Doesn’t Pennsylvania v Mimms also say that the cops have to have a reasonable belief that you are a danger to them? This case law is abused by every department in the country. It is also the only case law cops know!

What "legal documentation" did the driver present that "proved he had the right to drive the vehicle"? In my State driving with no plate will get you pulled over. I don't know that this is really a "fishing" exercise... more just a cop doing his job.

Supreme court ruled that asking to get out of the car during a stop is supposed to be when there's a reasonable suspicion that the occupants may pose a danger. Not just because!! Not for their ego, them being jerks, don't like being asked questions, people asserting their rights, etc. I wish people would stop saying they ruled cops can ask anyone to get out of the car. As soon as a cop says get out, immediately ask if they think you pose a danger to them. Officer safety is what the supreme court said. 🤦‍♀️

No, sorry wish that were true, but Penn vs Mimms say you have to get out period, unfortunately they need no reason whatsoever. They do need a reasonable suspicion you're carrying a weapon to do a Terry frisk. Terry vs Ohio

Julia, the actual ruling says the officer can order you out "for officer safety". Which is undefined, and can really be anything. And a cop does not need to articulate the reason they are ordering you out.

The address on the documents for the vehicle matched the address on this gentleman's license. So, by the officer's logic: this man stole a vehicle from his own residence...🤦‍♂️

Pennsylvania v Mimms still says the officer must reasonably believe the driver is a possible threat to remove you from the vehicle. Everyone glosses over that.

If it's stolen, it will show as stolen when he checks as long as it is reported stolen. If it's stolen and not yet reported, the cop will have no way of knowing. Period.

That's in direct opposition to the doctrine of "innocent until proven guilty." With no evidence that the car is stolen, and no probable cause to arrest him for a stolen car, he's insisting that he prove that it's NOT stolen.

That's harder than you believe!! Like maddog said, the will hold the door open while another officer, volunteeringtellingmakingyoumove, makes it hard to lock. Besides when they handcuff you they may call a well trained BLG K-9 that will make the whole principle sometimes great for US!!! Agreed, if possible lock and close your door!!! Hell if you have a backup key, throw them in the bushes!!! Don't help them set you up because of ego!!

Refuse to exit until they give you space to do so, if you choose to exit. If they refuse to give you space, leave your doors locked and windows up until they do. You neither want them in control of your property nor do you want them to fabricate an assault or battery charge by standing in front of your door while it bumps them.

I think this driver should have used his right to silence a bit more. Just provide the paperwork and then "my lawyer has advised me to use my fifth amendment rights, I don't answer questions, I don't consent to searches or seizures"

We were recently on vacation and my husband got pulled over for speeding. He was driving my car. The cop didn't bat an eyelash. he didn't even ask me if I was the registered owner because he's not on my registration it is my registration alone. I don't know why cops decide to hassle drivers for something as stupid as the name on the registration not matching the name on the driver's license this guy just wanted to be a problem the cop not the driver

Then more clarification needs to be written down and enforced. At this point, if a cop asks you to get out of the car for zero reason and you don't, then they arrest you, and the charge holds up. If you want to be a martyr, go ahead, but at this point 99 times out of 100 you will be arrested and convicted if you don't get out

@@kevinzink9063 right, just keep it simple. Record, follow commands, remain silent, fight it in court, and file a lawsuit. If people could just do that when shit goes left, we'd get some change. It would be harder for police to talk it away in the media if in every lawsuit there was absolutely no defense for the polices actions. No "they resisted" "they ignored commands" "they obstructed", it would just be police illegally arresting or citing someone demonstrating their lack of knowledge. And I'm not defending police, the decks just stacked against us, so why make it easier for them to make excuses?

Get out of the car with confidence. There is nothing you have to do AT ALL outside the car. Don't argue, don't (generally) answer questions, don't try to teach the law. Just step out and stand there, ask if you are being detained, state that you invoke all of your rights and waive none, then be silent.

Why does it usually take about 13 to 19 weeks on average but can last up to six months to become a slave patroller but it takes 2 YEARS to become a barber and about 8 to 10 years to become a lawyer or judge? I'm convinced that you don't need a IQ above 7 to be a slave patroller.

Fund the police. Fund a National databases tracking harassment, brutality and murders by police. Make this data available to the public. Then terminate their police certification permanently. Bad police get paid, paid administrative leave, keep their jobs and we in the community just have to deal with it.

Keep it very simple like this: Keep all doors locked. Windows up. Have Drivers side down just enough to pass license, registration and insurance back an forth. Keep quite. Say absolutely nothing. Video everything. "If" ordered out of the car, remove keys (Keep them in your hand and do not hand them over under ANY circumstance) Step out, close door and lock it behind you. (Slam it shut if they are hanging onto it) Refuse the roadside "field sobriety tests" (AKA, "Stupid Human Tricks") Demand a blood draw with your Attorney present instead. Invoke your Fifth and Fourth Amendment Rights. Keep reminding them that you do not submit to any search's, and they cannot continue to question you with out your Attorney present. Put that on repeat EVERYTIME they ask you a question. (Because these morons will.) Don't talk about where you are coming from, what you are doing, going "fishing" who you work for etc. Keep your yap shut!

If the cops had anything on him, they would have arrested him. Give them your paperwork that's required by law and tell them your invoking your 5th amendment right and you won't say answer any questions without a lawyer. Then shut up!! Don't argue, don't help their fishing expedition into other charges. They are going to do what they are going to do. If they arrest you, then you can sue them for violating your rights.

Penn v Mimms states, The Pennsylvania v. Mimms case brief is that the U.S. Supreme Court ruled that a police officer ordering someone out of their vehicle and conducting a pat-down to check for weapons after a traffic stop does not violate an individual's Fourth Amendment." Which means that the cop has to believe that you're ARMED AND DANGEROUS for them to order you out of your car. They can't just order you out of your car for any reason they want to.

Unfortunately drivers and passengers had to exit the vehicle upon police demand however the extractions are often used to violate rights such as illegal or coercive searches and forcing passengers to ID.

@@555Trout its not a law. Supreme court has ruled that an order to get out of the car is a very minimal intrusion to the right of privacy and the benefits far outweigh the negatives. Pennsylvania v Mimms. It really is a minor intrusion.

Lets wake up people you dont have to register your car. Your registration says "vehicle use: commercial." Vehile code states a commercial vehicle is a motor vehicle of a type required to be registered under this code used or maintained for the transportation of persons for hire, compensation, or profit or designed, used, or maintained primarily for the transportation of property. Thats why youre coerced to pay tags every year & why cops have jurisdiction for tickets.
