Galactic crows: the guy who regrets his decision, and is sorry for it. AjbGames: the guy who carelessly handle the situation. The modeler: the guy who didn't regret his actions, and was less sorry for it than he should've been.

Something that gets me about the modelers statement is that they claimed that the teeth were the only things used, when they basically raised the entire model, down to the body and the bow.

Well, I assume the fact I did a mistake, of course without realization, I have never thought it would go that far. Lesson learned, I’ll be more careful with whatever I buy and who I buy from. That’s for sure! If y’all wondering me and AJB are in good terms, and always were during this situation. Thank you for the video! I genuinely cared about all parties involved!

Honey, you violated copyright laws to steal models from a game (which was made by what was still an indie studio at the time), sold it for $150 despite doing very little work with it, risked their integrity and brand for a quick buck, asked to stay anonymous because you KNOW it's wrong and you KNOW no one would ever work with you if they knew, and then have the audacity to try to guilt trip someone covering the subject and pretend like it's no big deal? Jesus Christ.

Hearing you so passionately talk about how much you hate the modelers mentality because you have genuine love for the devs in it is really cool to see. Thank you for this video and thanks to all the people who helped me in this situation , I didn't know that the Model is copyrighted and also Paul ( GalacticCrows ) He didn't know either , we made a mistake and we learnt from it , I will never repeat this mistake , as the new projects I will make everything from scratch to avoid problems like that , thank you so much for the video again ❤

Make sure that if you DO need to get a model from somewhere, you either DIRECTLY commission it (so you know who you're working with and can check if they have a bad reputation and have the option to look around for price estimates, never trust a middle-man, not even if it's from your publisher) or you buy it from a professional marketplace (where it's rare to find stolen content). As an older (amateur) dev who's been working around with various kinds of art for going on 20 years, doing everything yourself isn't always possible. And sometimes doing everything yourself will stop your projects from being released. Best of luck with your game projects going forward!

part of me is morbidly hoping that the modeler will out themself with an angry post of some sort on Twitter. Like, Baddest choosing to keep them anon. and they proceed to out themself with a hissy fit. That would just sort of feel fitting to me... I'm a hobbyist blender modeler and self-taught. I'm self-concious about my models but consider them okay, and they're MUCH better than any clumsily sculpted Garten of BanBan, but I would NEVER charge that much, even for a much more visually appealing model. I think models from professionals who know what they're doing could go for that much or even more, but this wasn't really a case of a professional or an innocent freelancer... I wouldn't care what website it came from, modifying a model rip and selling it for 150$ is very gross in any circumstance, and at least Garten of BanBan made their own models from scratch (albeit poorly).

Extremely appreciative of your points here. People definitely made mistakes, but there's hope for all of them to grow from this if they choose to put in the work. Copyright law and theft are really serious issues, thank goodness someone is looking out for the indie scene. I'm not a game developer, but I am an independent artist, and it is so, so important that we take the time to learn about things like open source and creative commons 0. I'm constantly sharing open source software options for drawing programs with younger folks, because I've been there, sometimes you need something that's free and legal to use to get started. It's really unfortunate when stuff like this happens. earlier in the summer, someone took to twitter with concerns that the cutout model for Bendy and the Dark Revival was actually using stolen fan art, and I have never seen theMeatly be so quick to acknowledge and try to correct something. He was vigilant about clearing the air and making it right, and that spoke volumes. If one of the more well-known devs of the indie space can recognize when they've messed up, then so can more folks. I genuinely hope this modeller gets their act together, it would be a shame for them to carry on this way and tarnish their relationships in the creative world. Here's hoping for a brighter future.

If this situation was brought to court for whatever reason, it would be likely that a lot of this could fall under the innocent infringer defense. The Bokkie dev is the most obvious example of this, i highly doubt any court would charge him. Galactic Crows *could* probably be charged since they are the ones who sold the model and they still have a working relationship with the modeler. But if it was brought to court they could throw him under the bus to save their asses and possibly reduce the money lost. And i highly doubt that defense would work for the modeler. He could try to use that defense due to the misunderstanding, but it's highly likely he would receive at least a partial charge

the modeler and everything he made before and after is definitely something that should be looked into. This does not seem to be a one time thing kind of situation, they would have produced more than one model for other people. Who knows what else he worked on that might have similar copyrighted work? Sure, this might have been a one time thing he did during his free time while he had another bigger job to work on and put barely any work into because it was not his actual job. He did not actually take this whole 'created for a indie game' seriously (have seen this attitude in some modelers). But that is if I give him complete benefit of the doubt. This is not something to just bring to the public, but to past employers

If you're commissioned with actual money to make a model, I still don't think you should be looking for the basis in the first place. That should only be done if there's no formal commission and if the model will not be used in a commercial setting, otherwise too many risks legally

So basically nobody is “innocent” but it’s all basically the “modeler’s” fault (and the guy who put the huggy model on sketch fab to begin with) While the darker muzy being cancelled is fair I’m a bit curious how it would’ve been darker exactly. gore? flesh? corpses? Damn my curiosity

Good lord you work fast. I feel so conflicted with all the people in this situation, Galactic Crows I think is someone who made a real genuine mistake and is probably the most innocent person here. Although I do feel sympathy for AJB games, I am struggling to forgive him for his actions online especially because of how one of these unnecessarily put one of my freinds in the crossfire here (Isaac will know who I mean, I'm sure a lot of people here can guess) but at the same time nothing bad has happened to them because of it yet and they seem to be brushing it off as a joke. This modeller is someone I don't know how I feel about though, they could be a bad person attempting to try and save face but also could just be an idiot who misspoke. Truth be told, this whole thing just made me more interested to see what Galactic Crows and AJB Games make in the future. Even though his actions on twitter were terrible, the fact he was willing to die on this hill for a random mascot horror project makes me believe that he genuinely cares about what he is making. Excellent video btw, I don't really have too much to say about it but just wanted to let you know I enjoyed it.

In the end honestly if that modeler can't understand people on sketchfab lie about what's free and doesn't understand his work's license makes him DIRECTLY RESPONSIBLE for how it's used? He shouldn't be selling anything yet. Creative Commons literally is about control over how your work is used. a CC0 waives all legal rights and sends it to public domain. A CC BY requests use only with credits. A CC NC means your work can't be used in commercial works. A CC SA means that other people can only use your work if they also use the exact same license you used. The BY, NC, and SA tags can be combined to make the rest of the CC licenses. Applying a CC0 doesn't magically make him immune to legal responsibility for character copyright infringement (and might actually violate a previous license if the work he took it from was Share-Alike or Attribution, and meanwhile if it was NonCommercial he violated that license by selling the work).

I agree that exposing wrongdoings in the community is very important, which is why it’s very disappointing that we don’t know who this person is. It’s very much a double edged sword, because if you release the name, your credibility goes down as a journalist, but if you don’t release the name then you’re allowing them to continue doing whatever essentially free from any real accountability.
