Story I heard a few years back a guy always used a stick figure when he needed to sign for credit card purchases. He lost his credit card one day and reported it to the company. Later the company asked if he changed the way he signed for stuff. Apparently the person who picked up his lost card used it to purchase stuff and wrote the guy’s name from the card in cursive. So they voided all the purchases with his name in cursive

This reminds me a story I was told by a notary friend. In defiance of the terms of a will, an heir decided to botch the sharing agreement signed by other members of the family by drawing a cross on the last page. The notary took back the document, circled the "X" and lifted a legalese formula from a XVIIth century document he happened to have had framed and was hanging on his wall (the formula was something like "I, ___, notary, certify the present mark to have been drawn in front of me by ____ etc. etc."). The bitter heir thus left egg-faced.

I have cerebral palsy and come from the days when us gimps were segregated from the normals in "special schools" so no one caught Disability... I remember our teachers spending quite a lot of time making sure we could all sign our first names when at all possible (including taping a pen to pupils' hands, etc - really impractical means sometimes!). It wasn't because an X wasn't valid (we were often reassured that it was), but rather because it's easier to forge an X than it is to forge a highly-illegible, obviously-gimpy, but fairly consistent version of "Andrew," "Mary," etc. I was one of the luckier students, in that I could write, and write legibly, but I remain grateful that my generation of disabled people, at least in *that* school, all went into adulthood with the ability to sign our first names... even the folks who literally can't write anything else. As Simon points out, it's becoming an obsolete skill *now*, but in the early/mid-80s, we had no way to know that would happen... it was nice that the staff cared enough to spend time on it. I'm also grateful that my parents fought like hell to get me into a regular mainstream (aka with-ablebodied-students) school fairly early on, but that's another matter.

In Japan and probably China too you can get personalized stamps that you use instead of writing your name. That was even a thing in Europe where you had your signature made into a stamp that you used if you were in a position where you had to sign a lot of document every day.

Björn-Erik Borg, in Russia doctors, and veterinarians too, and probably lots of other people, have their personal stamps and stamp everything they issue. Of course, they also sign important documents with a pen. At least you can read on the stamp who the person who signed or issued a document is (and ask about them later) for doctors' writing is horrible, as always.

The last checking account I opened I asked if they needed me to fill out a signature card and was very surprised that no one had any idea what I was talking about. They ended up asking one of the loan officers about it, I guess because of my complete confusion, and luckily she knew exactly what it was and explained that the bank no longer used them. Another bank I use still uses signature cards, but it seems like they're a dead or dying concept. One thing I hate about getting older is the number of things that are normal to me are obsolete enough to the world of today.

Many years ago as a lender in a bank, I had a few borrowers who could only make an “X”. We noted it as “His” mark, with two witnesses. Not a single one of them ever defaulted.

One instance where a matching signature is very important is for absentee voting ballots...at least in Florida but probably other US jurisdictions as well. For those that don't know, a voter can request an absentee ballot to vote, which is mailed to their registered address. You vote and then put the ballot inside an envelope and then have to sign across the seem. When it reaches the supervisor of elections office, all absentee ballots are processed by a canvassing board with the signature compared to the signature on file (when you registered to vote, or updated your signature). If it doesn't match, the envelope won't be opened and so the ballot won't be counted in the election.

If someone gets you cornered in whatever manner, you can create a method for later litigation purposes, with a "TDC" after your name, indicating that you signed it under _Threat, Duress, and Coercion._ Signing in Liquid Blue Ink is also helpful in establishing that the signature is not a photocopy.

My signature is an ineligible scribble that i cannot repeat twice in a row, even on the same contract. im 40 and nobody has ever said anything or caused me problems. not even the bank who pretend to go check it bc if they did it my scribble now wouldn't match from 20 minute ago let alone 20 years ago. I think tptb should stop wasting our time with this. For this reason, the backs of my cards are not signed. I was once asked for my signature and i said, are you serious, let me sign the back of my card first. They said dont worry and honored the purchase. To defraud by forging a signature these days is a definite ticket to jail so nobody is dumb enough and those who are must be prepared to do the time bc you will be caught 100%

I write “see ID” on the signature line of my credit card. Even still, I am rarely asked to show my ID when utilizing it with a cashier. So much is done yourself at the touch pad these days and it never leaves the purchasers hand. The amusing thing is that there are now issues with the electronic pens used for signatures. One thing that has been semi-common among people who start having issues with their hands/wrists that would make a clear signature impossible is to take a copy of theirs from when they could and have a stamp of it made. That no longer works with several of the things and creates a mess...

