The Law of Torts: Assessment of Damages for Personal Injuries (Lecture 7, LAWS11069)

This lecture provides a broad overview of the common law remedy of damages. While damages are prima facie available for most torts, particular reference will be made in this module to the assessment of damages in personal injuries caused by negligence. The assessment of damages for personal injury in Australia is now governed by the civil liability legislation in each jurisdiction. As such, this lecture will provide a brief explanation of both the common law approach to assessment and the legislative approach under the Civil Liability Act (CLA) 2003 (Qld).
