Heh.. well, if you look at other parts of appeal document, you will see that a lot of items are most appropriate to be pre-trial motions. And those pre-trial motions were submitted and declined. And that is not really unexpected tactics: they throw a bunch of poop at wall in case anything sticks. Bigger the appeal(even if majority is expected failure), higher chance something beneficial happens. Just because appeal court is also human beings.

I've been a juror several times. The lawyers on both sides question each juror from the beginning to see if they are a good fit for their side in the trial. If the lawyers don't like one answer from the prospective juror then that juror is released for another 2 years. So these lawyers in this trial had their opportunity to dismiss!

2 persons at the same address with the same name; those persons assumed the younger person was being asked to serve. It should have been picked up in the attorney questionaire session. Attorneys are responsible for any discrepancies as to why they cannot be a prospective juror; apparently that's Virginia law. Grasping at straws I think, and publicity. Edit: A responding prospective juror has no knowledge of the trial assignment; there is no responding Depp/Heard juror bias.

Or clerical error. Like if the cleric in the court house entered the guy's date of birth and they missed that they entered the wrong year. Either way, unless they are accusing him of impersonating someone with malicious intent to change the outcome of the trial (better have proof of that or you might find yourself disbarred as a lawyer) it's going nowhere since if it was no fault of the juror and they are eligible to serve on the jury. You had your chance to screen them and they are pretty much like any other random citizen that were selected as a possible juror.

So like example: William B Smith (Jr. dob 3-5- 75) came in as juror instead of William B Smith (Sr dob 1-12-45 ). Im guessing is what they are saying. But Everyone should have comfirmed this info prior to the trial. The attys had how long? to check this out? The clerks office should have caught this during the day of picking jurors but i doubt it gets her a new trial.

When the stenographer was being harassed, they mentioned that the jurors had stand ins, most of the jury had fallen asleep due to Amber's prolonged testimonies, and the stenographer said the only juror to actually react to details was a stand in aka replacement Whether juror 15 is the same person is up for debate, that's what the stenographer said about the main jurors

​@@Bustuhh The one that was extremely attentive and taking a lot of notes was actually a younger guy according to Runkle the Bailey, Canadian Lawyer who does KZbin videos like BlackBeltBarrister. He actually went to the court house during the trial to get a feel of the jury. Since he was wondering if the lawyers on LegalBytes stream of the trial, which he was one of the regular ones on it, were reading the flow of the case right. Juror 15 is either the older white guy who seemed annoyed to be there (and wouldn't that be ironic if they wanted his father instead) or the Asian guy who he had a hard time pinning the age down on because Asians age extremely well making it hard to read and he was wearing a Covid mask. Also all the jury were attentive with the start of each new witness. But tended to drift off one by one as they dismissed the testimony of those witnesses as BS or pointless. Except when it was recorded testimony the jury had trouble staying engaged unless something caught their attention. Like when Heard's acting coach said Heard had trouble actually crying when acting.

This motion is interesting only in the fact that AH's team filed a motion to seal the jury demographic information (for a year) so no one from the news could reach out and question their position on the trial. Yet, Elaine immediately blames the Judge, Jury, and social media for the loss on national tv following the trial. Now they are targeting Juror 15 and no one can get their side of the story without that Juror outing themselves and opening the door for hate and targeted vitriol. I could be wrong but this seems like a plan set on the backburner in case they lost the trial. Elaine had every opportunity to object to this juror but failed to do so.

I was recently on jury duty and we had to show a valid ID, we were questioned by both side’s attorneys, and they took our photo for our badges. Both sides had to agree on a jury. If #15 looked younger than stated age why wasn’t it addressed on day one of the trial?

Just on another note I went through hell on my divorce and after 18 years together all I received was £1,500. My children and I lost our house and we were placed in bed and breakfast. Yet evidence showed my husband had money he had a house in the UK a house in Lanzarote and a house in the Bahamas. However because I had no money I could not take him back to court as legal aid refused. However I wanted the marriage over because my ex was violent and I could not stand to see him anymore. So I walked away with nothing. I brought my children up on my own (they were 4 & 6 at the time. I went back to nursing and did my degree. I was given a council flat which I was able to buy I decorated saved up for furnishings and landscaped my garden. That was 34 years ago. My eldest is now 40 and I am 68 but unfortunately I had a accident and fractured my spine so had to retire from nursing at 58. I am registered disabled and have to pay people to do things for me now. Yet I was happy because I got of a way from violent marriage. I could not face finding another man so have been in my own but I have my daughters and grandchildren and they make me very happy. So if Depp was suppose to be that violent to her why does she keep wanting to go over things again.

