No matter what happened. The commonwealth just didn't have the evidence. I hope the best for this officer. He didn't get the rush of making what he suspected ruled into "reality". He will have to collect the proper evidence next time.

Yeah that's less than Basic Combat Training for the Army, and Basic isn't really your training. Most MOS's (your job in the military) have a longer AIT (school for that job) than Basic. No wonder cops don't usually know the law...

Not even just that. Dash cams are so cheap. Let alone they could at the very least have some sort of body cam without all the storage story for so long. He’ll a go pro is a cheap and they could submit the video if they feel it’s needed for the case. In this day and age I don’t understand how a department is even allowed to not have body cams/dash cams.

I can't believe the prosecutor was allowed to speak that final line. "We shouldn't reward the defendant for legally refusing to give the state more evidence..." That is directly contrary to the fifth amendment. That's basically saying "We might had more evidence is it wasn't for the defendants pesky rights..."

One would think that prosecutors, especially those who don't have a case to begin with and aren't trying a violent defendant, would learn that being rude and demeaning will do nothing to help their case. As much as this man-child blowharded about "interpretation not mattering," the jury makes the decision and those interpretations will have influences. My eyes nearly fell out of my head when he said "probable cause is irrelevant." It is also terrifyingly clear the prosecutor never took a physics or math class outside of elementary school if the mechanics of the crash escape his understanding. This prosecutor is a total, dangerous, immoral joke. Excellent work, Larry.

I was worried the Jury were going to find him guilty despite the fact there was no evidence presented by the prosecution only hearsay because Juries are fickle and don't like to go against police especially with DUI. Nobody likes a drunk driver so you're usually guilty in the eyes of most people before you even go to court.

This is what I was thinking too. That prosecutor asked the jury to convict based on evidence. There was none. Just a rookie cop afraid to do nothing about the wreck. I don’t doubt that he smelled alcohol, but there was no evidence that he could produce or that he did produce to show dui. He is a rookie cop that made a bad call and then the prosecutor brought charges because he knows most people back the blue. He’s trash!

It can be evidence, it is just not a hard fact. And the evidence needs to be weighed against other evidence and other plausible theories of the incident. So, it was extremely weak evidence without any supporting facts.

Witness testimony can be considered evidence of the jury believes the witness is credible. Like if he said he saw him drink and then watched him drive drunk and that is why he arrested him they could use that testimony to convict him. But all he did was “smell” him. Even if they found him credible, he still had no testimony to prove he was drunk.

I am not shocked having watched the trial. The behaviour of the prosecutor was what shocked me. The lack of any investigation resulting in any evidence was shocking. No pictures of the vehicles or of the skid marks, no breathalyzer, no blood test, witnesses favouring the defense. I could never have found him guilty. I have to wonder how many innocent people have been convicted in that proseeutor's jurisdiction because they did not have a lawyer or did not have a good lawyer.

Larry, I watched all three videos and seeing this verdict has restored a little of my faith in the jury system. Great job! I must say I was struck by the casual way this judge ran his court....those were not just speaking objections, those were soliloquies. The banter back and forth by counsel, counsel testifying during examination, the endless leading during direct... let's just say my idea of order in a court is a little different from this judge's court. But I know every judge is different. I also noticed the jury was out only 18 minutes. That barely gives them time to walk down the hall to the deliberation room, elect a foreperson, and then vote. I'm surprised they didn't just raise their hands in the courtroom and say, "Your Honor, there's no need for us to walk down that hall... The defendant is not guilty!"

I think the whole county is suspect. Why wouldn't their police have cameras? Last case I heard of with no body cam was the ATF when they raided and killed a guy in Arkansas. Why they didn't have any cameras? It's not a budget issue, the ATF makes 100s of millions of dollars off of just NFA tax stamps and transfers and they only have 5800 employees or so. They have plenty of money coming in, so why no cameras when they were raiding the home of a suspected gun runner?

Earlier on in voir dire, one of the potential jurors said that your job was to "poke holes" in the version of events and the story posed by the prosecution. It's absolutely ridiculous that the prosecution had so little evidence to provide that their entire closing argument consisted of trying to poke holes in the defense's story rather than talking about the evidence they presented.