To answer that question from the standpoint of a non common law legal system - yes you can, the Croatian civil obligations act calls it a "handsign" (litteral translation). It's only supposed to be used by people who can't read or write, and any contract signed in such a way needs to be verified by a notary public. You can also create a last will by signing a premade text that has been read to you with a big fat X, however the last will needs to be signed by two more witnesses.

Lots of questions about what happens if you sign, "I do not consent." You are making a counter offer. Therefore, the other party need not fulfill their part. For example, let's say you have to sign for a package and you write, "I do not consent" or "under duress." In both cases, the deliveryman is not allowed to negotiate new terms of delivery with you, so they simply take the package back with them. I wish I could draw. Even my stick figures are embarrassing. Sigh . . .

In times past some wealthy men used signet rings to "mark their mark" on legal documents. A man would press the ring into something like an ink pad and then press the ring on the document to make a particular mark that he identified with. Others would mark a document with the first letter of their name instead of an "X".

The X is actually a Greek Chi, which is the first letter in Christ. By signing at the X, you are attesting before Christ as your witness. I thought that this was well known. It is also why Christmas is abbreviated as Xmas.

In most countries in Europe the signature has to be placed by hand, so it can be an X or your initials, but not a stamp. An electronic signature is allowed with the "something you have, something you know" principle. PIN/TAN for example.

Only problem I have come across with signing whatever you want is that you will usually have to explain to the person who is getting you to sign that it's the intent to sign, not what the signature looks like that matters. Of course they will often times still not believe it so the best way is to just lie and say it is your real signature.

Yes. There would be a huge problem trying to define a signature, while forbidden a single letter. When I worked in a bank, one customer always followed his name with a smiley face. He explained that if there was a signature lacking the face, it would be a fake.

Electronic signatures are generally only enforceable via special statutes that provide so. But for such legislation, under the plain language of the UCC section cited an email signature would *not* be a valid signature. Moreover, the good old manual signature is and will remain for the coming decades, the standard way of expressing assent to be bound by a legal instrument or SoF compliant contract.

There is an exception. Any medical documents. You can simply write ‘I do not agree’. This has held up in courts when asked to submit to arbitration or waive your rights to seek justice in a court by trial! ‘ I Don’t Agree’ is also acceptable!

I’m Portuguese and in Portugal, each person must have a signature that is displayed in our ID card. I’m not sure if you must sign all documents with this signature, but all government paperwork must be signed with that signature. This signature, however, can be anything, as long as you always use the same (you can only change it when you renew your ID, every five years)

Well in law school they taught me, consent can be given in various ways a simple yes answer or a handshake is already considered consent, making a contract legally binding. The problem occurs when the contract needs to be proven or enforced, this is why things are written down. This however does not mean verbal contracts aren't enforceable, evidence such as witness testimony and circumstancial evidence can be used to prove the contracts existence.

Without watching the answer is yes, it doesn't have anything to do with what characters you use to sign your name, a paper contract is only a physical representation of the intangible concept of a contract which exists when both parties agree to terms with consideration on each side. The contract is formed at the point where a meeting of the minds takes place so both people know the exact terms of a contract and then agree to them, a handshake works too. In this case, the X just signifies that you agree and it can be proven that you understood the terms as they were written out on a paper that you indicated your agreement for.

As a software developer I can say that on some credit card systems then don't even check the name when you buy things over the internet, you only need CC number and CVV pin and expiry. I was sending null in the name for years to some card API and no one noticed.

Even a long time ago, I used to sign for credit card purchases by drawing a little house with a happy family around it, Garfield (it's worth noting that I am probably the single worst drawer on earth), with the name Mickey Mouse, "Totally not the owner of this card", so on. Legally binding contracts can have another problem: if the contract is written in a language that the participant doesn't understand in sufficient detail it may be that a company offering services, such as an insurance company might just refuse to provide the service as the contract would be essentially unenforceable. To my understanding this is not that rare problem for expats...

In my job I research 1800s era documents. I regularly find deeds that were recorded with the signature noted "her X mark" indicating that someone could not read and write. 99% of the time it is the wife or some female heir of a wealthy land owner. But it is notarized and there are usually notes that the person notarizing examined the person to verify they understood what they were signing.

The question is one of authentication. If the purported signer denies the authenticity of the signature, it is better as a matter of proof if it is possible for an adverse party to prove the authenticity of the mark, and better still if it can also be shown that the mark was willfully and freely made without misrepresentation or undue influence by the person seeking to enforce the signature, or his agents.

Speaking of credit and debit cards. I'm almost 31 yr old and have never, not even once, ever signed the back of my cards and have never been questioned about it at a store lol. I've even went to pick up supplies for the office and paid with several different cards in different people's names (signing each receipt with my name) and no cashier has ever questioned me on it.

