Wow the people asking questions about birthright citizenship must have their head up their backside. It's the 14th amendment that came after the slave citizenship. The video explained alot of things. No wonder the host left the country, he saw the writing on the wall a long time ago of how ignorant Americans are

@@AlbAy537because traditionally it’s been very easy to make money and buy a home in America aka the American dream. That’s why people have wanted to come. Not because of the lovely pick up truck driving armed to the teeth Muricans. The dream doesn’t exist anymore inflation and monthly bills will kill any savings potential and $400k homes on 7% is not a dream thats a nightmare.

Whether you support Trump or oppose him on this issue is irrelevant. The fact is that birthright is enshrined in the constitution (fourteenth amendment) of the United States of America. What people need to bear in mind is this. If Trump is allowed to override the fourteenth amendment and thus override the constitution, then what is to prevent him from overriding the second article of the very same constitution, and thus ensuring that there will be no presidential election in 2028?

One mistake that people are making is they're saying that the children born in the US to foreigners would have the citizenship of their parent's country. That is SOMETIMES true, but not always. It depends solely on the laws of the parent's country.

Not really, the United doesn't follow the principle of jus sanguinis, in which the newborn is granted birthright citizenship depending on the citizenship of the parents like in France, rather the country adopted the English common law principle of jus soli, where regardless of the citizenship of the parents, the newborn will be granted citizenship upon birth. This was illustrated clearly in the Supreme Court case of United States v. Wong Kim Ark as part of the interpretation of "subject to the jurisdiction thereof" in the Fourteenth Amendment of the Constitution but it won't be granted to newborns whose parents are (1) foreign diplomats, (2) parents who gave birth on a ship and (3) enemy combatants. The Wong Kim Ark principle has also been followed in another Supreme Court case of Plyler v. Doe and also other lower court cases. To me, it's patently clear about the position of birthright citizenship. However, besides that, Trump's decree of an executive action is tantamount to him exceeding his constitutional powers, similar to what happened in the Supreme Court case of Youngstown Sheet & Tube Co v Sawyer, where President Harry Truman signed an executive order to seize steel mills during the Korean War, which was deemed ultra vires and unconstitutional. Only Congress is allowed to amend the Constitution with a supermajority of both Houses of Representatives and Senate as well as the consent of 38 out of 50 States. Trump is not only dangerously testing the waters of the Constitution but also committing constitutional procedural impropriety as well as a contravening the Rule of Law and Doctrine of Separation of Powers.

Actually, babies born in Chile do get citizenship. Many Russian come to Chile to give birth and they call it birth tourism. They stay about 3 months after birth and child gets the Chilean passport. They come back afterward and parents apply for permanent residency and subsequently the citizenship after a few years. You can check online, they have a website where they cater especially to Russians. 🎉

@@nightowl7261 from what I can tell, he was born in Pretoria, South Africa. Moved to Canada aged 18, getting citizenship via his mother. Then ends up in California, '95 to go to Stanford, but never enrols in any classes. Gets US citizenship in 2002, probably as a result of his families money and investments/business building in the US. Certainly not the ideal Trump poster boy, but it's Trump so the irony will be lost on him and his immigrant wife.

@ it's obviously lost on many that Donald (second generation immigrant), married to Melania (immigrant), with Elon as his lap dog (immigrant), are bending over backwards to grab literally anyone that comes within reach, some, that 'kind of' qualify (to their criteria), to just grab them and deport, likely without any form of due process, and then there is the birthright thing.

Only way to do it....however, you better either have made a significant amount of money on the way out OR you can work hyper remotely or have access to a network of family who live abroad already in various countries. Preferably 3 of the Schengen zone and 2 of the new BRICS nations to be pretty solid in your living. It's doable but will take at least several years.

I agree, the parents could be just vacationing in the country or transferring to another country by plane. Maybe there could be some exceptions such as parents that had a permit residence there and speak the language and our the road to citizenship.

I'm OK with the way Australia, New Zealand, Ireland, and the UK confer their nationality to people born in their territory. They require at least one parent to be either a citizen OR a legal permanent resident (or whatever they call it in their country).

Say what you will about Australia but i think they strike the perfect balance in this particular instance - citizenship is granted to children of Australian citizens and/or permanent residents. For children of temporary visa holders, they are issued the same visa status as their parents/"best status" if parents on different visas and then the child can become a citizen after their 10th birthday.

Speak for yourself! Australia needs to tighten up and move to a system similar to Singapore. Renewing a permanent residency visa every 5 years and making actual citizenship a high bar to obtain would be a step in the right direction. And permanent residency should not just give your child automatic right to citizenship.

The supreme court case you mentioned of 1898 giving citizenship to Asian parents should be clarified, borh Asian born parents were Legal residents. Neither Asian parent was an illegal immigrant.Why did you omit this fact?

Trump is talking about removing “birthright citizenship “ for illegal foreigners or anchor babies. He is not talking about taking away “birthright citizenship “ for Americans born in the US. Trump even has said the 14th Amendment was created specifically for decedents of slaves because at that time some were questioning whether the former slaves and their children were citizens. It was not intended for undocumented foreigners to give birth to children on US soil who then becomes US citizens. He says the US is the only country that does this.

This is apparently so deeply ingrained in the constitution that to even consider changing this is a waste of energy and time. It will never happen. As a spectator from across the pond, to the sh1tstorm that's happening right now, it is interesting that there is such animosity to immigrants given that some 27% of US citizens are first or second generation immigrants, and that INCLUDES Donald (second generation), Melania (immigrant), Barron (first generation), Elon Musk (South African, Canadian, US immigrant) and the list goes on. His ignorance to the irony knows no bounds.

