This happened in Tauranga and the elderly women who owned and lived on the land like this couple defended her land until the bitter end. NZTA took it and are now building a by pass to enter Tauranga. The land she looked after had native Trees planted by her now passed husband, I took one of her last walks through that property with her while she touched and remembered EVERY TREE AND PLANT ON THAT LAND. her heart broke because she was getting to old to defend it against these awful planners. We experienced this in Christchurch. Unfortunately as a result we have learned that there are ZERO private property rights in New Zealand. Many Cyclone Gabrielle victims are still trying get back on their feet also with insurance and compensation issues. There is a clause in legislation that when private land is compulsorily aquired, compensation at a market rate is meant to be offered. Instead people have to fight like hell for years and years.

Barthanson3043 I was interested that the Treaty was signed AFTER the UK began rolling back their feudal claims to own everything below the first 18 inches of owned land. The New Zealand government legislated to be able to take people's land off them, to facilitate a railway passage through the Waikato TWENTY YEARS after the Treaty was signed. I'm guessing that this means EVERY NZer cannot have their land taken off them. Thoughts anyone??

This is awful, we dont need another 4 lane highway. We can already access the country that we all call home. It makes me sick that this is happening to our country, not only here but all over. Years from now we will look back at the way Aotearoa has been changed and shaped into a skeleton of its former self, rife with western corruption and greed. well said, though unfortunately us having access to "our" country has little, if anything at all to do with it, corruption has its roots in greed and a four lane highway only serves those who gain from the movement of commerce across it, at the expense of native flora, fauna, Whanau and untouched ancient lands for future generations to connect with. An official info act request by our lawyer to our council uncovered the email trails. When we went to the council to protest about privacy issues they told us to withdraw our consent applications. Mum would always point out it's rugged, untouched beauty and the drive over Mt Messenger was a special family checkpoint for every trip we made. It would be heartbreaking to see that valley disrespected by a road that only saves a few minutes, especially when the existing road can be upgraded. A well built road can be a great asset, Transmission Gully in Wellington has been a huge success but that did not destroy pristine native bush and pure streams like this would. I pray this insane idea is stopped and NZTA pull their arrogant heads from out of their backsides.

Well done on your production. I am aware that the family in your doco lost their case to prevent NZTA building the bypass. The very fact that they were well advanced with construction before they had even secured the route says a lot about their arrogance . When I looked at the WSP web site I certainly had some question marks over their claimed crash savings because they seemed to be using parts of the highway in their analysis (as best I could tell from NZTA’s publicly available crash data ) that were unaffected by the bypass. I put the existing route up on my youtube channel and made a few derogatory comments about what this route will look like after they have buggered the valley, based on their recent cut and fill approach north of Auckland and their “fly-overs” on youtube. Of course I’m sure NZTA would have a PR spun alternate view of how all this went down. I’ve been up and down SH3 for five decades and Mt Messenger was always one of the most scenic sections and incredibly safe if you don’t drive like an idiot, I thought the comment on the cold, ice and fog in the valley was an interesting one and I can guarantee that was never taken into account in the cost benefit. !!

They asked the 40 businesses what they though and ALL opposed their proposal . When they came to me and my business I threw them out with a trespass threat if they did ! Now that they have closed off the road we now , thousands of vehicles must make a +7 K trip to a over pass that is now congested to get BACK to where we use to go south on Hwy 2 . We formed a committee and the NZTA didn't want to listen ! I personally wrote Simion Brown to complain and when I call his secretary she asked when did I send it , I looked on the computer and told her the time and she then confirmed they had it and that Simion would call me . The road companies are using the NZTA as a piggy bank to get money for their over priced jobs it is a Government Mafia . NZ has become a horrible place to live ! Why, for the past few decades, does everything in our country that brings on the skin crawling feeling of possible government corruption, always seem to involve road building?

Thanks for the upload, record every interaction and make is much documentation/interactions etc viewable to the public and not just in your local communities but also things like facebook as it would be a shame to see such a place destroyed (cause we all know how crap government departments are at doing things right or just at times)

Poutama lost the court case. Whats more disgusting is that Waka Kotahi then filed an application to seek costs of $70,000 from Poutama for the legal proceedings, and won that also. If you're interested in reading the court PDF files, google POUTAMA KAITIAKI CHARITABLE TRUST AND D & T PASCOE

Just to get proper balance, it would be great to be told what NZTA offered them . Due to do gooders they have got nothing , with a new road we won't see a junk yard at the road side . A balanced dock would have been great

Thanks for sharing this story. I've been in the courts system self-representing for over 7 years and these so called experts are nothing of the sort. The expert is the person who has the direct lived experience of events including the antecedent events and conditions that contribute to the current situation. In this instance this family and the generations of people that have cared for this land are the experts. Courts do not want truth they want money for themselves and those who they are aligned with, in other words their colleagues, perceived peers and old boys club. Prideful idiots all of them. Stand strong no matter what. Many of us stand with you whilst standing by our own principles in our own struggles. I look forward to visiting this region again and enjoying its majesty. Thank for taking care of this place. I'm sure it takes care of you too

Great actor isn't he. The valley he shows is not even the valley concerned. Only reason, after having been offered extremely generous compensation, that Tony does not want to move, is because of his long established drug trade. Recently nearly 300 plants of an illegal drug were removed from his property. If you think his 'pristine' valley is so loved and cared for, ask Tony to let you in the usually locked gate, which he will refuse to do. You will see absolute waste material pollution, of all description. A little further in, you will see uncontrolled wild pig damage, which if you look hard enough, will include destruction of ground dwelling bird nests, including kiwi. The whole property is a disgrace. The proposed two lane highway, which is now in its second year of construction, is costing twice as much or more, thanks to the stupidity of Tony and his two supporters, whose legal protests have probably been paid for by their drug money income. This route is the one recommended by the TRUE tribal owners of most of the concerned land. Every precaution is being taken to ensure that the minimum environmental damage occurs. This includes replacing every native tree that is removed with ten. No day is started before a kiwi dog & handler have checked the area concerned. Any sign of even a non threatened lizard species, is enough to stop work. So please don't be sucked in by this selfish individual, who cares only for his self interest. As for his statement, "I will have no where to live", he forgot to mention the brand new house he was offered as part of the very generous financial settlement. As I say, "A great actor isn't he".
