The elephant in the room which is overlooked is that "property" which can be expropriated is not only limited to land in terms of Sec 25(4)(b) of the Constitution. Simply defined property can include anything which has economic value to the holder of property be it i.e., immovable, movable, immaterial and incorporeal property. Expropriation without compensation is nothing less than confiscation of property dressed up under the guise of land reform and public interest.

Justification for expropriation includes, "if the owner cannot retain occupation of the land/property, then the land can be expropriated". As images of Zimababwe demonstrate how this might unfold in practice. A group of militant one day move onto your land, they might demand that the rightful owners leave or occupy the land with all the inconvenience that accompanies such a presence. Worse still, would be the slaughter of animals and threat to life. Instead of interceding to remove the illegal occupiers, the Government simply expropriates without compensating the owner. Now, much is made of the rural areas being targeted for such expropriation but ANY property, including urban homes or land could be fair game for similar action. Urban areas need their green spaces, they need areas for unrestricted drainage and preservation indiginous fauna and flora, the EWC could see the loss of these crucial areas. We should remind ourselves that in so far as South African indiginous tribes are concerned, they still have a Homeland to return to. What has been done to ensure there are economic opportunities in these regions to reduce the pressures of informal settlements in the rest of the Countries urban areas?

A new law does not over rule the constitution. So very easy to reverse any law like that. US law allows US government to expropriate and pay only a token amount. Trump in his first term expropriated 400 properties to build his wall. Many owners were offered a mere $800/ Acre for their land. Those land owners had to sue the Trump admin at their own cost. The Fed court orders meant they lost that land whilst the cases were still in court. Is that a law we should adopt here.

The wording of this act is vague en therefore very wide. It includes ALL types of property, not just land. More importantly, the provisions for "consultation" are such that if the "seller" refuses the "price offer", he can be left with nothing, i.e. property will be confiscated without compensation. It means: daylight robbery. They could also confiscate pension and medical funds, inheritance assets, mining ownership, businesses, etc. The list is endless. They will call it "state owned" but in reality it will be "Politburo owned". Insofar as land is concerned (farms, residential properties, business properties such as banks) are concerned, such actions will crash the housing market overnight, cause a banking crisis of note and could turn the value of the Rand to Zimbabwe levels. The IMF and World Bank - however much disliked by most and for good reasons - can simply call in its debts and the entire country will be gone. The regime actors won't escape either, as they and their families will be "blacklisted", their foreign bank accounts frozen, restricted from international travelling, and even put on wanted lists. Neither Russia nor China is going to lend a hand, as they won't accept this massive rejection of the RSA constitution that is in tune with international law and the basic principles of human rights (individually and collectively), wrt ownership rights.

This is what I suspect about both NHI and the land thing: The government has not used the last thirty or more years it's had available to build much in the way of new infrastructure, or to create institutions that enable people to learn how to do difficult things like farming on a small scale (which is what solving the inequality problem via land would have to, by necessity, entail). Instead of spending the money available for these things as they should have, they've just told people there will be this or that expropriation (with a big point being made of there being no confiscation, so it's revenge being offered), and that will magically fix everything a real world program might have. I've recently been to a government hospital. It was shocking. They've gotten worse. And a look at the infrastructure shows that everything there was built more than 40 years ago. Solution? Take the hospitals the private sector built. There's the hospital neglect problem solved. (So they're both fake "solutions" to problems, just used to put off claimants until this catches up with them.)

There are many indigenous tribes, and they have different territories and different treaties. The Alaska Native Lands Claims Settlement, which involves millions of acres, is different from the James Bay Agreement ($235 million in the mid-1970s, plus special hunting rights, cultural authority, etc) or the treaties regarding Navajo, Mohawk, Apache, and other lands. No single tribe ever controlled all of North America.
