Is the Code of Conduct in the South China Sea on the brink of collapse? Is conflict in the South China Sea possible? ‪@dr.ilangokaruppannan‬
Watch this video next: • South China Sea Tensio...
Discover how the Philippines, in responding to its conflicts with China in the Second Thomas Shoal (Ayungin Shoal) has made a tactical error seeking an extended EEZ.
By using the Sabah baseline, it revives a dispute over Sabah claim, a move that will strain bilateral relations with Malaysia. The submission has also introduced new problems in the overlapping claims in the South China Sea dispute. These developments risk creating distrust among the ASEAN claimant states which could cause the negotiations on the Code of Conduct in the South China Sea to break down.
By welcoming discussions with Malaysia and Vietnam over its EEZ submission but not China, the Philippines appears to be betting that this move would push Malaysia and Vietnam into negotiating separate codes of conduct with it. However, this move is very risky as it could erode trust and confidence among the claimant states and could cause the ASEAN claimants to go their own ways and deal with China. If that were to happen it would mean the end of the Code of Conduct and leave South China Sea /West Philliine Sea vulnerable to conflict. Ultimately this would spell disaster for regional peace, security and stability and ASEAN unity.

Malaysia may never side with the Philippines in asserting its rights over the West Philippine Sea. Even when the Philipines won the 2016 arbitration which actually benefits other claimant states, was there any word of support from Malaysia? It is heavily dependent on china .. Asean is divided and will implode as a political group because its member states stand idle while its other members are bullied by china whose claim has been rendered illegal under Unclos.

PH's strategy is the SCS with respect to its claim on the disputed reefs with China is to goad the other SCS claimants entwined with its dispute with China. By invoking the Sabah issue, PH has effectively recanted an earlier political settlement with Malaysia, an obvious tactic to complicate matters on the SCS with China. Perhaps, the PH is doing so on behalf of the USA in order to justify the US naval presence in the PH, and by extension the US involvement in the SCS.

Agree that the world is governed by the law. But in the case of Sabah, does PH abide by the court? There are 2 instances that these issues were raised in court. Firstly, there is a court case recorded in 2001 by ICJ (International Court of Justice, The Hague) about the Philippines' claims on North Borneo. It is a special 37-page report by ICJ that was published in 2001 and is easily accessible from the ICJ official website. It was a trial within a trial in the main court case between Malaysia and Indonesia over the ownership of the islands of Sipadan and Ligitan in Sabah. Philippines which is not a party to the trial requested permission to intervene. To comply with Article 62 of the Statute of the Court, the Philippines stated the objectives for the intervention (Section 7 & 84) namely, to safeguard and preserve the Philippines' historical and legal rights (only found in the 1973 PH Constitution) over North Borneo and to inform the court of the effect or effect of the court outcomes of the trial on its claim to the territories. In that trial, Philippines lawyers explained their case especially the Sulu-Ovenbeck 1878 agreement (primal reference) and related information to the court (Section 44 & 83). The same 15 main court judges were sitting at the bench and Malaysian and Indonesian lawyers too were present. On 23 October 2001, by a 14 to 1 vote, the court rejected the Philippine's request on the ground that there is “no interest of legal nature” (Section 93). (Meaning Sulu/PH claim on Sabah is null and void) Type the statement below and go to the official ICJ website (a 37-page report): INTIZRNATIONAL COURT OF JUSTICE REPORTS OF JUDGMENTS, ADVISORY OPINIONS AND ORDERS CASE CONCERNING SOVEREIGNTY OVER PULAU LIGITAN AND PULAU SIPADAN APPLICATION BY THE PHILIPPINES FOR PERMISSION TO INTERVENE JUDGMENT OF 23 OCTOBER 2001 Notice the PH objectives in the intervention, its primal reference, and the verdict by the court. Secondly, Sulu lost all its arbitration court cases in Europe in 2023. The news has been published internationally as well as in PH itself. Check the latest in June 2023. These are a few. The Manila Times: Dutch court rules against sultan's heirs AlJazeera: Malaysia hails ‘victory’ in row with Sulu sultan’s Filipino heirs Philippine Star: French court upholds Malaysia’s challenge vs $15-B award to Sulu heirs Reuters: Spain charges arbitrator who awarded $15 billion to sultan's heirs in Malaysia dispute Reuters: Malaysia says Luxembourg court sets aside request to enforce $15 bln arbitration award Bloomberg: Malaysia Wins Court Fight Over Sulu Heirs’ $15 Billion Award

@@aganivloger3132 The ownership of Sabah by Sulu can be disputable. Because Brunei Sultanate (original owner) granted North Borneo (Sabah) to BNBC dated 29/12/1877. Much earlier than the 1878 agreement. How can it belong to Sulu if Brunei can give it away? Sulu Sultanate relinquished its territories to the Spanish under the Bases of Peace and Capitulation Agreement on 22/7/1878. Sulu has nothing left. Thus the 1878 Sulu-BNBC Agreement dated 22/1/1878 is null and void. The cession of Sabah from Sulu to PH in 1962 is invalid.
@hopelope1703

