The plaintiffs say the defendant hired them to work on tiny houses built for veterans. They claim the defendant stiffed them on their pay, so they’re suing. The defendant says she’s the director of a nonprofit, and one of the plaintiffs was bizarre and aggressive about how they got paid, so she no longer wanted him to work on the home.

To be fare most licensed contractors receive a large deposit before the job starts to hold your spot and then receive the remainder upon completion

I find it ironic that the reason he gave for not being licensed is that he had to wait for the process to complete and expects that to be fine with the defendants. Then, when the defendants have their own process that governs the payment, the plaintiffs demand it immediately and to bypass it.

He passed the test and he knew he had to wait until hearing back to be fully licensed. Then, he ups and demands full payment before the job is completed? They wouldn't be here if he had waited.

It's so unfair a person can do"handyman work" but expand what that means and do so much more, and contractors like me lose customers to them. If it's ok. Then why aren't there "handy law people" or handy medical people" who just feel like " I'm just bandaging and sowing!" I'm hourly rate is challenge do people who will happily work for $100 a day. They shouldn't get a penny.. They should be fined highly. Plus I have to pay $ 350 a month for liability insurance. And pay guys workers comp at &.35 on every dollar I pay out

As a former contractor it sounds as though they were hired as laborers, not a general contractor. The defendant knew they weren’t general contractors and if that’s how she treats people I’m not surprised they can’t find a GC. Sounds like a great organization though.

My husband was licensed and insured to do jobs up to $30,000 and he didn't have to take a test to be a General Contractor. In NC , in early mid 2000's not sure if changed since 2010, there were 3 levels. In level 1 you could build up to $100,000 level 2 up to $250,000, 3rd level was unlimited license. I know u had to have $17,000, $50,000 and $100,000 in bank when got license and had periodic checks to assure that amt is in bank cash accessible when you renew yearly.

There is a huge misnomer that "Not for Profit" or "Non-profit" means the people don't make a profit. All a "Non-profit" status is an IRS classification. If your business is deemed to be "for the public good" you can get "Non-profit" status. The IRS has a list of approved businesses but will take applications for any business. For example, if you decided that squirrels in the park needed more nuts and you wanted to go into business to raise the money and have feeders installed in there, you would probably qualify for "Non-profit" status. Don't get me wrong, I think what these people are doing is really nice and more importantly, it's needed. But a lot of non-profits act really high and mighty where in actuality they are raking in huge profits and paying no taxes.

Agreed entirely. It’s hard to determine from the outside how much employees of a nonprofit should be paid, but when they might be making 6figures and stiffing a couple of veterans for their hard labor, it really begs the question whether they’re serving veterans or serving themselves.

Not all service people get PTSD, only those in combat, and these two plaintiffs do not have it, but the conning people fever.

I absolutely agree. Many of them receive nothing but a hard time. There are so many new class action lawsuits regarding military soldiers contracting all types of incurable diseases it's horrific from contaminated water, exposure to chemicals etc etc. It's downright disgusting how poorly they're treated when they return home.

@@KyTy-yb3vl They're the kind of containers they use at construction sites to be used as offices for the foremen. They're often smaller than trailer park homes, which are built as homes. These things were build to transport meat products, and now we're forcing our vets to live in them...

And because he wasn't licensed the wiring and some other work will need to be redone, and everything will need to be closely inspected and possibly done over. You can't do electrical work without a license.

Did you build them in Pinellas County? Each county has their own rules. Were you the homeowner or were you building for someone unrelated to you? Homeowners can usually do their own work.

I’ve been an avid fan and watched since Peoples Court since inception. Judge Wapner, Rusty, Doug and Harvey were integral then and now. I love Judge Millian and her trust bailiff and friend Douglas. I was elated when Doug Lewellen returned.

He’s right about that licensing process in Florida. When I tested for my insurance licenses those contractors would be in there stressed out with humongous folders.

Why doesn’t a person who passed the exams, paid whatever needed to be paid and filled in all of the necessary documents get the license that he now arguably has a legal right to within a decent amount of time OR (if that for some reason is a time consuming process) get a TEMPORARY license for this ‘in-between-time’?? When somebody has invested time, effort, money into obtaining a license, it is only JUSTIFIED that he gets to profit from his investments once he has done all he is required to do!

When I got my Realtor license in Florida, there was a long delay in taking the state's qualification exam in Orlando. But I didn't sell any houses before I got my license.

The judge is absolutely right. I lived in Pinellas County Florida for 6 years. It's extremely hard to become a licensed contractor. They actually do police stings all the time to round up unlicensed contractors because there are a ton out there that don't want to go through the process of actually getting their license.

