I think, and actually you can just Google this, the smell of weed alone generally isn't enough to be used as probable cause. And actually it has been misused as an excuse for illegal searches. I had friends that had $1000s in cameras, wallets, etc in their car, went to get a cup of coffee and in less than 5 min their stuff was stolen in San Francisco. They had tracking chips in their bag and was calling the police to not only make a report but to tell them exactly where their stuff was. The police TOTALLY IGNORED them for 2 weeks. Then 3 weeks later an "investigator" called to "investigate" the crime. By that time, the tracking devices had lost their power and were not producing the signal. The "investigator" said "Be glad it was only your stuff! Its not like someone was killed or anything." They reminded the law enforcer that they work in theft not homicide but to no avail.