Sulu/PH needs to resolve 3 legal aspects before making any claim on Sabah from Malaysia. Firstly, Sulu needs to show undisputable proof that earlier, the Brunei Sultanate (original owner) gave North Borneo (Sabah) to Sulu as a gift for assisting in Brunei’s civil war. This is to rebuke the existence of the 29/12/1877 agreement (consisting of 4 agreements) signed by the Brunei Sultanate that grants the whole of North Borneo to the British North Borneo Company (BNBC). These agreements exist and are kept at the National Archives in London. The word “grant” has been used, and it has never been challenged or protested by Brunei, even when the British turned North Borneo into a British Charter (1881), Protectorate (1888), Colony (1946), and finally British Parliament under the Malaysia Act 1963 incorporate it into Malaysia. Secondly, let's assume North Borneo belongs to Sulu. The Sultanate of Sulu signed many agreements to relinquish his territories and dependencies (including North Borneo) to the colonizers. These include the Bases of Peace and Capitulation Agreement with Spain on 22/7/1878 and the Carpenter Agreement on 22/3/1915 with the US. Later Spain and the US relinquished North Borneo under the Madrid Protocol of 1885 and Anglo-US Border Convention 1930 to the British respectively. In the end, Sulu has nothing. Thirdly, PH claims North Borneo (Sabah) is null and void. For any colonized colony that seeks independence, the territory (sovereignty) is based on what has been given by their colonizer. In this regard, the principle of uti posseditis juris is applicable, acceptable, and recognized internationally. PH got their independence from the US in 1946 and under this principle, there is NO North Borneo. Rebut with facts and references. Not hearsay. The UN has recognized Sabah in Malaysia since 1963.

Is there any clause in the 1878 agreement that Malaysia has the responsibility to continue paying Sulu? Why do the receipts in Sulu's possession not mention the money is for the rent? Why is the amount so small in value and not what has been stipulated in the agreement? Why did Malaysia give the money from 1963 until 2013? But the agreement was dated 22/1/1878. When Sulu relinquished its territories and dependencies to Spain on 22/7/1878, it left Sulu with nothing. That 1878 Sulu-BNBC agreement automatically became invalid as Sulu lost its ownership. Why must we pay when Sulu is no longer the owner? Why did Sulu never complain about Malaysia not adhering to the above agreement? In 2013, when Malaysia stopped giving the money, why did Sulu never bring the matter to court? Giving away money is not an offense. Very good unbiased narration of events, w a likely possible surprising yet risky reason for the Phils' asked extended shoreline w Sabah in it.Ever since Filipinos are nonchalant about Sabah issue & the heirs of Sultanate of Sulu are probably only ones keen about it nowt..Phils,Malaysia & Vietnam have partly of their EEZ sea encroached by China's dash line,same w Indonesia & Brunei. Phils & Malaysia's conflict over Sabah was not as highly adversarial as the Phils/China row now.Phils & Vietnam have common at times serious respective clashes w China's intrusions in their EEZ seas, & Indonesia too w China in Natunas area.Posture of the Phils seems it does feel as threatened when Vietnam partly occupied Spratly compared to strongly when China also partly occupied Spratly ...The 2nd Thomas Shoal is within EEZ waters of the Phils under UNCLOS to which China signed as signatory. Also 2nd Thomas shoal as well Spratly,Sabina Shoal , Mischief reef & others claimed by China are parts of Phil Territory embodied in Treaties of Paris & Washington (mentioned by P Marcos in Singapore speech) ceding Phils to US by Spain which treaties China said it accepts recognizes formally conveyed to the UN Permanent Court of Arbitration, yet will not participate in proceedings... Sizable damaged marine & coral life in Phils' EEZ waters due to China's heavy dredging, massive fishing w detrimental methods,harrassments to Filipino fishing & naval boats tolerated by admin of frmr P Duterte, prompted now P Marcos to take a strong stand ( agreed to by 80% of Filipinos in credible polls) to protect & defend Phils' territorial & EEZ sea.

I like to refer to your statement "Also 2nd Thomas shoal as well Spratly,Sabina Shoal , Mischief reef & others claimed by China are parts of Phil Territory embodied in Treaties of Paris & Washington (mentioned by P Marcos in Singapore speech)" and would like to give my comment. "Others" means I believe you are referring to all the outcrops in the South China Sea. PH was colonized by the Spanish and later by the US before she gained its independence in 1946. Therefore, applying the principle of uti posseditis juris is justified as it is an internationally accepted and recognized approach by ICJ in resolving any sovereignty dispute. PH got what was given by the US under the 1946 Treaty of Manila. Historical evidence is no longer valid. The South China Sea outcrops were not stated in the territories under the Treaty of Manila 1946 and the Treaty of Paris 1898. However, the Treaty of Washington 1900 stated that all “islands” beyond the 1898 Treaty particularly the 3 islands namely Cagayan, Sibutu, and Sulu belong to the US and later claimed by PH. But those outcrops in the Spratly’ are defined as “rocks” (not islands) by PCA in 2016 and eligible for the territorial sea. Thus, the claim by PH is ambiguous and cannot apply to all the “rocks” in the South China Sea. In this context, the statement regarding the Treaty of Washington in the Treaty of Manila 1946 served no purpose. Furthermore, if those outcrops are truly under PH, it should have been clearly stated in 1935 (PH Commonwealth), 1946, and 1973 PH Constitution where it has sovereignty and jurisdiction. Surprisingly, it was only established in the 1987 PH Constitution and the details are in the 2009 Baseline Law (RA 9522). What is your response?

