In exchange the US is strict about losing your right to cast a vote (not to be voted) at least as far as I know. If you are convicted of a felony, you can loose your right to vote for a very long time (depening on the state). In my country you only loose your right to vote in case of special crimes (manipulation of the election, treason, ...). Robbing a bank wouldn't result in losing your right to vote.

To be clear, I'm a supporter of one of Australia's two major parties. Australia is also a two party system - only Liberals or Labor will ever form government. But the idea of the system being so entrenched that internal party selection matters are a matter of federal electoral law is wild. EDIT: Australia has preferential voting and minority governments are absolutely a feature of our system. Liberals need at least The Nationals to hold government. Labor usually wins in its own right, but might need Greens or Independents. Canada isn't really a multiparty or 3 party system. Sure the NDP have beaten the Liberals, but they will never form government, similar to The Greens in Australia. It's a bit closer than Australia (The Greens have never come close to out-polling Labor, but on the other hand The Nationals have provided Prime Ministers).

The charges in the document indictment are specifically focused on Trump lying to the Feds about returning the documents. There is leeway where Trump can claim error or ignorance for prior mishandling, which worked for Clinton and Biden.

Remember how over the last two years there have been a lot of complaints about how the Justice Department has spent too much time going after the low level foot soldiers from Jan 6 while ignoring the guys at the top who set it up and were directing it? Now we see the government's long game strategy. Lots of the nuance defence arguments that T-p might want to use have already been used and rejected multiple times. I presume at least some of them went through an appeal process so that by now there is a fair amount of case law written by multiple judges from multiple jurisdictions that the current Judge can refer to when making rulings.

The classic example was yelling fire in a crowded theater (from the days curtains were flammable, and they used gas lights for the stage). If you cause a stampede and people get hurt, you are liable. There are plenty of other examples like fraud and defamation. If your speech causes harm, you are not protected.

It's not that. It's simply that one of the narrow exceptions to freedom of speech is the commission of crimes. If I plan a bank robbery, I cannot claim that my planning of a crime is protected under freedom of speech. If I enter the bank and yell "give me the money or I kill you", again that is not protected under freedom of speech. If I talk a bank employee into defrauding the bank, that is not protected under freedom of speech. Etcetera.

Regarding the analogy of the bank robbery, you can take it a step further. *Even if it's true* that your account has (or should have) $5,000 in it, you're not entitled to rob the bank. I like the examples of attempting to hire a hitman to off your spouse. You don't need the act of your spouse being offed to actually have happen to be guilty of soliciting the act to happen. Or the example of planning, with others to rob a bank. Even if you aren't robbing the bank in person or the get-away driver, the act of "being in on the plot" is criminally punishable.

My high school US government textbook had, as its introduction, a short description of an election campaign between two (made-up) candidates. It concluded the summary with something to the effect of "at about two hours after the polls closed, [Candidate B] called [Candidate A] to formally congratulate him on the victory." And then noted that this was something unusual in the world that we take for granted in America: despite much talk by B during the campaign that the election of A would be a disaster, B never considered gathering his supporters to instate him anyway, establishing his own government elsewhere, or any number of other events that have happened in less stable democracies. B accepted that he had lost fairly and submitted to the will of the voters. We are no longer in that America. However, we can still be in the America that, if a candidate DOES try one of those things, he will neither succeed nor be given the opportunity to try again.

She dealt with him in an earlier case. When the House Judiciary Committee was holding its hearings last year they subpoenaed some documents and trump tried to withhold them. The matter ended up in front of this judge, and in her ruling she said, "we have presidents, not kings, and Mr. trump is no longer president." And then she ordered him to hand over the documents. Those same documents ended up in the hands of Jack Smith.

The problem is the question isn't "did he do that," as we all know he did. The question is "is what he did okay," and a frightening portion of Americans believe it was, that the end - Trump remaining in power despite attempts of a "deep state" to undermine him - justified the means. To them it's like a situation where someone killed someone else in broad daylight with many witnesses and security camera footage, but the defendant claims it was justified self-defense - not a question of what happened, but why and if it was for the right reasons.