By the domineering way the prosecutor spoke to the judge at the beginning of the trial, to the way both the judge and prosecutor admitted they didn’t expect this trial to take so long to present, demonstrates how most DUI cases probably go in this county. Were it not for the awesome representation from defense council, I believe the defendant would’ve been found guilty, regardless of the aforementioned 11 reasonable doubts. Well done. 👏👍

Toward the end of the persecutors closing comments, didn't he make a Fifth Amendment violation? Legal precedent and the Fifth Amendment says the court and the persecutor can't use a defendant's invoking of his constitutional rights against them. Just as somebody refusing to answer questions cannot be held against them, their refusal to participate in a field sobriety test shouldn't be held against them either.

In most states, the implied consent statute makesrefusal (after probable cause) admissible. "Implied consent" is a legal fiction that, when one accepts a license it constitutes a "contract" between the driver and the State that the driver will consent if there is PC that he is in control of a vehicle while under the influence, thus an exception to 5th Amendment right not give evidence against yourself. Good thought, though.

My understanding is FSTs, at least in most states, are voluntary. I would agree, but it seems to be a grey area where the State views refusal as suspicious, whereas civil-rights minded would see it as an exercise in rights. Judges seem to lean toward the latter as well, unfortunately.

Similar here. I found out after, because a jury person told me, that the first vote was 11-1 for acquittal. Took three more votes, no changes, and one of the jury people said "hung jury" and the one hold out voted for acquittal. All within 40 minutes. :-)

The moment where your client mentioned dancing with his wife and getting alcohol on him was powerful. The way he said it with such confidence really answered the question of how he likely smelled of Alcohol. Also the consistency of the defense witnesses would've been extremely difficult to overcome. In the end, the evidence just was not there for the prosecution...honestly a weak case and should have been dismissed. The police officer should have asked more questions before jumping to arrest.

Same exact thing is happening to me, the officer stopped me only for an expired tag, told him to just give me my citation and I’ll have it paid by the court date, the officer refused and said he smelled alcohol . He told me to step out of the vehicle and I refused cuz I felt like my rights were being violated. He charged me with obstruction and pulled me out, cuffed me and said I’m under arrest for dui. He asked if I wanted to take any of the test, I refused. I refused all test going forward and charges were still filed. Told my public defender let’s go to trial. The officers testimony is that my speech was slurred and I had bloodshot eyes 😂

I can't tell you how many times I have been cut off by a motorist passing me on the interstate. I do my best to have my foot covering the brake while on cruise control. The DA was way too condescending, way too arrogant. Was he a police officer before he became a lawyer? I don't see how he would ever win a case. I'm not impressed with his courtroom skills. The prosecution didn’t do ANY work on this case. He just wanted him to pay a lawyer and be inconvenienced for months.

The defense attorney absolutely destroyed that prosecutor. Oh my goodness he kicked his ass something ugly. Yikes. That prosecutor was indeed out of his league. Reasonable doubt in abundance.

How can this Prosecutor sleep at night over his actions during this trial. His total lack of evidence for this case, is such an injustice for Mr. Faulkner. If he were to have been found guilty guilty, he would have been thrown in jail for 30 days. Most like if lost his job and his Insurance rates would have skyrocketed like heck. Also the Charges would be on his record for life. Great job Mr. Forman, another job well done.

I'm reasonably convinced that the 75-mph guy was in the same lane, noticed the vehicle he was approaching way too late, swerved around, and brake checked them while sideswiping.

All defence witnesses don’t have to prove the defendant didn’t have any alcoholic drinks. The burden is on the prosecutor to enter actual evidence that the defendant did drink alcohol drinks and was drunk while driving.

A prosecutor has zero evidence besides a cop that arrested him and said he smelled like alcohol? That’s lucky to the defense to get a not guilty verdict? I’m sure you’ll feel the same when you’re in his spot. A prosecutor trying to put you in jail with no evidence. I would never wish bad things but I wish you get charged for something you didn’t do and feel lucky when you get a non guilty verdict or your ass gets thrown in jail. Then you’ll think “lucky” won’t you?
