The origins of the racial Hierarchy in America go back even earlier than Bacons rebellion (1676). In 1640 three indentured servants attempted to escape their servitude in Virginia, 2 white (Dutch) one Black. When captured and tried the two white servants got 4 extra years of indentured servitude as punishment. The black servant (John Punch) was sentenced lifelong servitude and could be sold or rented out as property for the rest of his life. He effectively became one of the first (if not the first) chattel slaves in the Americas. So even though formal legislation in Virginia came after Bacons Rebellion, the courts decades earlier were already applying this racial hierarchy in the application of separate and unequal penalties for blacks and whites.
