Good one. I see this case cited in so many cases and often wonder if it should be revisited. So many missed opportunities by the Supreme Court one has to wonder how much they really care about all of the wrongful or unsafe convictions had.

I have used the Rule in Browne and Dunne 1800's on appeal to the Full Bench of the Federal Court of Australia and I was successful in that matter. If you can get your hands on "Cross on Evidence " you will find that it is not as narrow as you suggest .
