What I try to get across to people who favor term limits is that term limits aren’t a constraint on the politicians; they’re a constraint on the voter. They tell the voter that no matter how much you favor a candidate’s positions, no matter how well he may have performed in his office, you are not allowed to vote for him. If you write him in, your vote will be discarded. If you convince one million of your fellows to write him in, one million votes will be thrown in the trash. A constraint on the voting public is a constraint on liberty. Term limits are a constraint on liberty. There is a logical disconnect between loving liberty and favoring term limits. When I’ve presented this argument to people, they often respond something to the effect of, “I agree with you, but entrenched incumbency comes with so many inherent problems that term limits offer a way to get rid of politicians who think they’ve been elected for life.” I don’t disagree that there are plenty of serious problems attendant to entrenched incumbency. Solving them by diminishing liberty is like throwing out the baby with the bath water. The 22nd amendment was a terrible idea, but like so many terrible ideas, it has gained a conceptual foothold and its idea is proliferating. The solution is not to expand it to other elective offices, but to repeal it and put the idea to bed once and for all. As far as Supreme Court justices are concerned, the system of checks and balances we have include not only those of the enumerated powers but of political and non-political offices and their terms; six tears for senators, four years for the president, two years for representatives and no temporal limit for SCOTUS. This is a balanced and rational scheme taking into account the function of each office.
