If they demand it, that is unlawful and inadmissible in court. If he hands it over willingly and with consent, that is a lawful search. Tricking him into agreeing to do something that he is not legally required to do is underhanded and despicable, regardless of what he's done. He has rights and is innocent until proven guilty, not the other way around

No they can’t. It’d be thrown out in a second with a mediocre lawyer. You can’t detain a person unless he’s committed a crime or you have reasonable articulable suspicion that he is about to commit a crime. Exercising a right cannot be used as a suspicion of either. Doing something someone finds suspicious is not a crime or an indication that they are going to. Even if he’s enamored by her and is taking her picture that’s not a crime. It could just as easy be argued that since he is enamored by her he would be less likely to harm her. What they could have done is ask him about his activity but he’s not obligated to engage with them at all.

@@deweyplanck9850 RAS means suspicion that there is criminal activity. "Is currently being, has been, or will be committed." They have RAS that he is committing the crime of Stalking, or Harassment. I watch 1st Amendment auditors too, but can tell the diff between stalking and exercising a right.

@@xenaguy01 If he has the right to film, the SCOTUS has been very clear about this, it cannot be suspicion to exercise that right. For the same reason that pleading the fifth is not an indication of guilt. It is totally unreasonable to say if he’s exercising a right it is suspicion of anything. And it’s been deemed by the court that’s it’s unlawful for LEOs to use that as suspicion.

The SCOTUS has been very clear that if you have a right to do something, doing that activity cannot be used as RAS and it is not an indication of guilt.

By definition if he has the right to do it, it does not meet the standard of reasonable or articulable. It can never be reasonable to say that exercising a right is in any way an indication of guilt or meets the standard of RAS.

Actually you can photograph anything in public. Even people. There's a whole channel dedicated to it 🤣 the difference comes in the intent. Channel does Polaroids and gives then to the person. Always positive responses. Again INTENT is key. And it also matters if youre ugly or attractive. Its creepy for ugly dudes to do it but if a cute guy does It...its fine 🤣

There is no expectation of privacy in public. He can take all the pictures he wants of her unless she has a restraining order against him. They had no right to ask what he was doing, no right to tell him to stop, no right to demand his camera, and no basis for a warrant.

Normally I'd agree with you, but in this case she was potentially the target of a stalker and had death threats. So given the fact that he was taking pictures in her direction possibly of her, they would have the reasonable suspicion to stop him. Does that amount to probable cause needed for a warrant, i believe a judge would determine that I think but I don't know. I am not a lawyer, just some random guy on the internet so take this with a grain of salt.

No. That's not true. Depending on the state, this can very much be illegal. For example, this show is set in a two-party consent state, which would make it against the law to actively record a specific individual like he's doing without their consent.

Also, in the US specifically, you have a constitutional right to take pictures of anyone or anything, including private property or government building or people and anything that is viewable from public property and police aren't allowed to interfere.

If there’s reasonable articulable suspicion, there’s a difference. He has to be doing something more than exercising a right to make it articulable suspicion. Also she’s not allowed to hold him till she gets a warrant. You can’t detain a person who is not committing a crime unless you have cause that he’s about to commit a crime.

@@chillboi1476 Nope you have to have reasonable articulable suspicion of something. It doesn’t necessarily have to be a crime but RAS still comes into play. Also it depends on who is arresting you. These are city cops. The feds have broader investigative powers than they do. They also have a higher standard to bring charges. For instance they have to show that it reaches the requirements for them to intervene. Some state cases they can take the case and some they can’t.

He was caught in the act by an officer. So it is reasonable to believe a crime (stalking) was being committed - NO Warrant needed. If it was only an accusation from someone else, then a warrant would be needed.

It's not unreasonable, he's suspected of a crime and so it's reasonable for them to get his camera. If the camera is locked like how a phone can be locked they need a warrant, but otherwise not.
