I REALLY hope that Nintendo loses this case. The company really need a good humbling before the company starts seeing itself as the next Disney, with their willingness to even sue basic ideas that likely predated their own products. Nintendo will only get bolder if they get precedence by winning this case. We already have Internet Archive set to get another reaming (from the music industry iirc) after the precedence set by their recent lost case, so the last thing we need is bolder Nintendo.

Patenting mechanics is utter BS, imo. Remember the Shadow of War/Shadow of Mordor games and the Nemesis system? IIRC WB patented the nemesis system and proceeded to never use it again. If you're going to allow mechanics to be patented, and that's a continent sized "if" to me, then that patent should be voided if you don't make a product using the thing that was patented within a specified time limit.

People need to learn how game patents work. They don't patent the specific mechanic of catching the creatures to use in battles. It's how it's implemented, for example with pokemon, you use a ball, throwing it at a pokemon, pokemon has chance to get caught, heath level and ball type effects chance. you can't patent specific mechanics, only how it's implemented. And this is what they are most likely going to court about, the practically 1 to 1 implementation of a mechanic. Nintendo was merely taking this time to build their case

I'd still be okay with some kind of crystal-like of thing instead, and where you can capture a pal in a shard instead; throwing constructed Pal Shards at them in a dart or kunai like manner, forcing them to an aethereal essence-like state and then shwooping that into the shard to attempt the capture. Your shards could then be worn like jewellery and function to release them at any position close-by.

Regardless of the legitimacy of this lawsuit. I really wonder if this is going to break the camels back in regards to Nintendo's holier than thou reputation. In my opinion, Nintendo is as bad or worse than EA with the sole exception being their video games are good enough to cover over all of the bad that Nintendo does. It's PR team has worked wonders on Nintendo's reputation, but at some point eventually with all of these bad decisions that they managed to hide away with their really good games, it's going to have consequences for Nintendo. I wonder if pow world is a large enough to actually get a legitimate pushback this time instead of them. Just getting away with everything like they usually do.

It's why I disagree with patents on mechanics. Pokemon should never own exclusive rights to creature catching and battling game. Would Hogwart's Legacy run afoul of creature catching? Would Monster Rancher run afoul of creature battling? It opens up a lot of doors from its sheer ambiguity.

This is the absolute lowest Nintendo's legal team has ever stooped too. When it came to shutting down fan projects and emulation sites they were in their right, but they had to do go so far out of their way to create vague patents for general game mechanics just to even try and take shot at Pocket Pair. This is beyond preserving IPs, this is just being petty. And yeah, it's not going to benefit them, Palworld has mechanics similar to Pokemon, but as a whole it is so much different. Palworld players aren't going to be going to Pokemon, it's apple and oranges, both are a fruit and that's about it.

As far as I understand right now, they are legally in the right if a patent was infringed upon. However, I like many people right now am still incredibly upset at their actions. The court of public opinion is stacked against Nintendo right now, and I think they've burnt through a lot of good will they've earned over the years. Apparently that's the second time they patented it. There was an earlier one back in Sept 2022, but that was a couple years after Craftopia released, which apparently has a similar creature capture mechanic, from what I've heard.

I had a time on twitter trying to explain why this is absolutely a bad thing, and the only arguments to the contrary I saw were that 1) we still didnt have all the info so we’re not allowed to speculate, or 2) businesses in Japan have a cultural history of patent spamming because apparently other businesses could create and take those patents if they’re not patented??? Both arguments were insanely stupid and after a certain point I just got tired of interacting with people about this.

I've honestly just stopped interacting with a lot of Twitter over the same reasons they fall into bad faith arguments really quick. This is one of those things that I'm incredibly concerned about, but nothing can really be done about it. Internet outrage is 2 weeks, but this legal process is going to take a while. I have my eyes on this case, and whatever is publicly accessible. I'm also going to be watching for other companies engaging in the same behavior, should they arise. Patenting mechanics and the way that they are implemented can be one heck of a slippery slope.

I have my doubts that these patents are actually the cause of the lawsuit. The Palworld dev's already had the basics of the catch system in their previous game Craftopia which released 2 years prior to Legends Arceus. Also it includes quite a a few claims that simply don't exist in Palworld. And Palworld doesn't have the described mount system of the other patent.

I don't pick up Scarlet and Violet again because I'm tired of performance issues. It makes my eyes bug out. Sword and Shield were the better competitive experience for me because at least it was more stable. SV felt like a step back in many ways.

