Hello, my name is Chris Morales I'm a criminal defense attorney in San Francisco,California. I'm a board certified specialist in criminal law.
I want to talk today about a very common occurrence and crime.It is the law of hit and run and the law is really strict here if you get into any sort of accident or fender bender or minor scratch you have to stop and exchange information with the driver.
If you hit a car accidentally that is parked and the driver is not around you are obligated by law to leave your contact information and if you have it your car registration and you insurance information with that vehicle or track that person down the owner of that vehicle and give that to them.
If you do not do this you are charged with vehicle code section hit and run and you will be arrested and go to court.
So, if you neglect to do and you do go to court there is a way out of this. The law can be a little bit forgiving in this particular instance. If you damage somebody's car and you are able to pay for that damage and if the other person is agreeable then you can do what is called a civil compromise. That is if you can show that you paid all of the damage for the other party and the other party will write just a brief letter to the judge saying you know what I been paid in full I do not seek any prosecution and I want the case dismissed. The judge can dismiss the case even if the District attorney objects to the dismissal. So, that is called a civil compromise and it only works for minor hit and run cases.
If there are any injuries involved the chances of you getting a civil compromise are very, very slim.

In New York State there are so many cars being driven illegally that there is an epidemic of hit and run auto accidents. The NYS DMV and police estimate that in parts of some cities one out of every two cars is illegal. The NY Legislature, in their infinite wisdom, decided to address this problem by REDUCING the penalties for hit and run accidents DOWN from a Class A misdemeanor to a traffic infraction if there are no deaths or serious injuries requiring hospitalization from the accident. Their reasoning was that treating hit and runs as a criminal offense was having a disproportionate impact on some minority groups who are committing the hit and runs. New York roads are now like something like a Mad Max movie. My advice is to get the best insurance you can afford.

If is a minor hit and run ! You don’t really need to hire a lawyer…they want you to hire them for obvious reasons … you hit a car park or moving you flee the seen wait till they contact you at least 24 hours assuming no one was injured…bumper to bumper … call the police station tell them what happened hopefully you can go down to the police station and exchange insurances and be ruled an accident… But if you know you shouldn’t get behind the wheel that is the for sure way not to get charged with hit and run or much much worst .

Please help me. I was mowed down by a Lime Scooter on May Twentieth by a Lime Scooter on Browne and second avenue Spokane. The ambulance service as they loaded me into the ambulance said they "caught the guy who did it" I asked the Providence recieving staff where the police where to file a report. The emergency staff doctor asked me if I was mentally ill as I lay dying because my Medicare card apparently reads as such. I got SSI at twenty because the Dept of rehab I applied for for work in the early seventies, I was a stripper stuck in the business needed me 'not to work' stigma became my life, I hid mental health scam by getting a degree and high quality art schools I lived my life. I called crimecheck the next day my nearly severed arm in agony, my brains smashed into the surveiled major city sidewalk

Pickett Reintroduces Hit-And-Run Bill  2/19/2013 HARRISBURG - Legislation that will help to save the lives of those involved in hit-and-run vehicle crashes has been reintroduced in the new 2013-14 legislative session by Rep. Tina Pickett (R-Bradford/Sullivan/Susquehanna), author of the proposal. The legislation would specifically deal with hit-and-run crashes involving serious injury or death and assess criminal penalties upon the passengers in a fleeing vehicle. “Under current law, there is no legal requirement for anyone to call for help when a hit-and-run accident occurs, and if that crash is serious, every second is important in making sure any victims get prompt medical attention,” Pickett said. “The present law makes it easier for someone who has caused an accident - either a passenger or a driver - to flee if he or she may be under the influence or afraid of contacting authorities for any reason. If the passengers in that fleeing vehicle are able to call for help, the law should make it clear they must do so.” House Bill 401 would hold passengers traveling in the vehicle at the time as legally responsible as the driver of that vehicle for reporting the accident to authorities as soon as possible. Pickett’s legislation is modeled after similar legislation in New York, known as “Steven’s Law.” A former Bradford County resident, age 17, was killed by a hit-and-run driver while cycling in Ashland, N.Y. on March 22, 2007. The body was not discovered until the next day because neither the driver of the vehicle, nor the passengers in the vehicle, reported the accident to police. “It is the intent of this legislation to hold equally accountable those passengers who, by their presence in the vehicle, are involved in and knowingly witness a hit-and-run accident involving serious injury or death, yet decline to report the accident to authorities,” Pickett said. Under House Bill 401, penalties for passengers who fail to report a hit-and-run accident would be the same as those imposed against a driver who is guilty of the same offense. If the victim suffers bodily injury, the violation is a third-degree felony, with a minimum prison term of not less than 90 days, and a mandatory minimum fine of $1,000. If the victim dies, the violation is a third-degree felony, with a minimum prison term of not less than one year, and a mandatory minimum fine of $2,500. The legislation has been referred to the House Transportation Committee for consideration. My parents car was hit in a parking lot at a mall and there is a camera that recorded everything. The issue is my mom did not notice until she got home. The police refuse to do anything or look at footage because she left the scene. I’m from New Jersey and there is a law saying that everyone must wait at the scene. I was in my school parking lot in my car, and I saw a student hit another parked car while backing out, then drove away. I checked it out and it was a super bad dent in the doors. I left an anonymous note with the license place number, time the hit took place, and description of the car and driver, that did the hit and run. Should I have stayed out of the whole situation? At the time of writing this I can still go take the note off the car..

