This is one of the reasons I left trucking. As an o/o I was getting ripped off by too many brokers. Yes, I can collect from the shipper, but it can cause problems the next time I attempt to pick up a load with them. Need just to get rid of brokers and be done with it

ET Transport. I’m a truck owner operator working under Dunavant Sea Lane LLC authority. They don’t offer a tire insurance program. When a tire of the chassis blow out they charge you $1200 to replace the tire. It is a company rule. They don’t offer any tire insurance and the driver pay $1200 to replace a recap tire in the chassis. Do you know any insurance trucking company that offers insurance for owner operator that covers the tires of the chassis?
Because we live in a free country so solving problems makes money. Most companies that use brokers do so to save the time and trouble of doing the job the broker does. You might believe they do nothing, but in reality they do the qualifying of transporters, which solves a lot of headaches for a business. Many companies I have dealt with could drop 3 to 5 employees that were paid yearly full time salaries and benefits to offload this responsibility to a broker. For transporters brokers solve the problem of finding loads from shippers. For small outfits this is a huge win. If brokers disappeared today, no small carrier would likely exist within the month. Medium to large scale transport companies hire teams to contact companies and go through the sales chain grow trust and get shipping contracts established. They have lawyer teams that write up these contracts while working with their own staff so they are mutually beneficial so they won't drop after someone comes offering lower cost a month later. Load brokers don't get rich, funny enough they have the crab in a pot syndrome though. New brokers will drop the rates industry wide just to secure contracts and there is always some midnight electric fuel pump holding fuel their owner operator from the eastern block ready to drive for 1$ a mile. I know many that call Vancouver Washington area their home base. They use a 20 or more gpm 12v electric pump with a power tool battery and in few minutes they make a cheap load profitable. They are so bad that in ten minutes they will swap out outer drives with you when you go to shower. I had my fuel and outer new virgin rubber drives stolen this way. I was in the truck stop fifteen minutes max. My cams picked up a Romania or Moldovan talking and going to each side my truck. Well basically you should thank brokers cause without them you probably would be a swift slave driver

And got paid between $25-$40 in detention about 30 years ago….$25 being only occasionally…$30-$35 was more like regular… This days $35 is trash money. A brand new truck was under $80k Brand new Pete with wet and all the toys including 46k per axle was about $99k in US dollars Shop labor was between $40 to top $65 ….but $65 was the most expensive. So what is $35 worth compared with those money….it’s worth money for 3 packs of cigarettes….3 fucking packs of cigarettes.

Oh they get the detention, they just don't give it to you. If you're a o/o you can reach out to their customer regarding this and they'll tell you. Well the one's I've delt with have. You'd have to reach out to accting. Not the easiest but worth it.

Brokers are also being a pain with the detentions, Yesterday my driver waited 5 hours at shipper and 5 hours at receiver. At the shipper i told the guy there is a delay cuz the shipper directly told us the product wont be ready until 5pm it was 2 pm at that time. The broker said 3 hours free and then detention will be billed i have a call recording of him. And then there was detention at receiver. After the load deliver we sent them the BOL with the in and out time from both sides he said we dont a detention policy with the customer and that is not mentioned in the BOL ima work on it only with the shipper . cuz i told you about the shipper. But then couple hours late they email us saying we dont have a detention policy with the customer. Seriously 10 hours of delay our 1 load being cancelled 1 load being late. Paying a late fee of $200 on that they are saying they dont have a policy. Im just worried about the freight guard report cuz of the hassle of getting it removed. 😐 Please response and let me know. Many brokers have been playing around with the detention.

This is a good story with a good outcome well done. I'm going to had that this person should have been held legally responsible and sued in small claims court...this way these lowlifes in the industry learn to play fair and not steal!!! By not charging them also in court they learn to keep repeating their behavior, but if there's negative consequences to their stealing then it may deter them. If they know they will be taken to court and fined and have a record that can be publicly used to expose them they might stop. No consequences...No behavior changes with true criminals. They should be forced out of our industry for everyone's sake. Guaranteed the lowlife has done it before and is doing it right now to another working person/company. Disgraceful trash. And yes I use the legal system...and have won in court for criminals stealing MY money...and have ruined the criminals reputation in more ways than one. We found out in court just how many more victims there were, but it stopped after that!!! Theft is theft. It's funny how a guy gets thrown in prison for stealing $5.00 bucks from a persons purse or wallet and these criminals in the office steal far more and most don't get any jail time...this has got to stop. We all need to man up and protect our property from thieves.

EXACTLY. The reason that scumbag brokers get away with this is because people LET them. Most owner operators are either: A) Ignorant of the law, B) Uninformed when it comes to trucking business practices, C) Scared of taking on people bigger than them. I successfully went after Amazon last year and WON. The broker went out of business so I made Amazon pay me. Read my story in these comments. That happened to me just last week.

