When I heard that Tesla sued for this review I assumed it was because Clarkson did the whole review by making jokes about the roadster not even being able to finish a lap, and then ending it by pretending that the battery spontaneously exploded. But this is actually really level headed and any gripes don’t look exaggerated or made up.

Tesla unsuccessfully sued British television show Top Gear for its 2008 review of the Tesla Roadster (2008) in which Jeremy Clarkson could be seen driving one around the Top Gear test track, complaining about a range of only 55 mi (89 km), before showing workers pushing it into the garage, supposedly out of charge. Tesla filed a lawsuit against the BBC for libel and malicious falsehood, claiming that two cars were provided and that at any point, at least one was ready to drive. Paradoxically, the range of 55 mi was calculated by Tesla itself and supplied to Top Gear as an estimate of the car's range.[100] In addition, Tesla said that neither car ever dropped below 25% charge, and that the scene was staged.[101][102][103][104] However, Top Gear frequently stages scenes for comedic effect, for example by showing Jeremy Clarkson having to refuel the Jaguar XJS three times during the review of it.[105] The High Court in London rejected Tesla's libel claim.[106] The falsehood claims were later struck out.[107]

The huge problem I see here with comedic elements is the fact thath the show is producing a kind of review format. The viewer expects those three professionals to give an fair review about the vehicles and don't do scripted shows. As Elon Musk said in a statement, at the point the car was delivered to Top Gear for test purpose there was a script found on the table wich said, that the car would break down at one point of the show. In fact they staged a breakdown to a car wich in fact did not brake down. In that stage of company development beeing a startup this could have cost the future of the company.

Because according to Tesla the car didn’t break down, didn’t die. Therefore, it was a fake review damaging to the company. They lost because the show is scripted, and Tesla knew this going in. Overall I think it was a decent review.. perhaps it didn’t breakdown or die.. but consumers should understand the downsides of the vehicle. So many people regret buying teslas now after realizing the price of replacing batteries, the ridiculous charging times and the use of fossil fuels to charge the car constantly. Tesla would have been better off starting the market off with a converting engine electric/gas. Perhaps using the gas engine to charge the electric would have been much more productive for consumers and environment. Rather than requiring a gas vehicle as back up to have a productive life.

The only reason the judge threw the lawsuit against top gear put was ‘BEcAusE iT WaS a jOke’
@kingenfuuken

@@HeavyMoonshine19 Why are you lying? That's not what happened. www.wired.com/2011/04/elon-musk-calls-top-gear-completely-phony/ www.wired.com/2012/02/tesla-vs-top-gear/ Although Clarkson hailed the car’s acceleration as "biblical," he declared the technology “doesn’t seem to work” because the cars ran out of juice after 55 miles, needed 16 hours to recharge, and broke down. Tesla claims none of that happened, and Musk is especially peeved that Top Gear allegedly wrote the script before anyone actually drove the car. Tesla claims one of its employees saw a script written before the test. Poppycock, says Top Gear. In his post at Jalopnik, the program's executive producer (Andy Wilman) says there was nothing dishonest about the test, and Tesla's claims aren't true. Wilman claims Top Gear never said the Roadster's range is only 55 miles (Tesla claims 245 miles), nor did it say the car ran out of power. "In the film our actual words were: 'We calculated that on our track it would run out after 55 miles,'" a figure he says came from "Tesla's boffins in California." "They looked at the data from that car and calculated that, driven hard on our track, it would have a range of 55 miles," Wilman writes. As to the matter of brake failure, Wilman said one Roadster experienced a blown fuse in a vacuum pump, which is indeed a failure -- and one Tesla insisted on repairing before Top Gear continued the test. Wilman offers a lengthy rebuttal to the claim that Top Gear wrote the script before driving the car. He says Clarkson's time behind the wheel is but a fraction of the testing conducted, and much of the driving was done before filming commenced. Early drafts of a script are written ahead of filming and revised during filming as new information and insights arise, he writes. At the end of the day, Wilman writes, the Tesla performed admirably but fell short because its drawbacks outweigh its advantages. And in regards to the lawsuit proper: Tesla Motors CEO Elon Musk called Top Gear "completely phony" and his company sued for libel and malicious falsehoods. A judge dismissed the suit in October, saying no viewer of the program could have reasonably compared the Roadster's performance on the track to real-world performance on the street. Tesla would not be deterred and returned to court with an amended suit. The same judge, in a ruling handed down Thursday in London, dismissed the claim. He noted that Tesla's amendment was "not capable of being defamatory at all, or, if it is, it is not capable of being a sufficiently serious defamatory meaning to constitute a real and substantial tort," according to The Guardian. He added that "as any reasonable motorist knows, a manufacturer's statement about the range of a motor vehicle is always qualified by a statement as to the driving conditions under which that range may be expected." Elon Musk fanboys, I swear. You probably think he's a real Engineer too.