The only "patented" mechanics that i can think palworld shares with pokemon its catching a creature by throwing an sphere object after weaking it, creature breeding and maybe battling with said creature... If that was the case, why temtem was ignored? If anything thats more pokemon than palworld... Nintendo probably didn't go after Temtem because they use cards not capsules, It kinda reminded me of the time they sued TearRing Saga not because it was an SRPG but because the game was literally just a Fire Emblem on the PlayStation, Hell the main protagonist had blue hair before the game's release. But Nintendo lost the case and TearRing Saga's developers released the game with the only change being the main protagonist's hair color.

Some of these patents came up after Palworld was a known quantity (some after the early access was released). Palworld isn't even like pokemon in any way other than having creatures that are very similar in style. Here my honest take on this: I dont think nintendo isnt here to nuke palworld face of the planet, i think they have issues with some of the models, not all of them but some of them is almost one to one of pokemon models but somewhat changed, we cant lie some of them are this pal is this pokemon but somewhat changed, there was a post nintendo made like months ago talk about they would be looking at palworld see what the people say hold any water so this most likley they found something they have bit issue with, then now palworld post they being sue while nintedo kinda didnt assuming they wanted to keep this lawsuit private. the dragon quest argument, i haven't seen any proof if the creator of pokemon use dragon quest idea for the game, all i dig up is this using bug catching as the bases for his game, plus the agrument they kinda use is with very.. how i say? basic monster types which every game even stories use since man kind could make stories, if we use the dragon quest agrument, we can say that game copied, dnd since that game got the same monster types, since the game and board game 12 years apart, can they sue them? i dont think so because that bit silly. would palworld be gone? the most they could sue for is using of their models or is tooooo close to their pokemon maybe they are tracing; there alot of pals look like.. well pals while others look like a pokemon but somewhat change up, there so many other monster catching game that is fine, nintendo never touch them because, well they're different games. It's mostly that I'm bringing to the forefront that when everyone starts to file patent lawsuits against each other, it will be an overall detriment to the entire gaming community. From AAA and AAAA developers, to the little indie guys. Companies at the end of the day are there to make money, and innovate if it makes them money. That's the fair and reasonable expectation. Having potentially ambiguous patents that can be called upon at any time can be a big moral and ethical issue. Not necessarily a legal issue, Nintendo might have enough here to stand legally. But, the court of public opinion isn't looking at them with any favor. It doesn't have to be Nintendo either. Any company patenting mechanics in games has been criticized by me. But, I'm curious to see how this will go. I can't really do anything more than that.

When Nintendo announced Pokémon Legends Z-A for 2025 I thought they were _finally_ taking the criticism on board and giving the games enough time to bake. Yeah theres a lot of games out there that have monster catching and/or battling mechanics that play off a pokemon-like system (dragon quest: monsters, monster rancher, fossil fighters, hell you could even lump the tensei games in at this rate). As i said in the community post, though, it honestly still feels like nintendos doing this to appease the whiny pissbaby pokemon "fans" who kept throwing comparison videos around the internet. I doubt even Nintendo will try with a CCP controlled game, with the CCP likely having some law requiring the case to be brought to Chinese court. If even Disney basically never sues Chinese bootleggers, I doubt Nintedo will, even with Genshin's overworld being so close.

Its disappointing but understandable. Japan does NOT share its IP ideas. This is just an immovable fact about their bussiness modles. It was inevitable this was going to happen. Doesnt matter: Those are THEIR markets, and they are NOT up for competition, and there shall be NO discussion about it

Which is fine. With their declining quality in games, it'll eventually come around to bite them in return. They won't fail, or go bankrupt, in my opinion. But, they will definitely see hits to their profits. Especially in the face of the "Ever increasing profits" philosophy. Whether it's legal or not, the court of public opinion is really not liking this decision.

@@KipReactsI think you are wrong. Companies like apple should be out of business by that logic, with scummy stuff they do. But they aren’t. The fact is Nintendo makes good games. Barring Pokémon, they too many good series people love.

0:58 ...From the abstract, the number of games "stealing" that mechanic at this point in time is staggering. This would effectively ban transforming or multi-terrain vehicles entirely. That's whack, even for Nintendo.

@@KipReacts Oh, if it's anything based off of this, this is going to be worth a sit down with a bucket of popcorn. This 'patent' would allow Nintendo to sue Gaijin for having the game Warthunder, which as anyone could tell from a glance, is COMPLETELY DIFFERENT from anything Nintendo has ever made. Can't imagine something based off this abstract bit actually going anywhere. I'd certainly be interested in seeing what you'd design, though! Hopefully this all ends well.

just a heads up kip, but are you sure showing Byleth's Lower "lips" at 3:13 is a good idea considering it could get you in trouble even if its showing it at a minimal level some one can mistake it for what it is. Just trying to help one of my fav Vtubers
