3:38 yes, there is a procedure for an advocate to surrender their license in the event of misconduct: Disciplinary committee If a State Bar Council believes an advocate has been guilty(convict) of misconduct, they will refer the case to their disciplinary committee. Possible punishments The disciplinary committee can: Dismiss the complaint Reprimand the advocate Suspend the advocate from practice Remove the advocate's name from the State roll of advocates Surrendering license An advocate may also surrender their license. For example, in one case, the advocate surrendered their license in 2016 and stated that they would not resume practicing law in the future. 3:38 - No, an advocate is not a servant, but rather an officer of the court with rights and responsibilities. Advocates are not considered public servants under the strict definition of Section 21 of the Indian Penal Code (IPC). Here are some other facts about advocates: Advocates are not allowed to be full-time salaried employees of any person, government, firm, corporation, or concern while they are practicing. Advocates have a duty to ensure the smooth functioning of the court. ****Advocates have duties to their clients, including accepting briefs, not withdrawing from service, and making full disclosure to the client. **** Advocate can't miss behave at cost ...

On the line of this argument no advocate should take cases of clients who have done wrong! On this lines of argument kasab should have had no representation On this line of arguments, advocate should not take fees or return his fees back to the litigant. Biggest question is "What do you do when the advocate is actually wrong?" What should a litigant do when the advocate on record does not do his job correctly