I don't really know what your point is here, nobody is arguing about if TG was in the wrong legally, even musk most likely just wanted to get exposure from it. What people are mad about is that TG literally faked a breakdown because the show is entertainment and not educational. The argument over wether or not it was legal doesn't matter, the issue is that many people consider TG to be at least somewhat honest about the vehicles that they test and in this case they were not.

If the top gear (ha) of a transmission holds the engine at its eco-band at high speed you actually get the best fuel economy at sustained high speed. The prototype of this car actually DID have one but it kept breaking so Tesla abandoned it because the electric motor was technically able to operate without one and doing so simplified the manufacturing process. Because there is a lot of misinformation, here are the facts. Elon Musk sued Jeremy Clarkson and TopGear due to his roadster breaking down. Jeremy won the lawsuit proving this episode was not scripted and showing even though it was a negative review it was accurate. Elon then appealed the lawsuit and brought it to another court. That court had the same findings, the episode was not scripted and had a fair review even though it was negative. Now due to heresay laws, Elon Musk claims someone who heard from some else told him the breaking down was in the script. Due to Musk's money, he is able to slander Jeremy despite Elon's claims being proven wrong in court, twice. Jeremy cannot say to the contrary because even though the evidence supports he was never in the wrong, slap suits are not illegal. And it would cost Jeremy a small fortune to win for the third time. Goes to show you, having a massive PR team and a firm of lawyers has a massive impact on public opinion. So in a court of law it has been proven twice, this was not staged, never premeditated, and was an accurate review of the tesla. Conjecture leads you to believe since Musk himself says that investment was stifled after the review. He slapsuited Jeremy to create the false impression that they were biased against his car. When in actuality they reviewed the car they were given accurately.

One thing Top Gear said in the episode is that the car died after around 55 miles on the track, but Tesla said the logs on the car showed it never even dropped below 20% state of charge. The brakes in the car never broke either, apparently it was a blown fuse. I don't know if that's any better, though. The motor overheating never kept the car from working completely, only reduced torque. Car still worked fine. Tesla later lost the lawsuit as the court failed to find any evidence that this caused any damage in reputation or sales of the company, which it obviously has seeing these comments. Then again, a lot of you might have disliked Tesla anyway for different reasons. Hard to say. Anyway, here's some quotes on the case if you want to know what info I used to compile this summary: Two quotes from the judge: "Not capable of being defamatory at all, or, if it is, it is not capable of being a sufficiently serious defamatory meaning to constitute a real and substantial tort," "no viewer of the program could have reasonably compared the Roadster's performance on the track to real-world performance on the street" Tesla official lawsuit claims, word for word: *Malicious falsehood* The item was false in the following respects: Particulars of Falsity (1) The first Roadster shown (which was silver in colour) did not run out of charge. (2) The first Roadster did not have to be pushed into the hanger as a result of running out of charge. (3) At no point were the brakes on the first Roadster broken. (4) The second Roadster (which was grey in colour) did not become immobile as a result of overheating. (5) There was no time at which neither Roadster was available for driving. During filming, the Second Claimant's UK Director of Sales and Marketing, Don Cochrane (who had previously expressed concem about whether the Roadster would be fairly portrayed, having seen whilst on the set, a script written before the Roadster had been driven at all which concluded with the words "It's just a shame that in the real world, it absolutely doesn't work."), challenged Mr Whitehead about another script which he had seen which called for the Roadster to be filmed being pushed into the hanger having run out of charge. Mr Cochrane said that Top Gear could not do this and Mr Whitehead purported to agree and said words to the effect of "We don't want to be sued." On or about 21 December 2008 (ie shortly alter the initial broadcast of the item) the Defendant issued a press release which claimed that the Roadster was shown being pushed into the hanger to demonstrate "what would happen if it did" run out of charge. The Claimants infer that this press release was issued on the basis of an account given by one or more of Messrs Wilman, Whitehead & Clarkson. This reason was a lie. It is in any event, an admission that the Defendant (by any/all those men) knew both when filming and by the date of the press release that the Roadster had not run out of charge and did not need to be pushed into the hanger as a result. Each of Messrs Wilman, Whitehead & Clarkson knew or recklessly did not care that the brakes on the frst Roadster were not broken or did not believe that they had because (a) this was apparent to Mr Clarkson, who was driving the Roadster at the material time, and (b) the Claimant's engineer Stuart Brierley, and Mr Cochrane explained to various members of the Top Gear crew and Mr Whitehead that all that had happened was that a fuse within an electrical circuit providing additional powcr to the brake pedal had "blown" meaning that while the brakes were still entirely safe, the brake pedal needed to be pressed down harder than would otherwise be the case. each of Messrs Wilman, Whitehead & Clarkson knew or recklessly did not care that the second Roadster was at no time ''immobile due to overheating or did not believe that it was. This was evident because it did not overheat (but rather reduced the torque available to prevent overheating) and because at all times it remained capable of being (and was) driven by Mr Clarkson, including being driven by him to the point at which it was shown sitting immobile on the track.

