Thank you for the informative information. I filed the case with Eeoc and OSHA for covering up at work.. I was retaliated on, kept accurate records. it was eventually terminated received a decree from Eeoc, And OSHA called me about a mediation over the phone. my question is how do I figure out what’s the value of my case and what is OSHA obligated to make them pay?

You have been a great help with your videos, thank you in advance! I have had no luck with attorneys here in my state. All of the free consultations have ended with you have a possible case but I can not take your case at this time. I am currently running out of town since I was wrongly termed back in Jan. I finally paid for an attorney’s consultation of $200 given no luck with the others. She mentioned I have a case but she can not take my case at this time. She recommended for me to file with the EEOC. Is there a reason for this or should I give up on my possible case…

My sister went through 5 attorneys before she got to the attorney she has now. One, major firm, told her she had a case but due to “economic” reasons, they could not take it. They said they’d be using more money to investigate that what the case was worth. We were so angry and frustrated. Just keep looking, one will turn up.

Please Help: I agreed to take my EEOC claim to early mediation, my former employer however refused mediation. I just recently received their response position statement to my initial claim and it is littered incorrect information. So much so they even got my date of initial employment incorrect by 2 years. My rebuttal statement is due in a couple of weeks, do I correct every error in their statement or just focus on a handful of key issues?

I started my eeoc claim December 27th 2021 they assigned me a investorgater around March 2022 I sent a lot of paper work I got a position statement from employer and I sent one back the discrimination are sex age disability on my job they talk to an attorney for the company and found they were wrong about me. They subpoena there work records. I sent more records of there discrimination . Now they sent my case to someone else What should I do

I have just one last question if you don't mind I was going through your videos and learned a lot from you over the last few days but there is one thing you don't touch on. If you file with the eeoc and the company starts to retaliate but does not fire you just continuously is retaliating by false write ups, increasing work load, micro aggression and you can prove it does your case value go up with each retaliation?

When going into a eeoc meditation is there only a limit cap you can ask for in meditation ? Or can you ask more then 300k

I'm supposed to have mediation here in California in a week via Zoom. My issue is that no attorney will take my case as I was a part time employee, so they won't make enough money off of my case. I'm nervous about mediation without representation. Though I'm very confident in my case and have all the supported evidence, I feel intimidated that the employer will be watching me present everything, unless that's not how it works. I thought mediation was a private back and forth type of scenario? I was once involved in a civil mediation and that's exactly how they did it. Can you clarify how the mediation is conducted?

Whats the difference between you suing the employer with a lawyer or the eeoc suing the employer for you what are pros and cons and can you get just as big a settlement with both

Happy New Year, Mr. White! What if the EEOC never mentions or sends you a letter regarding mediation? Is this because employer said they didn’t want to mediate? EEOC goes straight to investigation.

There is some variance in how certain offices handle cases. Usually I see a similar letter go out to both parties simultaneously offering mediation, but I have also spoken to investigators who check with one party or the other first, and if the first one they speak to refuses, then they don't bother speaking to the other about mediation. Lastly, some EEOC offices just aren't very active and may have a procedure that...... doesn't do much.

EEOC in my case like you said didn't even consider mediation...within one month they adopted the determination of the NYSDHR.....they know I hate them

Someone at the EEOC or the Defendant decided there was no point to the mediation. You can still extend a demand if you want, but I would prepare to draft your rebuttal once you receive their position statement.

I am looking for an attorney. I am having issue finding one for my FAA EEOC case. Currently I was asked to do an offer settlement and I am unsure how to respond. I have my first initial conferance this Wednesday and I didn't even realize they changed the judge this has been so fustrating 😵‍💫

See if your town has a law library. It’s so many resources there and sometimes the law students will answer a general question. You should’ve gotten a letter or email that the judge recused themselves

If the EEOC refers a filed charge for mediation, then what period of time is the Respondent typically allowed to decide whether or not to participate in mediation? If the Respondent decides to participate, then after what period of time can the parties expect to be scheduled for mediation? Will the mediation likely be virtual through Zoom?

is it realistic to talk 1 million dollar plus figures at mediation or is that not really realistic in that forum? can you bring up at mediation that you plan to go to the national media with information that would be damaging to the reputation of the employer. Kind of their last opportunity to hear what would be in tomorrows news? any thoughts

I'd say don't exactly say you're going to the national media. Word as a riddle for them such as "if my issue isn't resolved or criteria is met I'm prepared to go extra lengths to inform and ensure this issue never occurs to another employee" something like that. Never say your exact moves rather legal or personal it's always best to surprise

When I was supposed to go to mediation my attorney declined because the company’s’ lawyers wanted us to send our video evidence , my attorney said that’s a bad idea , he said they will just try to come up with a defense to it as opposed to it getting us a higher settlement ,Does this sound right to you Vince ?

I don't know the circumstances so I don't want to second guess your attorney. But the other side is going to get those videos in discovery eventually, and they'll have plenty of time to think up a defense.

The EEOC stated my employer wants to settle and close case. Then they came back and stated the company was dragging their feet. And suggested I receive the right to sue letter. what are your our thoughts on this? This was a medical discrimination case.

Hi, sorry this is long. I have a unique situation. A coworker reported me for 'harassing' another coworker (whom I had been friends with for about a year by then). I have not read the write up, but I can only imagine it says something to the effect of (I) technically am allocated to work out of office A, but I showed up to work out of office B a few times, while my friend happened to be out of office, and I sat in her vacant seat... 'Blah blah blah, concern about harassment'. So the company gets some HR imbeciles to investigate this non issue, who then pull my friend into an interrogation without telling her what it was for to get some timeline, and at some point she apparently mentioned that she didn't respond to my texts at one point (months ago and I had not texted since). She would have said that we were friends when they asked (they asked me as well). I have gotten a text from friend coworker that affirms that she never 'said anything', meaning she did not have any complaint, since then. But HR then pulls me into an interrogation without telling me why and asks for a timeline of my interactions with my friend coworker for no reason. They then come back and claim I harassed her and give me 'disciplinary action'. They provided no evidence to support their claim when asked and even made it clear that the friend coworker did not complain of any harassment. First off, there is no way any investigation could have been prompted at any point if the only difference here were that I were female. HR clearly only tried to claim this was harassment because they believe it somehow to be safer for them legally so they could say they took some action, as I am a man and she is a woman. The company has a portal where I can report this discrimination. I am between reporting there first and filing this with the EEOC. Frankly, the appropriate resolution to this is that these HR persons involved are fired for either blatant stupidity and incompetence or moral bankruptcy in viewing employee employer relations as a sort of zero sum game, and the one who filed the initial report is reprimanded for discriminatory behavior in filing the report. What path should I pursue?