ASEAN member states must stand against China in one unison voice, Asean fragmented diplomatic approach is not strong in the face of Chinese incursion. Resist the Chinese bullying, aggression and intimadation against Asean states, with one united voice, china will think twice. With out unity, China will still persuade to continue to assert their illegal activity and bullying tactics against ASEAN states.

Sabah Claim Historical Context: The Sabah claim involves the territorial dispute between Malaysia and the Philippines over the region of Sabah in northern Borneo. Historically, the Sultanate of Sulu, a Muslim state that once ruled parts of the Philippines and North Borneo, ceded the region of Sabah to the British North Borneo Company in the late 19th century under a lease agreement. When Malaysia was formed in 1963, Sabah chose to join the federation through a referendum. However, the Philippines contests the legitimacy of this, arguing that the lease was not a transfer of sovereignty and that Sabah still belongs to the heirs of the Sultanate of Sulu. Current Status: Malaysia asserts its sovereignty over Sabah, emphasizing the results of the 1963 referendum and subsequent international recognition. The Philippines maintains its claim, occasionally bringing up the issue in diplomatic discussions. Extended Continental Shelves (ECS) Definition: The ECS refers to the seabed and subsoil beyond the 200 nautical miles (nm) exclusive economic zone (EEZ) that extend to the outer edge of the continental margin, up to a maximum of 350 nm from the baseline. Relevance to Malaysia, Philippines, and Vietnam: These countries have overlapping claims in the South China Sea, which is rich in resources such as oil and gas, and strategically significant. They have all submitted claims to the United Nations Commission on the Limits of the Continental Shelf (CLCS) for extensions of their continental shelves beyond the standard 200 nm EEZ. Implications: These claims are based on geological and geomorphological data that demonstrate the natural prolongation of their land territories. Overlapping claims lead to the need for diplomatic negotiations and potential joint development agreements to exploit resources in disputed areas. Exclusion of China Reason for Exclusion: China’s maritime claims in the South China Sea are primarily based on the so-called "nine-dash line," which does not adhere to the principles of the United Nations Convention on the Law of the Sea (UNCLOS) regarding EEZ and continental shelf limits. The nine-dash line encompasses most of the South China Sea, overlapping significantly with the EEZs and ECS claims of Malaysia, the Philippines, Vietnam, and other Southeast Asian countries. The international arbitration ruling in 2016 (Philippines vs. China) found no legal basis for China’s historical claims within the nine-dash line, emphasizing the importance of adhering to UNCLOS. Impact: China's expansive claims and activities in the region, such as island-building and militarization, have led to increased tensions and disputes with Southeast Asian nations. China's exclusion from discussions on ECS claims is primarily due to its reliance on historical claims rather than the geological and legal criteria set by UNCLOS. The maritime disputes involving Malaysia, the Philippines, and Vietnam over their respective ECS claims are complex and require adherence to international law and diplomatic negotiations. China's exclusion from these discussions stems from its reliance on the nine-dash line, which lacks legal standing under UNCLOS, creating significant geopolitical friction in the South China Sea.

The ownership of Sabah by Sulu can be disputable.

The Philippines stand for its right of Sovereignty. There is none such so called "ASEAN CENTRALITY". I think Malaysia should not worry about this because Philippines, Indonesia, Brunei, Singapore and Malaysia have the same ancestors or ancestral parents. In fact, it is possible that 100 or 200 years from now these countries will become one as these countries attempted before to form one country known as MAPHILINDO which stands for Malaysia, Philippines and Indonesia. Indonesia really wants to unite us as one. If these countries will become one then the leaders or the Prime.Minister or President could be from Malaysia, Indonesia, Philippines, Brunei or Singapore.. Everyone knows that the name Philippines has nothing to do with their bloods and ancestors because Philippines are Indo-malays just like Brunei and Singapore. We rather help one another to ward off China from the Indo-malay territories. Remember we have the same ancestral parents. Look at Indonesia, Brunei and Philippines they look up each other as brothers with strong close relationships. Philippines and Malaysian politicians should set aside their personal interest and rather think for the good of all Indo-malay people because we are great people...

Actually the issue is not black or white. Claimant states are not trying to appease China. All of them have protested against the 9-dash map. All of them do not recognise it. But China is prepared to talk. Why not take that route. The UN adjudication path is not going to produce tangible benefits.
