strategizing and implementing military operations and CEOs have trusted financial officers when making major decisions. The Vice President was reaching out to the foremost constitutional authority in his sphere for counsel. This is a sign of great wisdom, especially given the crisis that unfolded and the grave consequences for our nation.

@@curtisaz First of all, Mike Pence did not reach out to Judge Luttig, one of his concerned Counsel did. 1:18 And I didn't have to assume anything, it was clear when the VP cited the Judge's Tweets and called to thank him the next day. Why would Pence feel inclined to call and thank Luttig, who indirectly over a social media platform told him what his responsibilities were, if he already knew them? 2:45

Once I got used to Judge Luttig's thoughtful, considered speaking style (Jan 6 hearing #3, and a 2-1/2 hr interview with Frontline ) I started looking forward to hearing what he'd say next. This was an excellent interview. Thank you, and more like this please. It's like Civics classes for the adults who never got it in high school - and for those of us who did.

it's so great to hear what he has to say, delivered by one who clearly knows what he is talking about. That alone is reaffirming. Also he is retired, and clearly has no 'skin in the game'. We get so jaded hearing from all those who - whatever their viewpoint - have a self-interest in what they are saying. As a Retired and Very Tired Retired Paralegal (and now being Saturday, October 22 of 2022 as many of the polls have opened plus mail-in voting in many states) this is where my head, heart and exhaustion level is-- Exhausted. Judge Michael Luttig is my hero! I have saved his testimony to the J6 Committee as a masterpiece of judicial writing. I am an independent but vote with Democrats more often than Republicans. But I certainly recognize a patriot who loves this country and the rule of law. Bravo, Judge Luttig and thank you so very, very much for possessing a moral and ethical compass that will not, under any circumstances, be swayed by party or politics. God speed! Oh! By the way, John Eastman was Judge Luttig’s law clerk. Let that sink in. Your own law clerk aiding in obstructing the peaceful transfer of power and overthrow the government. Watching Judge Luttig’s testimony and essentially testifying against his own law clerk was poignant for those who knew this backstory and certainly a painful, defining personal moment for Judge Luttig.

Some are saying that Judge Luttig failed to properly influence the future behavior of a law clerk (John Eastman) and he should be held accountable for this failure. They say that Judge Luttig is in some way responsible for the insurrection of Jan 6th.

Judge Luttig, may well be one of the most Conservative judges in the country, but he never allows partisan views or words to interfere with his impeccable knowledge of constitutional law. As a person who ers toward the left side of politics, I hold this gentleman in the highest esteem. We are indeed truly fortunate that former Vice President Mike Pence had remained steadfast with absolute professionalism and presence of mind, when his life was threatened, betrayed by the president, held the line and performed as he was so appointed, ... supported by Judge Michael Luttig. 🙏

Pence was shopping for a way to do what was asked of him. He is neither honorable nor is he a hero. This judge on the other hold is a true conservative. Despite my disagreement with many of the conservatives' principles, I respect his right to hold such views. True conservatism, however, has been hijacked on the right by raging lunatics with regressive social agendas. The reason Republicans fail to attract minorities is because their so-called " social" conservatism that drives their "fiscal" conservatism is nothing more than thinly veiled racism, misogyny , xenophobia,anti-science and homophobia. More conservatives need to speak up and speak out against v the crazies in their ranks.

He was being told by the Trump advisors that he could do it. We have never had a President demand it, and though he may have believed he couldn't do it, he needed to find out through Constitutionalists and Judges as back up, for his decision. I would think it would be a good thing to ask different ones, that he felt, their word to be true, their opinion on the matter. That shows his respect for the law.

the problem is that "doing your job" shouldn't be some extraordinary honor. yeah, pence did his job on j6 (and thank dog he did). pence drew a line at *_committing crimes ON CAMERA_* but tell me, Holly: should "doing your job ONCE in four years" be praise-worthy? This judge is one of many heroes who worked to defend democracy on Jan 6th 2021; the capital police and the Jan 6th committee, are also to be congratulated for their efforts. Donald Trump, incited this insurrection because he lost the election and wouldn't accept the results.

I know that Judge Luttig is retired, but he needs to further discuss this issue and others in a series of discussions for a longer time period. I would subscribe to the series. I'm also glad he is rewriting for clarification the Electoral Count Act. The madness needs to stop.