Assembly line, show freight, crew waiting, sail bookings are exceptions, but in the majority of cases the end user derives the same benefit with little or no detrimental effects whether freight delivers Monday, Tuesday or Wednesday. These unfair fines and holdbacks are simply strong-arm revenue generators.

I have gone through one just like that. They said I was late and told me the time that I arrived. it so happened that was when I was mt and tracking quit working when I arrived the bill had arrival time by the receiver and signed. We when round and for bit until I bill the shipper for the whole freight bill because I wouldn't except partial payments. Also stamp the bill with your company credentials it works

A better arrangement is available. The most legitimate arrangement would be, since the final contract rests with the driver responsible with load in hand. Start by paying the driver CASH (app) in hand. The driver will divide the pay from the customer, in the appropriate payments to the broker, carrier, and how ever many brokers are involved in all this.....mess.😊 Yes, novel concept. The driver moves the freight, so pay the driver FIRST (CC'd with customer/shipper negotiated rate). The CONTRACTED driver now pays the "help" after miles, fuel, expenses and hazard pay has been deducted. How 'bout that?!

I have a situation in which a broker is ignoring our request to pay 2 layovers on the load that had a reefer unit sitbwith the product running continuously because they messed up the appointment. Can we apply the same tactics and hold the shipper liable for those layover charges?

PLEASE HELP. I was dispatched a job under a lease agreement. The person who I was dispatched to work for went MIA. I reached out to the actual broker who was on the BOL and they chose not to help and told me to go after the other party since they have paid them. This was within two weeks after the delivery. Now both party went MIA. I have the Rate Con and signed POD in hand. All emails and conversations along with the lease agreement. What should I do now? I am frustrated and confused. I am in the hole 3k running all 3 loads for this brokers. CO to FL, FL to CO and CO to NC, NC to SC.

I have similar situation that happened to me regarding check calls. Broker deducted $600 over daily missed checked calls without ever warning us. What can I do? I have tried to email but got ignored.

Go after the shipper. You are not BEHOLDEN to the broker. Your job is to pick up and deliver the load in the prescribed time. If the broker wants check calls, then they either need to CALL YOU, or they must furnish you with a tracking app like Macropoint. If you go down that path where you have to call the broker every time they want, then that means they can impose other conditions. What happens if they require you to call them every two hours and you don't? Can they dock your pay? Well, if you signed the ratecon and it says this, then they CAN, right? What about if the ratecon requires you to wear a blue shirt, and you wear a red one? Do you see where I'm coming from? Before you go to the shipper or the broker's customer, let them know your intentions. You would be SURPRISED how quickly they buckle when you threaten them with this. Make sure you have a paper trail.

I have to say that I usually agree with you Ronan, but in this case, I simply can't take your side. I agree the $200 charge for tracking was unfounded, but late deliveries do have huge financial impacts. You are only assuming the broker was not being penalized, but even if they weren't, is it not reasonable to have incentives in place to ensure companies fulfill on their obligations? Even if the broker was not penalized directly on this load, do you not agree their is reputational damage caused by late deliveries? And if so, should they not be compensated for that? I'm sorry to say, but in this case, I feel you leveraged the client against the broker unethically. It's easy to make excuses as to why you don't honor the terms of an agreement after it doesn't work in your favor, but true honor comes from living up to what you agree to when things don't go as you hoped.

You do have a point - but a driver getting sick enough that he/she can't safely drive is not within ET Transport (or the driver's, really) control. Deducting HALF of the agreed rate is beyond excessive, and ET Transport did advise the broker what was going on. ET also delivered the load as quickly as they could. Yes, a penalty to ET may have been appropriate - had the situation been within ET's control (truck breaking down due to poor maintenance, assigning a driver that didn't have the hours left, things like that).

To address a few things. We did not act under the assumption that they weren't penalized, but no documents supporting that they were were presented to us. As stated in the video, had such a thing happened, we would not have taken any further actions. However, also bear in mind that we consulted the shipper directly explaining the situation. If the shipper had let us know that they were financially impacted by our late delivery, we would have also dropped this case. However, no such event occurred. Instead, we were deducted $600 purely by the broker's discretion. The fact of trucking is that things happen. If an accident occurs and causes a massive delay due to traffic and late responders, should the truckers be penalized for late delivery? What about if the trucker was ill? What about breakdowns that can happen at random at times? Things happen, this deduction was not necessary and that is precisely why we went after them.

We have a great reputation working with reputable brokers for 18 years now. We don’t have a problem with Fly by Brokers not using our service. Remember the wold is round, it was just 18 months ago that they were begging for our trucks. It will come back around again. Nobody should tolerate these types of unlawful deductions.
