Being one of the five doesn't need you to die. Vampires do and hybrids. Witches probably won't die too and just be human again too. Like Matt he died many times but he had his ring but he's just human at the end. Jeremy being in Mystic Falls isn't a plot hole. At least this is how I saw it.

Elena not getting her memories back because of that, not gonna lie did annoy me though, but I'd say it's more what she gets for hesitating too long (I still get that it might take some time to realize it in that situation she's in).