In my teens l took to signing my Civil Service time sheets with a joke name. When after 5 months my manager asked my why l was doing it l told him l wanted to see if anyone would notice. He said, "Yeah, that's why l kept putting them up." He said we've proven our point now. No-one ever checks. I went back to signing my name.

Graduating law student here. In a word, yes, you can be bound by a mere "X." However, this turns on if you intended such a letter to be your signature. A written contract need only be executed; the complexity of the execution is immaterial.

Let me be clear. I work at a bank and we check an ENTIRE year worth of signatures just to make sure nothing is shady plus we also look at the transaction history to see if it's consistent. If it doesn't meet our criteria we put a hold on it until the other bank can verify the funds are accurate

You do not need to sign anything to enter into a Contract. You just need: 1. An offer; 2. An agreement; 3. Consideration; and 4. An intention to enter into a legally binding agreement. Hence why you don’t sign anything when you purchase items from a shop. (Exclusions apply!)

I missed a flight from Berlin to New York and at one point had to sign my name, over and over, till it matched my passport before they'd put me on another flight. I'm also in a line of work where I deal almost solely with contracts and what Simon says is correct... just curious what my ordeal was in Berlin?

The state's driver's license holds an X for the signature. Other times I'll sign, "Without Prejudice X". I also never sign the property of the banks.

At a company I used to work at an employee was forced to sign a document before leaving. They signed it and added the word "unread", apparently previously advised by a lawyer. I guess this would go towards coercion if they needed to oppose the document.

In this case he was a director of the company and was being pushed out. I don't know the details but it was a pretty tense meeting. I've heard of similar stories with just regular employees being forced to sign non disclosure/non compete forms or not be allowed leave. They were kept for many hours until they broke down. I just always remember when this happened because if I was in the same situation I'd try the same thing. Or, until I saw this video, I'd have signed something like "Mickey Mouse"

Could it work by first writing (with inc) outside the marked area something like: "I have been forced to sign this document that I don't agree with" & only then sign it for real?

That's sort of what I'm wondering after having watched the video. If anything you write (even a false name) counts as you accepting the terms and the only way out of it would be to prove you were coerced, is there something that you can write to turn the tables on them? I know that he was told beforehand by a lawyer to write this if something fishy came up. I guess in the end it would come down to fighting it out with lawyers and possibly court which is always big bucks. I wonder if that trick would be good enough? and I hope I never have to find out :)

A recent legal obligation required me to sign a multiple of times. I apologized to my lawyer that my signature varied slightly each time. She told me that non varying signatures are and can be an indication of practiced forgery. Variation is natural. Also my signature doesn't fit on the space provided on the back of cards and some forms. The size of a signature is a unique identifier too. I hate miniaturizing my signature. Some authorities have practice proformas with a window printed on it to practice signature miniaturization. I like a thumb print personally.

a few years ago, while getting some work done on my car, I mentioned to the guy who I signed my car's details over to just how inaccurate those scan guns are for signatures, and he told me of a friend who, whenever she needs to sign on one of those things, she just blanks out the entire screen, for shits and giggles

what I find annoying about the signature on the back of cards is the material you have to write on. For some reason, you can never find a pen that can write on it decently. Usually your signature is something that you write quickly and you cannot apply much force so you can hardly see it. But if you do it slowly and with more force, it's legible but looks less like your actual signature because you have to write it slower... but in most cases those things aren't very writable with an ordinary pen...

Not in Brazil. Here you have to sign the same way you signed in your documents or the cards registered in the public notary office. However you could register anything in a public notary card or sign any name on your official documents.

I'm at 4:28 and I already have something to say about this video. I used to pal around with a totally blind man and occasionally, I'd help him write a cheque. He told me to sign the cheque with his name, so his name, my scrawl. Fast forward to 2018. I pick up prescribed drugs for my Mom, including an opioid. The pharmacy wants my signature in some electronic device. Lately, I've been signing for Mom's stuff by writing my first name in block capitals, BART, as millenials supposedly do since cursive writing is no longer taught in school. X

Uniform commercial code only applies to the sale of goods, not including real estate. And isn't actually a law, its adopted in each state so you would have to review the legal language for the particular state your in.

Nurses (and doctors, I'm sure) learn this is acceptable when getting a patient's written consent for a procedure. Whether the person can write or not (or even write neatly & legibly-think an elderly person with Parkinson's or who's had a stroke) isn't the issue. It matters whether the patient: understands the pros & cons of said procedure; pros & cons of refusing it and that the doctor has explained everything to the patient's satisfaction. It also matters that the patient is of sound mind; those with severe dementia or otherwise mentally impaired or underage require a legal proxy. For us though, we're not allowed to acquire signatures when the patient is under the influence of drugs or alcohol or whatever.

I assume that would be primarily people who have impaired vision, rather than true illiterates.
