I've always HATED the "manslaughter" charge for these types of crimes with a burning passion. He brutally beat her to the point her beautiful face was unrecognizable. She had internal bleeding, blood in her lungs, and her teeth in her stomach, he beat her. Blood was all over the apartment, he planned to run, and tried to clean it up. How does this case scream "I didn't mean to kill her"? It's murder in my honest opinion and he should be locked away for life.
@halofornoobs93
@halofornoobs93 11 ай бұрын
You're opinion thankfully doesn't matter regarding the law. Homicides have to meet fairly specific criteria to be ruled as murder. While I think the crime was horrific, there really isn't enough evidence to make murder the charge.

@@halofornoobs93 manslaughter should be reserved for cases like when 2 guys are arguing, maybe pushing each other, one on an impulse grabs a knife, and that one stab turns out fatal. Here there was sustained violence, the physical difference between perpetrator and victim was huge, and we only have the killers word that it was an impulse act. I don't know about Nevada law but in Sweden "voluntary intoxication" is never a mitigating circumstance, essentially if the criminal voluntary used alcohol or drugs he is sentenced as if had commited the same actions sober (though sentences in general are lighter in Sweden so he may or may not have gotten away with 15 or 18 years anyway, with parolle possible after 2/3 of that time, and life sentences are typically not served for life but commuted after 20-25 years). Here usually when the manslaughter label is applied there was at least some provocation or violence from the victim also though well below the threshold for legitimate self defence.

US courts routinely offer plea bargains to criminals to get a guaranteed outcome in effort to avoid a lengthy and costly trial with less predictable outcome. Trials cost a lot of public funds + there is no guarantee of a guilty verdict or longer sentence after trial. In the interest of saving public resources and expediency, they will offer plea bargains to lesser charges. If the person takes the deal, they can get a lower charge and lesser sentence than they might’ve gotten after trial. The courts then get a much faster and less expensive closure, put the person in prison and move on. Jury trials are long and very costly, and there is always the risk of a not guilty verdict with a jury. Plea bargains get a predictable outcome and cost a nothing compared to a trial.

Adrian, thank you for your compassionate coverage of this very sad case. The sentence is an outrage - he is a "gentle" giant that beat a woman to death, and the judge thinks he won't do it again. He takes drugs that cause him to savagely beat someone and he won't do it again?? Is she so sure he'll never take drugs again? And people still support him because he is pretty? What a sick world we live in. Also, I appreciate your underlying the danger of people like Ash who are into "healing", but have no real training and can do real damage to already hurting people. This is the type of man you run away from - usually screaming at the top of your lungs. That line of his, "I've had a lot of women" is one I once heard from a guy during dinner. He said this like it was a good thing and assumed that I would find this to be impressive somehow. He was a neighbor, who I ran into quite often while walking my dog, so when he asked me to dinner I didn't think of it as a date, he was not my type. Up to that point we had had five or ten minute conversations over several months and that was the extent of our contact. The first time that my dog Noah met him on one of our walks, he made it obvious that he did not like this man and Noah liked everybody. He stared at him, stood between us, his entire body was tight and his ears were up the entire time he was around this man. When this behavior continued I started to avoid this guy because Noah's dislike for him was embarrassing, and on top of that Noah was a very tall 125 lbs. black Bouvier, not a breed you mess with. Fast forward a year or so and I found out that this man had shot his brother in law dead and spent ten years in jail for his crime.

It’s not every day you watch a crime documentary and realize you knew the victim, even if only briefly. I am the photographer who took those photos of Herleen, in her Indian garb, in that park during the fall of 2011. When I saw that image at 5:27 mins in, my heart absolutely stopped and sank as my mind reeled to reconcile that I was in fact not dreaming. I only met Herleen the one occasion, but she had this beautiful, serene energy that literally made her glow. A makeup artist from PA that I knew, brought Herleen to New Jersey for this shoot, and when I look at the gallery, my heart breaks knowing now her tragic end. 💔 It it also seethes in the injustice of Ash’s sentence, because out of those 8 years, he will likely do far less and then carry on with his life. It’s an extremely more visceral outcome than say a manslaughter in a drunk driving case. Thank you, Adrian @coffeehousecrime, for covering this case. I am a huge crime documentary viewer, and have followed you for awhile now. Were it not for you, I may have never known what eventually became of Herleen. There is truly sorrow in knowledge.

I like the term “Pretty Privilege” a very apt analogy. Society has this warped perception that beauty = innocence. I have never in 30years of working with human clients, ever, thought of anything more deluded. Beauty has nothing to do with psychopathy. In fact, if people love themselves to an unhealthy level, how can they have love for anyone else? Their ego is consumed by them. Narcissistic Personality Disorder is named after Narcissis for a reason, he fell in love with his own image and no time for anyone else.

20 years is never enough. I had a friend who was murdered (premeditated) and his murderer only got 17 years. The same goes for the guy who murdered my uncle. These scumbags should never see the light of day again - people never see how bad the victims’ families have to suffer for the rest of their lives because of a ‘stupid mistake in judgment.’ But I have seen firsthand - the pain persists long after the murderer gets out of jail, and the family dynamics are completely ruined. Yeah, the murderers may get a second chance at life, but the victims remain forever 6 feet under.