Russia is quite literally one of the worst countries you could live in right now. In hindsight, that scene from Home Alone 2 is comically inaccurate. We all now know that 45 would, in reality, have shoved the little kid the hell out of his way, acused him to rigging an election, sued him for slander, doxed him and his entire family, and all the while tweeting mean names at him like a little 6th grader bully.

Now I hate Trump, but when I saw that interview I am pretty sure she just meant: "Everybody was told by some of their advisers, that Trump lost the election". So yes, Trump was told by many that he lost the election, but that does not mean he believed it. She just said it incorrectly, so I don't think it will have a significance in court.

Yep. That's why he was furious at being driven back to the WH, and what he was sitting in the dining room, watching TV for the signal to go. While Pence was desperately calling everyone he could think might give him the slightest excuse to do as Trump wanted - he is no hero, and was well ensconced in the conspiracy, just turned tail at the end.

If your bank does something weird with your account and deprives you of a lot of money, you are entitled to take them to court and use a number of different legal means to recover your funds. However you are not entitled to go into the bank with a firearm and rob it, even if you can prove it’s your money.

Exactly. People saying Trump had every right to challenge the election results seem to be forgetting that he DID and there were numerous court cases around the country looking into possible elections fraud. Once those cases came back saying the results were fine, the question should have been dropped. My local election had to have a recount and it literally came down to like three votes difference, but afterwards we all moved on. The problem here is the conspiracy to refuse to accept the results and as you put it "take what's his by force".

A few years ago, republicans figured out that shouting "free speech!" whenever someone called them out on their lies/racism/bigotry was a pretty effective defense and went down well with their base since it also plays into their victim mentality. So this is pretty on-brand. It doesn't matter that it makes no sense to those who actually understand what free speech means. Besides, it's not like their using the "argument" of free speech in good faith anyway, these are people who will do and say anything to get their way.

I think Trump needs to be found guilty. But with that said, your example is not quite accurate. You are using a confession of guilt to another crime here, its not like Trump is publicly saying that he is guilty of all the crimes he has been indicted for. Their angle is that he was simply saying that there was fraud, he won, yada yada yada. Thats where the free speech comes from, but there was absolutely a deeper conspiracy involved than simply him saying he was robbed of the election or whatever, he actively conspired with other people to try and actually overturn the election. THAT is the part that his supporters are ignoring and just focusing on the "free speech" side of it.

Same deal with why lockpicks can sometimes be considered "burglary tools" and sometimes they aren't. I always carry lockpicks with me at all times, and they are never burglary tools since they are never used to commit a crime. The only time I use them is to pick locks with the owner's express consent to pop a lock they either lost the key to, or simply can't open, generally with them looking over my shoulder the whole time trying to discover my secrets. (No secrets sucka, it's all in the wrist.)

This idea has been brought up before in a video mentioning the first amendment here on this channel. What are you allowed to say, and does that language ever cross a threshold where it’s not protected speech anymore? The classic anecdote has always been shouting fire in a crowded theater, which would probably be covered as free speech and allowed for a variety of reasons. The deal is it’s impossible to cover every scenario, and some carry vastly different amounts of weight. It’s an extremely frustrating situation to be in. There has to be a line, but it’s impossible to cleanly draw one.

This is great, thanks. Subscribed, will be looking for more.I worked in law for 14 years, but all in civil cases, not criminal. This is most helpful - clearly explained. Smith's approach is also likely to be easier for the jury to grasp, rather than a confused ball of yarn they have to unravel.

In time, I'd love to hear how much of Jack Smith's approach here is based on his time prosecuting war criminals. You'd have to think that they may also be somewhat contentious in regards to verdicts so I suspect he also framed the charges in the way that was simplest to prove.