Sue, I happen to know a guy aged 40 who fits your situation perfectly. And I see the pain it brought him. Identical to yours, scarily - his Mum did nursing, and had to quit due to a spine situation caused by the abusive husband shoving her downstairs. The guy loves his Mum but he loathes, what his biological male parent did. So I feel for you as I see the reality of what you say in him. Additionally, I come from an abusive background myself where female beating and other acts I can't post on KZbin took place almost nightly. I know my own scars sometimes remain. It's hard. All that said, my friend is the same as you - stay away from the scumbag. Amber doesn't, she instead chases after him. That doesn't sound like any abused person I know. In Amber's defense, she might just be similar to you. Having had a bad relationship and wanting to explain it to others to explain her feelings on the subject. And since she did have some money she could take it to court. But the court case seem to imply that she is just a liar, since her body language like "Crying and telling a sob story, and then stop crying and look at the jury" seem very unnatural.

Blond hair, blue eyes, very pretty, ensuring nothing negative came out about her because she was not willing to surrender the information that the Depp team wanted, and then said that she would give all the divorce money to charity. He dismissed evidence from others that she lied. Misguided, and what in hindsight, with more information would not have believed her. Remember the case was against the newspaper, who she also lied to.

Yes. When receiving a summons for jury duty, you have no idea what case you could possibly be chosen for. Then, you have to go through voir dire, which is when both sides ask questions and each side can accept or decline a juror. Most high profile cases have experts for this process, and still have no idea what case you may or may not be chosen to serve. Most people hope they're NOT chosen, not wanting to miss work.

@@Tinmann_77 That's true for PEREMPTORY challenges which are limited to 3 strikes. Challenges for cause however, which I'm pretty sure would include the issue of birthday, are unlimited. In any event, they could have questioned him! No one did!

@@itzims5248 their lawsuit includes a footnote that they know Virginia law doesn't care about clerical errors. Which I understand to mean they would have to use one of their challenges to kick the person for a cleric error. Each court system is slightly different. I was called for jury duty several times in CA but was always in the batch that got dismissed at the last minute. I'm in AZ now, and the last time I got called for jury duty the judge did her thing and let people go because it would be a burden and it whittled us down to about 30. Then the lawyers got to ask their questions (voir dire I guess) and afterwards they each got to pick 6 to kick. Surprisingly it was the plaintiff that kicked me, even though while I was presenting my reasoning to the judge why it would be a burden for me I gave her my reasoning why I didn't think I would be unbiased and would probably find for the plantiff. The defendant didn't care that I had issues with their business because of my job, or that the plantiff was friends with my coworkers, or that my grandmother had died from a similar falling injury 3 months earlier. But the plantiff used one of their 6 (yup judge gave them each 6) vetos. So, I guess I'm saying that different states have different jury selection processes so AH might have been limited in how they could remove people.

The time to make objections was during voir dire (from the French term "to speak the truth," when AH's were free to questioned jurors suitability or reject him. Holding back this concern as a get out of jail card is a poor trick. God knows how much money they spent on jury consultants.

They didn't find his demographic objectionable so didn't want to waste one of their objects to have him removed from the pool and potentially leave in someone they felt was a bigger risk. The fact they knew to go back and pull out a birthrate discrepancy from a week or two before the trial (over 9 weeks before they filed this thing) shows they already had it noted as a possible "oh shit" objection.

@@Tinmann_77 That shows just how bad AH's lawyers are; if they were any good at all, they would have known that it wasn't an issue unless they raised it pre-trial. This is the text of the Virginia law code. Code 8.01-353: "Such copy of the jury panel shall show the name, age, address, occupation and employer of each person on the panel. Any error in the information shown on such copy of the jury panel shall not be grounds for a mistrial or assignable as error on appeal, and the parties in the case shall be responsible for verifying the accuracy of such information."

Heard is looking for any excuse to request a retrial, as that is the only way she can overturn the court's judgement. And it only costs $500 dollars plus her lawyer's cost to submit that appeal.

Code 8.01-353: "Such copy of the jury panel shall show the name, age, address, occupation and employer of each person on the panel. Any error in the information shown on such copy of the jury panel shall not be grounds for a mistrial or assignable as error on appeal, and the parties in the case shall be responsible for verifying the accuracy of such information."