Jeremy was so extremely fair with this review. Even though he clearly doesn't like electric cars, he was *really* giving a shot to this one, and giving praise everywhere he could find something that he though enjoyable. Clarkson was being intentionally misleading about many aspects of the car. He said the range was only 55 miles. As if hammering the car around a track somehow counts as real-world usage. In the real world, it was about 130-ish miles. Far short of the claimed range but significantly more than 55 miles. He then claimed that the battery took 16 hours to charge from a household socket while ignoring any other faster method of charging. As if anyone who could afford a £90k electric car wouldn't have a dedicated home charge point installed. It's difficult to know whether or not the car ran out of power because of how much energy going around a race track would use, but it would've been quite an oversight of the driver to not notice the car's power gauge getting so low. I find it hard to believe that they could've accidentally drained the car to the point where it couldn't move by itself. Besides, the reason that the case was thrown out was because the BBC said Top Gear is an entertainment show. Not a facts show. The case getting tossed out doesn't prove that the review was honest

@@smokindamaryjane The newer V3 chargers take 40 minutes, and the V2 chargers take about an hour. Doesn't matter unless you're going on a long road trip, anyway, since you charge it overnight when you're in town. No need to charge it at a supercharger every day if you can just charge overnight. Also something important to mention is that you get 200-400 miles of battery from your house, every single day. On the other hand, you get your gas range mileage from the last gas pump you visited, which you most likely didn't visit today, meaning your left with less and less miles in the tank every day until you have to pump in gas. Now, not only does this mean you don't use 200-400 miles up every day, it shows that when at home, an EV is actually slightly more practical and convenient in the fact that you don't have to spend time driving to a gas station every week to fill up the car. Also, it's cheaper! They lied about multiple things in this episode, the "analysis" is not a truthful one. @@SdoubleA Electric cars will eventually make transportation cheaper, and be the cheapest viable candidate in an inevitable post-fossil economy. They have potential to help balance the grid, lowering electricity prices, and minimizing blackouts. And they have potential to have far superior traction control and zero rpm torque. Also, one-pedal driving can be made smooth for cheap, which makes driving even easier. But the arrival of driverless cars will be a _much_ bigger revolution than the small list of advantages of EVs. EVs primary disadvantages are sticker price, range, charging speed and weight. Pretty significant drawbacks for many still. But the only big bottleneck of those disadvantages is the battery - which is still being exponentially improved and scaled up in global production. In a few years, it'll start being a small evolution, but certainly no revolution like cars vs. carriages. Plus, it'll take at least 20 years to produce enough EVs to replace most of the ICEV fleet, so it's not going to happen overnight even in the most progressive scenario.
