LVMH may be partially liable. The name Pocket Socks is def an infringement but according to patent rules if an item is re configured to a particular parameter it may not be liable..its then up to the court to assessment. So all in all the Pocket Sock company can recover a significant win on the name..The court will prob discuss the rest of the design differences.

I Think they possibly do have a case - the name sounds rather generic though. Unless they can prove pocket socks was trademarked. However Louis vuitton can afford this they most likely can't afford it to be on going. So Hopefully this will create brand awareness for the pocket socks company, ie it will be very good, relatively cheap marketing! Good luck to them!

Regarding the patent infringement, it's unlikely to win. The US POCKET SOCKS is in capitol letters and encompassed in a shield shape. They also have a zipper with the intention of keeping valuables safe and hidden. This is the main feature of the sock. The Vuitton version is not called POCKET SOCKS but labeled as Pocket Socks which is a description, and not a brand. The socks have a very obvious cargo pocket with a very noticeable button and is meant to be seen as a fashion statement and not a safety feature. As the pocket is not for safety but for styling and has no zip, it is unlilely to conceal or keep safe objects as they will be in full view of the prying pocket thieves. Remeber that those little buttons can easily be see for targetting,where as the branded pocket socks are hidden from view discretely. So, as the Vuitton version is strictly a fashion statement and the US company is a security feature, it is unlilely that the case will be won. Sorry Dacob, but once again you have shown your arrogance and lack of knowledge as to how fashion and utilitarian products are made. Ps: you can not patent a sock pocket. By you can patent it's production process as a feature. Vuiton has a completely different process to stitching a pocket on the outside rather than a pouch pocket with exterior zip for security features. You really should learn about how fashion works before making such claims.
