Arnold Palmer was a professional golfer. He also either didn’t drink or very rarely drank. So, at functions, he’d have the bartender mix lemonade and iced tea and drink that. It became famous enough that the drink was named for him. Yes, Arizona Beverage Company owns the trademark. As a person who has camped in Minnesota for 26 of his 28 years, the mosquito is the unofficial state bird. I had a lakeside site at Fall Lake after flood season and the stagnant pools left behind resulted in the worst mosquito season I’ve ever seen. After sitting on my screen porch I can now sympathize with the food at a deli being stared at by hungry customers.

What is funny is that both Coca-Cola and Pepsi has sued Liquid Death a few times, the only reason you probably didn’t hear about it is because Liquid Death won every time. List of lawsuits: (1) Cola sued over “copyright” for using aluminum cans. (2) Pepsi sued over future possible lost at music concerts. (3) Coca-Cola sued over international competition of bottled water. (4) Pepsi sued over 20 comedian’s refusing to renew their contracts with Pepsi over new ones with Liquid Death. (5) Pepsi tried to buy outright Liquid Death for 2 billion dollars. Liquid Death would allow it if Pepsi would continue to do 3 things: (1) Sell the product in aluminum cans. (2) At least 1% of profits of the branch goes to cleaning up plastic in the Ocean. (3) Everyone in the LD branch gets to keep all their healthcare benefits for at least another 10 years. Pepsi said no and sued for a break in contract that never happened. (6) coca-Cola sued over a parody of their 2023 Super Bowl commercial. Both videos were taken down from KZbin. The teas also use agave which is diabetic friendly (My mom can't have certain things due to her carefully monitoring her health after being diagnosed as being diabetic, but she can drink Liquid Death's teas, specifically her favorite is their newer Slaughter Berry). I personally love Grim Leafer, Dead Billionaire (AKA Armless Palmer), regular sparkling water (Cool black can), Severed Lime, and Mango Chainsaw. I can't drink alcohol due to health reasons, so my friends never knew I was drinking water until more recently when one of them cracked open a can and thought they were too drunk to notice the alcohol... I told them it wasn't alcohol and to look at the can closer. Sure, they laughed at me at first, but slowly they accepted it. One of them has kicked alcohol entirely by using the cans as a vice to kick their addiction (Similar feel and shape). I have the same condition as my brother too where I am physically unable to keep plain water down (Add a bit or sugar or salt and I can, but something will make me throw water back up the second I swallow it if it doesn't have anything added) but I have no issue drinking Liquid Death (Probably because of the can kind of tricks the mind).

Actually the word "sky" IS trademarked and is used to sue people who try to use it in anything commercial. Skyy Vodka and many others have all had to work around this.

Actually, trademarks generally have a particular class of goods or services they apply to. For a common word such as "sky", a trademark will only be granted for a very narrow set; there's no chance of getting an "all purposes" trademark like you could for a made-up word. Ergo, "sky" isn't trademarked like the word Skyrim would be.

A trademark, in the US at least, is similar to a copyright or patent, but is the the signifier of a product/brand/company rather than the actual product itself. The biggest difference is that there is no expiration date, but you have to actively use and defend a trademark. The best example is Band-Aid, the company, losing exclusive use of, the word to brand their adhesive bandage. It's also why Google sends legal notices to studios when someone says "Google it" to instead say "search for it using the Google search engine." They don't own the word, much less the number guggul, but specifically within the field of search engines, it's associated with a specific service.

If memory serves, the copyright to the use of "Arnold Palmer" in relationship to the 1/2 tea - 1/2 lemonade mixture is owned by Arizona Iced Tea, which includes not just the name... but the image of the golfer himself. So, when it comes to labeling a drink of the same mixture so close to their copyright protected name, you enter the legal area of "infringing" on Arizona's already established market AND copyright material. (The use of a similar name with the mixture) BUT, by calling it "Dead Billionaire", they distanced themself far enough away from the naming issues, that it doesn't matter that the drink mixture is the same concept. It is simply a "naming issue".

Candy Flavored cigarettes were mostly pure sugar, but they did have a minty, cinnamon kind of flavor. Not a strong one but it was noticeable. The ones you can find now though I think are pure sugar.

tangent about the panera bread charged lemonade: part ofthe issue is panera doesn't adequately inform people about how bad the lemonade is, as well as the fact its more caffenited than an ENERGY drink, and is especially not gonna think "oh this might not be good for my health" because 1) its lemonade and 2) panera bread seems to be like abread place so we don't associate that with bad for our health. plus they let you get refills from a slef service machine. All this has lead to people ACTUALLY DYING from the lemonade. So yeah no there's no grey area panera bread made a bad product that actually kills people and has done little to actually stop people from, you know, dying. hence the lawsuit.

So, I'd suggest you ask a lawyer for confirmation, but so far as I understood you are will within your rights to ask other people to message/mail to/call into a company so long as you aren't incentivizing them to commit a crime. As in, you can't tell anyone to go harass them, or you could legally be on the hook if they do, but if you mention wanting them to do something and they do it, and do it a lot you wouldn't be on the hook for that. And if it just so happened that they had several people doing this they would have to go to each person individually to file suit against them

We’d take those, and then pre workout. Then go to “work” and drink coffee after our breakfast or what ever meal you ate when going in. Depends on lots of things on what actual time you went in. Then we’d drink more coffee, like hot coffee during the Iraqi summer. And more monsters…as needed, to stay wake and alert, one reason I’m sure I’m have heart issues plus rip it’s from the chow hall. And however many we could manage to steal. All to be awake and and alert enough to do our job, no matter what. Or how long we had to be. Along with way too much nicotine and caffeine from other sources. Aka. Adding in the instant coffee to your dip, for when you been up and moving. Awake way too long. And still gotta do shit, two packs of instant coffee in a can of cope or skoal? Sure do it, you ain’t got time to make even instant most times, USMC vet here. We were ephedra, caffeine, nicotine and hate fueled MF’s. Along with pre workout too…not to be trifled with.

I won't outright condemn Opera on this as I haven't done enough research, but I recall Opera having privacy issues. Honestly I'd avoid anything Chromium based for sure and Opera makes me a little nervous. I'd just say find out who's behind Opera and make sure they aren't a Chinese based company as well as verify their track record with user privacy. For context I do this for a living.

So take from that what you will. Cancer due to tobacco has only killed some of my family, others did it for ever, never died from that. I’m not endorsing people do that. Mind you. All the health issues that can happen. On top of everything increasing costs, I’m slowly scaling back and will be quitting for good, mainly for monetary reasons. Also health. But money affects me more, faster now than health does, it’d take many more decades to kill me from that. But I can save a stupid amount of money by quitting again. For good. And helps me in other ways too, general health probably and not dying younger from a preventable thing.