I hit a car behind me with 0mph and got out the car it was no dmg at all went back to the lady’s car the police didn’t know who I was and the lady I hit the car said it was okay and she was not worried about it took down my insurance. But the court still have my case and they said they might sentence each to jail, suspend my license or possibly deport me or up to 1000$ fine but I have insurance which is bullshit So I decided to plead not guilty

I was hit by a semi. He took off. I told the cops witch Company he drove for and his trailer number. And the business he just left... The cops found him and the company sent the cop pictures of his cap with no damege at all. I was hit with his trailer..... Can he still be charged?

My truck was hit while parked, there were parts of the guys car all over the place and paint on my truck from his car. I did not see the accident but I noticed on a neighbors camera a black car with damage on the front around the time my truck was hit. If there is paint from my truck on his car is that enough for me to take him to court, I just want him to pay for the damages done.

I witnessed a woman hit my car, she fled. I got her vehicle info and name. When the police officer showed up at her home to collect her insurance information, she completely denied hitting my vehicle. Even though she got out of her car after she hit me, then got back in and fled. Obviously knowing she hit me. What are my options? How can I make sure pay, other than a lawsuit

This video doesn't provide enough information on the steps to follow when involved in hit and run. It seems you only covered what the person who hit should do and the penalty for running. What about the victim of a hit and run? I was involved as a victim. Was hit while I was at a stop sign. I took a picture of the guy's tag and notified the police. I gave my statement, I got the report, turned in the picture and report to my insurance company. I called a few times over a year's time and nothing to all of a sudden be told that there is no evidence of that person's involvement (we are insured by the same company by the way). What should I do then? They say the address of the other person doesn't match but does that matter? The representative said the report doesn't say at fault but it does. It just seems like they were looking for excuses to not charge the person and trying to get me to use my own insurance to pay. Do you have any advice for my situation?

I was being chased by a truck and after getting a good distance from him I tried to turn and my wheels started sliding due to gravel and my brakes locked causing me to hit a tree and wreck, the tree was not damaged, I ran from the car in fear for my life being that the truck was chasing me, the cops talked to my mom and I guess they told her they just want a statement from me. Hi I"m in California with Liability Insurance and Uninsured motorist coverage. My car was parked and was hit and damaged overnight no note left. I made police report. I called Insurance company and she said give my claim# to any autobody and Allstate will pay for damages. Then their adjuster said since no one left info like license and license plate they will not cover the cars damage. He said it is written in the policy Allstate. I read it and it does not say anything about getting the other persons info; they left the scene. Is this true? If anyone can help I would really appreciate it. Thank you

Quick question i got into a hit n run and im only 17 i’ll be 18 in april the hit n run wasnt intentionally cause i had panicked and didnt know what to do i didnt have any license to provide them with so i left no one got injured or anything it was a minor accident and they’re tryna sue me can i get my case dismissed with “ A Civil Compromise” What do i do? Do i go to there house before court and pay the damages? Or wait for court and let them know ill be willing to pay the damage?

Well what if the hit and run was a street sign. A few months ago I was feeling sick while driving and got light headed and jumped the curb next to me and hit a street sign and some trees. This was next to my neighborhood and drove home. I went home and threw up and had diharrea. I guess someone called the cops and took my plate because the cops were at my house an hour later. I told them what happened that I was sick. They checked my car and I gave them my insurance information. The next day I went to the ED and the day after that. I was very sick and was off from work for a few days since I couldn't hold anything down. This happened back in April 2022 and now in September 2022 I get a notice to appear in court with the district attorney. I called my insurance, Geico, and they said they had already been in contact with the courts and that it was all taken care of. I sent my insurance the paper work for my ED visits and the letter from the courts. What do you think will happen and should I hire an attorney?

My reason for asking is im currently in a similar situation as im a semi truck driver, yesterday in new mexico delivering a load i had to detour a work zone, was pull by the police officer saying they got report i hit a lightpole iltold them i was totally unaware as I wasn’t. Inspected my trailer saw a rub on my rear tire n said that must be where it clip the pole. He then gave me a citation for leaving the scene of an accident to report to court.