He is a registered voter and lives in the area, which makes him eligible as a juror. Her team made it sound like he wasn’t even eligible to serve and did it illegally. Plus, as BBB said, her lawyers acknowledged in the motion that the VA code says any errors on the info on the jury panel is not grounds for mistrial. Lol

EB filed an extra part to her motion earlier today whereby she stated in a footnote that its for the court clerk to verify the identities of the jurors and not the lawyers, completely trying to get whoever reads the motion to forget the admission she previously made about lawyers raising objections to jurors during the voir dire (sorry if I've misspelled that) process.

as long as the oath stands that the juror took when sitting for the jury I doubt there is any wiggle room for this. Jury selection is at best a tool to randomly select a party of the jurisdiction for potential seating on a jury, the formal questioning at the courthouse, and swearing in are the only things I would guess matter to the validity of the juror.

My half brother and his estranged father have similar names (he’s not a junior, or the second, their first and last names are the same but not their middle names). My half brother is 53 and his father is 74… my half brother has even had his bank account attached for mistaken identity before, because of his father. His credit report has even been wrong- as long as you provide your identity you’re fine, and things are corrected. I believe they could have actually served the wrong person for jury duty, but the juror did show up, was ID’d as a citizen and eligible and all that, they substantiated their identity and then followed through procedures, so I too do not think this argument from the Heard camp holds water. The same legal US and Virginia citizen sat through the whole process, so I don’t think they can call into question the process.

Even if you come at this from a perspective of logic, rather than the law, it's plain to see that the very reason for having a jury is that, when chosen at random, jurors are essentially interchangeable and the result would always be the same regardless of the individuals comprising the jury. So...even if they win on the point that the wrong juror sat, they would still have to prove bias or a breach of the jury rules in order to actually get anywhere. You have to sort of wonder if AH's legal team have any understanding of the law at all; they've always seemed to prefer to argue innuendo rather than actual legal points at every step.

I thought jurors were put through a selection process in the USA. Surely any problem with jurors should have been put forward at that point? I get the feeling AH will try anything to keep herself in the headlines, even to the point of destroying herself in the process.

Yes there is a selection process, lawyers get a list of potential jurors they get to go through the list and ask them questions, 2-3 and then object if they feel the potential juror is not one they want on the jury. They have plenty of time during that process to say they did not want that potential juror, they didn't.

AH's team put forward a motion to seal the juror's identities whch confused us at the time, the more that is coming out about this juror 15 the more that motion starts to make sense. The team made the motion before the verdict, they were really sitting on this and didn't want anyone to fact check this. Also an article on deadline said that ths had thrown the verdict into "chaos" when in actual fact the court hasn't commented or even entered the motion into public record as far as I know so where/who are they getting their information from? Ms. Amber "I don't know how to leak" Heard or one of her camp, perhaps?

In the state of Virginia, once you hit 70 years old you are no longer required to sit on a jury if summoned. You can be excused on age grounds. The person who was sent a summons is 77 and the one who showed up is 52. This is most likely a father/son (Sr/Jr) situation as they had the same name and lived at the same address. When the summons arrived in the mail they probably assumed it was for the son since it would have been sent with the same name on it. It is quite possible that they thought “excused” equaled “exempt” and that there was no way the father would receive a summons at his age. When arriving at the court the son would have to provide the summons and his ID. The ID would match the name and address on the summons. This filing only proves on of two this. 1.) They were too stupid to be able to tell the difference between someone who is 52 and someone who is 25 years older. They claim it was obvious this juror was decades too young to be the person who was summoned. If that was the case, why didn’t they realize it when questioning him when picking the jurors? They must be stupid. 2.). They did realize that this wasn’t the right person and said nothing, basically lying by omission to the court. So which is it? Are they stupid or liars?

It seems to me that once jury selection was complete, with or without errors, the selection process is no longer subject to scrutiny sans evidence of some nefarious action. The juror in question then met their obligation to the court and so due process is provided. The defense's failure notice and act on the error prior to the opening of the case is their own responsibility. Presuming good faith of on the part of the jurors, their specific identities do not bear on the facts, arguments, or judicial actions of the case proper. That's my two cents. One question though: supposing a mistrial is granted, is it comprehensive in that the $2M judgement against Depp would also be dismissed? If they were to begin from scratch, and new evidence is permitted, I think that award/judgement could be beaten. But that, for me, is recreational. As to what I think is best legal practice, the case is closed and the judgements have been published. Everyone pay up and move on.
