Got the point. But can't the judge punish the police officer because he/she is not registering FIR even in a valid case?. If magistrate or courts don't punish them then the police officer will continue to waste our & magistrate's precious time.

These systems are only there to serve the ruling class - in the past it was our British enslavers who used it to get the police to basically blackmail the "natives" into submission. We cannot change this system now because those are in power have a vested interest in maintaining the status quo. So we still have enemies of the nation and its people right here in the police and judiciary! This convoluted method of getting the police to act is testament to the kind of democracy we live in.

It has to change our Police regulation and CrPC . .. That is required New Enactment by Parliament...log procedure to be dealt... But if have good intention can be done by members of Parliament.

A lot of legal professionals donot know an additional point regarding 156(3) which is that not only does 156(3) confers the power on magistrate to order registeration of FIR and direct investigation but it also clothes the magistrate with the power to order a 'proper investigation'.

Police will never accept FIRs to reinvestigate their botched up earlier investigations even if the now angry complainants - who were earlier defendants or the ones accused of crimes against then complainants - who will now become the accused, and the guilty when proven with concrete evidence in the courts of law - wish to lodge FIRs. Vicious Police, hand-in-glove with criminals, are happy to side with these criminals to discourage people wrongly accused of crimes against those who lodged a number of complaints against them for crimes committed against them. Unfortunately, some people are above the laws of the lands because they have the blessings of lawmakers, lawyers, advocates, health professionals, judges, jury, law enforcement, media and the public. Period. ☺
