He then stupidly said he was off duty. An officer is always on duty, even after his shift. So why even say he was off duty, and he was put right by the little piggy that was driving the car. In order to be correct the signs should be at the entrance of the road, not on the grass, away from the entrance, and secondly we own the police so we cannot trespass on our own land, and thirdly, it has nothing to do with the police because civil trespass is a civil offense. The signs did not point out Police land

You should have a Copsplain Bingo card with the following on it - "At the end of the day", "We're going around in circles", "Can I have your name/details?", "Fella", "Police officers private vehicles", "In the heightened security situation", "Hostile reconnaissance", "You're not breaking any laws", "You shouldn't be doing that", "Section 43", "If I came to film your house" etc and when they say enough to complete a line just call "BINGO!". or just hand them a card with a tick list of those phrases and ask them to tick them off as they inevitably say them.

When he says *ALL* of the land beyond that sign, does it include my house, which is about fifty miles beyond that sign? There is nothing to denote the boundary or any perimeter, rendering that sign completely invalid..

The sign is informing that when you come to private land don't go. You would likely consider the land to be private once you reach the fence.

Ahhh y’know, after part one, I was going to give props to the police. They got close to crossing a boundary, but compared to many interactions I thought they were fairly measured. Part 2, however was the same paranoid overreaction we’ve come to expect. Glad to see him do the shuffle of shame at the end. 👍

Trespass in English (and Welsh) law is mostly a civil tort rather than a criminal offence. The circumstances in which it is a criminal offence are usually trespass on educational premises, railway property, protected sites, etc. This could well change soon under the currently proposed Police Powers and Protections Bill, which will affect England and Wales. If passed, it could give landowners the chance to criminalise harmless and often accidental trespass. More often than not as things stand, it's pretty obvious where anyone could be trespassing, as private area's have bloody great big fence's and things around them letting the public know what's what. "Fence-lines" mean bugger all really, as do silly little signs that don't point to the area you may happen to be in, in order to read it. British Police are not employed to involve themselves in civil matters, (though they often do) and this looks much like one.

That cop says he gave his name and used that as an excuse to get yours, but all he stated was he was police, it was Mathew chubb if anyone missed it on his badge. And to the cop, no you were not polite at all and if someone came to me speaking like that they would get nothing just as AB responded to him. Its not argumentative to not answer questions im afraid.

Technically you are correct. Curtesy and wisdom keeps the mouth shut, two laws that really tell us not to ask questions of others because it is none of our business. We used to here "Mind your own business," when others stepped out of line. The law of privacy is also not being observed by officers, and all those who ask us personal questions as though they have a right to ask. I ask such, Who gave you the right to ask questions of me in regard to my private life?"

@Don't Shoot well arguably, if you are a police officer, he can ask, but he's not entitled to demand any answer from a member of the public who has not broken any law. However, he kicks off by accusing AB of being difficult. Difficult by not giving answers to questions he's not required to answer? It seems you are the one missing the point 'Don't shoot', on the right to do what you want in a public area, without some plod walking up and demanding 'show me your papers'? The plods entitlement, showing his 'badge' and expecting AB to take a knee immediately, thinking he can demand polite answers, and your attitude here, shows how police officers believe they are always right, and the public, who they actually serve, are always wrong! AB was standing outside the disputed private / property boundary. What law gives a police officer have to walk up, even politely, and demand answers to private and personal questions??

To be fair the first two guys were quite polite and could argue their case like adults. Less said about the cop with the shiny badge the better! Think he drew the short straw to go out and speak to you.

Reasonable, Respectful and decent, up until the point where he suggested they could "eject" him, which would insinuate a threat of violence for non compliance, then the second who advised that if the police asked for information he would be obligated to give it as he would be trespassing, which a police officer has no official power to enforce trespassing as it is a civil matter, not a criminal matter, so the most they could do would be to obtain his information by consent and start civil proceedings. Sometimes police have an ego issue at the thought of someone challenging or questioning the limits of their authority, which is very worrying.

Just checked the land registry for you and unfortunately they police were correct the adopted highway does stop on the line they suggested, the footpath and road is private.

Its all owned by the public so its public land . Or is it a serco land then its private with the police being in their with publics police cars and police being paid by the public . Its all very fishy . Any police place is public owned . Unless the public leases the land from a private company and the publics paying for the lease . Do you understand where im comming from . The publics paying a private company to store and use it for publics property .

The proberable word is its " not adopted land ". Meaning Council is not the owner, a private is, but as its open "not gated", so rambler and other common laws applies. No offence such as trespass, and no offence either if no damage done. Note " not adopted " could also be as there is a land boundry dispute as adding or removing land has made a disputed zone on the Land Deeds. So it can not be gated, so its open, ie can't stop public entering and exiting on.

Not every footpath is a public footpath, if you notice there is a clear difference in the road surface between the public road and that lane. My bet would be on the police being right in this instance.

Hey AB. Love your Channel. I Think you should do some preparation by studying a real survey cadastral map of the area before you go. You Can even look up the owners of each parcel. This Way you know exactly if its private land or not and where the border goes.

I would also assume the private land is regarding the green land beyond the fence and not the footpath you are walking on, why therefore is there another sign further down advising the private land is beyond and not referring to the footpath. The police badge carries no authority without a warrant card, it shows no ID or warrant.

If I was walking there, I'd assume that sign is about the grassland. The fact that further down the path you encounter gated entrances tells me that's probably where the private property is.

Once had a witch park her flaming brook stick up against a shop and come across to me to ask me questions. The first was what I was doing? I was sitting on a bench on my lap top. Stupid cow. I said "I am doing some eclectic work,. That got her mad. She then asked for my details and I replied "I am an honest law abiding citizen, and you want me to break the law. She looked stunned. I carried on to say that the law says that I do not have to give you my details, so providing you with my details I would be breaking the law. That stopped the old witch and I walked off.