Plaintiffs made an error in judgement (doing work before the license was approved) but the non-profit made a moral error. Seems clear that once they realized the plaintiffs weren't licensed, they cut a third off the top of what they'd agreed to pay and told them to take it and be happy about it. I'd love to see what those three NP directors were making in salary (non-profit means the company makes no profit, not that employees/staff don't make profit). Ironic that a NP based on helping vets looked to cut corners by taking advantage of vets.

My husband is a Pinellas County contractor. He does tile and marble work on floors, backsplash, and bathrooms mainly. He just found out as of July 1, 2024, he no longer needs his contractors license to do flooring, but anything else like plumbing and electrical does in fact need to be done by a licensed contractor in Pinellas.

Yeah, these guys got screwed. Was the judge having a bad day? Why was she so hostile towards these guys right from the start? Her tone and body language said it all. The case wasn’t even about a contractor license but about payment. The defendant knew they not yet licensed but hired them anyway. Compromise is a valuable tool any good judge uses in cases like this but the judge had some sort of agenda. Shame on her.

Containers are not that small, I've lived in campers that are smaller. I've actually been thinking about looking into one of the container homes.

Even though he’s not licensed I would still pay him for the work he did. If I asked someone to help me move and they do the work and then I back out of paying that’s so unfair.

Why didn't she dismiss without prejudice and allow them to re-file when his License came through. The charity is exploitative and should do the right thing and if the work is to code - they should be paid. I'm sure some licensed Vet somewhere would survey the completed works pro-bono and facilitate a win-win outcome for this case.

@@miriamkivlehan3498 The issue remains that he still has no license whether he passed the exam or not. For example, in my state when someone passes the test for their concealed carry permit, they aren't able to lawfully carry until the permit has been issued.

A handyman can do the work without a license since there is nothing structural. They are making a bigger deal about the license than it really is. I am a license contractor.

How long can you wait to get paid for work you have completed? These guys performed a service and should have been paid. It was on the "director" to make sure the paperwork was in order and she didn't do that. Her "board" should be concerned about that as well.

Interesting. I’ve seen her ask both parties if they knew the contractor was unlicensed and when both say yes, she awards the unlicensed contractor money for work done. She said you can’t cry about the license afterwards just because you’re upset. So is this different because the defendant thought he had his license??

You can do work in your own home. You cannot represent yourself as being a licensed professional contractor working on someone else’s property. Two very different things.

I feel for the plaintiffs but they gambled. They knew if they were not licensed and doing work for something like this they might notget paid because of certain rules you have to have in place. If this was under the table sort of thing fine...but for a non-profit...rules have to be followed.

Just because he did his part. He still hasn't got his license in his hands. So in the real world he's not a licensed contractor. It's a shame veterans fight for our country to come back injured. And all they're offered is a tiny home 300 hundred and something square feet. And made out of freezers. I think it's sad. God bless everyone of you that fought for America. IN MY VIEW Both sides were wrong. The woman stiffing the workers from paying them for the work they did. She hired two men WITHOUT contractor licenses. The guy who wants to be a contractor wants to make his own indepentant contractor rules BEFORE he is licensed.

Just the way she acted at the end & her response to Doug told me she didn’t intend to pay them from get go! Do the right thing lady you & your board need to pay those gentlemen! I just wonder what really happened with the first guy they brought in to to the job. Karma is a biatch!

Nah…that’s the life of a contractor, especially the handyman variety. Work all week, drink your paycheck over the weekend, repeat. My ex was a contractor, and many of our employees lived in hotel rooms they rented by the week. It can be a very transient lifestyle and they panic if there’s no paycheck on Friday.

He should have waited for his license to come in the mail. The date on the license would let him know if he can then sue for non payment. He has 3 years to sue.

Y don't u respect Judge Milian ... She did say she'd like them to be paid but Florida law prohibits an unlicensed contractor being paid.. She stated therefore her hands were tied.. But she gave them all she could..$s for shopping. Impatience has it consequences the plaintiff should haf waited out the tedious process til he had his license then he could haf worked for the NFP Organisation and gotten paid...

In my state if you apply and do the test, you can do the work until the state gives you the printed license because the state recognizes that their system is slow

What people need to understand that if a non license contractor does a job in your home an it needs inspected the state will force you to remove all the work an fail the inspection. Plus liability is at play here on the work they do. Do your homework don't go by word of the mouth. They have to show you there documents an you can look them up if they are legit. Any person refuses please kick the to the curb.