Yeah, I'm guessing between the drugs and the steroids, whatever transpired that night made him snap and he lost control in the worst possible way. The roids could contribute to making your anger more intense, and the mushrooms might've lowered his inhibitions. From his public image, he definitely does not seem like the type to snap angrily or hurt anyone; yet here he did exactly that. Either the dude was a fantastic liar, and his public soft sweet image was all a lie, or the drugs and whatever happened just got to him. Steroids are scary as hell, and I don't even know about the way mushrooms could interact with that and the other stuff he was using. I dunno, it just seems very strange, but the sheer violence of the murder is absolutely shocking and astonishing. Poor sweet Herleeen.

At some point, he either lost control of her or she unmasked him. He must have pretended that things were ok or got her to come to his house where he exacted his revenge on her. He, “ over killed “ her, like, duh, yes that was deliberate. Obviously his psychopathy and charm got him a lesser charge. He’ll only have to do eight years for that. That’s what this show was saying. It makes me furious when people defend someone as "Gentle, kind, and caring" and they "could never see them doing something bad." Killers are not a different being. They are someone's brother, sister, child, father, mother, cousin, best friend, etc. People have different faces for different people in different situations. Every person is capable of heinous crimes in the right (or wrong I guess) circumstances.

I’m dumbfounded by the support of his “fans” who have been spoon fed the image he wanted for them to see. Between the possibility of steroid rage, mental illness and his inability to “love” someone other than himself, he is capable of such an heinous act.

'roid rage came to my mind too when I heard he used steroids. This gives me the feeling that for some reason, Armand flew into an uncontrollable rage that night, perhaps over some small argument, and he completely lost it. The beatings suggest an explosive fury. The injuries sustained were shocking and honestly, I would feel concerned about letting out this guy that it could happen again, seemingly out of nowhere. Just unpredictable.

Having watched the show, he was the guy that I would've felt more safe with which is crazy with all that happened. From what I've read, he was in a long term relationship with another woman and they had just broken up around the same time. I don't necessarily feel bad for him but I do feel bad for his kid that has to grow up without a father

Him being allowed to be released after just 8 years for torturing a woman to death is despicable. The judge had the authority to punish him appropriately & give Herleen’s family some *JUSTICE* but just like so many other judges these days, she chose not to. The justice system doesn’t need anyone or anything to make a mockery of it. It does a damn good job making a mockery of itself. The good old American “justice system” is a thing of the past. We just have a “legal system” now, a shameful system that hands down pathetic sentences like this, to a man who brutally beat a woman until she finally died. Her teeth were found in her stomach, he tortured her!

Adrian I know you’re covering mainly international cases, but there’s a case from Houston TX from the 70s that blows my mind. Dean Corrll was a serial killer who killed almost 40 kids from one neighborhood w/the help of 2 teenage accomplices. It’s one of the most brutal cases I’ve ever read about. Maybe you could cover it in a future vid. For some reason it’s almost forgotten. Your shirt pattern is iconic. Keep it ❤

I just wonder that perhaps she told him she wouldn't pay him rent anymore or something for him to snap like that. It's just super tragic and sad he took advantage of her already and then ended up taking her life in such a gruesome matter. Words fall short on how tragic it is.

Because he showed remorse, they think he can be rehabilitated. Like they say, "The first step to receiving help is admitting you have a problem." Sociopath's and psychopaths blame others and deny they had anything to do with it. Or in Betty Broderick's case (one that comes to mind), she's proud of what she did.

The injuries you described are horrendous, I have not seen injuries that severe even in high speed vehicles accidents. This is a level of rage that I can’t imagine and finding teeth in her stomach is very disturbing. It indicates a prolonged extensive beating far exceeding a level of rage most can maintain We all get angry at times but the rage in him goes far beyond anything I’ve ever heard of. I can’t imagine the fear, pain and extreme suffering the poor woman endure and she was completely helpless! He is a violent, narcissistic psychopath…..a parasite living off the money of women. Hardly my definition of a man. Pathetic and cowardly! No, 20 years is another punch thrown at her and her grieving family, parents never recover from the loss of a child. I find it appalling he is still receiving support from fans, and I disagree that he wouldn’t do it again, what’s that based on? Hope? It’s not worth the risk. 27:01

I trust my 2 kids. And hell sometimes I question them because u gotta be out to get me if u constantly drive me crazy and stress me out. (I’m def jk). But real shit. Gotta watch who u trust. Even the ones closest will screw u over. I stay to myself with very selective few friends literally like 5 total because u just never know. They will paint a good pic and then boom. My dad was a grade school teacher for 30 years and what I learned from him was that sometimes, the kids with the worst backgrounds turned out to be the best people, and the reverse being very much the case as well. He himself was orphaned/abandoned as an infant, was put through the public system without ever being legally adopted and suffering horrific abuse at so-called "fosters'" hands, and was just about the best dad ever. You can't always predict on background alone.