Read the constitution. Birth in the USA makes a person a citizen. A change to the constitution is necessary if you want to change the law. So at this time I disagree with DJT and many of the comments. The USA is not the only country allowing birthright citizenship. If you are a believer in law and order, follow the laws. I was born and live in the Netherlands. My mother was born in El salvador and my dad is Dutch. I can get a Salvadoran passport because my mother was born there. Would it be a good idea to get a Salvadoran passport or are their risks involved?

Dubai is supposed to be safe for women. I lived in Libya as a child and as long as you are fairly modest in dress and don’t draw all kinds of attention (wear skimpy clothes and tons of makeup), you should be just fine. Dubai is pretty cosmopolitan!

Actually Andrew US banking laws now have it that for any Canadian bank in the USA they have to report even their Canadian operations clients that might buy any US securities or investments inside Canada. They force those Canadian banks to issue a US tax form on those Canadians even if they never stepped foot in the USA. Scotia I trade I know for a fact does it as I received many notices for such trades made inside Canada not the USA. So any Canadian bank in the USA is now ignoring Canadian privacy laws and surrendering to the US laws private information of Canadians.

That last part of your video makes very little sense. If you’re here illegally and you commit a crime, of course you’re going to be subject to criminal penalties. I know you don’t expect the legal system to operate in a way where if you’re an illegal alien, you get to do whatever you want simply because you’re not subject to the jurisdiction thereof. Bottom line, that small line in the 14th amendment (subject to the Constitution thereof) means a lot if we’re going to claim to follow the rule of law. And the moral reasoning to have such a stipulation in the law is so that you bring in immigrants that are loyal to and understand the traditions and values of this country. The great replacement theory is very real. People who rush to get here illegally, also bring their beliefs and the problems they voted for in their home country into the US. Legal immigration helps mitigate that effect and bring some balance to how the country evolves.

The former slaves were under the jurisdiction of the state and the Federal government, first they were property, then they were second class citizens who could vote but only be counted as 3/8 of a citizen, which puts them under the jurisdiction of the federal government for voting purposes, so the former slaves that were freed were always under the jurisdiction of the United States of America.

I do not think birthright citizenship in the USA will end. Some of the US Supreme Court Justices might dissent, but for most of them, it will be decided for birthright citizenship. My son was born in Nicaragua, and his mother is a Nicaraguan and me an American, so he is a dual Nicaraguan 🇳🇮 and American 🇺🇸 citizen. The problem with taking birthright citizenship from people with visas in the USA, and give birth in the USA, is that not they are not permanent residents, but they still contribute to the US economy. Even illegal immigrants still contribute to the USA economy. Case in point, the produce prices are rising because those immigrants are not showing up to work because of deportation threats. ICE are targeting people for just speaking Spanish and looks like they could from Latin America. I am more worried when my son is older visiting family. Someone might be racist and prejudice trying to deport my son. I plan on buying plenty copies of his Consular Report of Birth Abroad (CRBA): USA birth certificate and USA certificate of citizenship for US citizens born abroad just in case of conflicts in the future!

Nope...the US Constitution (the 14th Amendment) does not require amending. Because the key phrase in the Birthright citizenship clause in the 14th Amendment (Section 1, first line) is "and subject to the jurisdiction thereof", is what President Trump is correctly focussed on. If President Trump's Executive Order is challenged in the courts, the SCOTUS can indeed rule in President Trump's favor simply based on that line, " and subject to the jurisdiction thereof". That line within Section 1 of the 14th Amendment, makes it clear that children born of ILLEGAL 'immigrants' on US soil cannot be considered US Citizens, since the parents (and the newborns) are subject to the jurisdiction of their own countries of origin. Now, yes, a Constitutional Amendment can eventually be issued to re-clarify the issue of Birthright citizenship (either re-enforcing the fact that children born on US soil to illegal immigrants are NOT considered US citizens; OR a Constitutional Amendment stating that those children born on US soil to illegal immigrants are considered US citizens) ---- but in the meantime, the often misinterpreted 14th Amendment already states that those children are NOT considered US citizens since they and their parents are not subject to the US jurisdiction.

Agree with the idea of not hiring US citizens vs other nationalities just on the basis of merit. Americans for the most part, have this entitlement idea that think they're the best at everything and should be hired over a non national. As a retired HR professional, I saw this over and over and mostly hired only those that had done their research into our company and knew our inner workings by studying our media posts, our business model and ethics, etc. Very few Americans went the extra mile and therefore not considered. When we did, it most mostly for lower level positions (admin, etc.). I see the problem worsening, as we instead of welcoming and utilizing foreign unskilled workers to fulfill the menial jobs (foodservice, general labor, etc.), they are becoming unwelcome and now WE have to fill those positions rather than focus on education and professional careers. We will inevitably see more physicians with unpronounceable names for better or worse.

He covered that. Most countries in North and South America, except maybe 2 countries. USA, Canada, Mexico, Brazil, etc. About 33 countries in the world offer birthright citizenship, which doesn't distinguish between if the parents have legal status or not

No they will not. Unless the parents were able to remain in France on a resident/work visa and continue to reside for the required amount of years in France would the child after a certain age be allowed to apply. This is the normal throughout most countries in the world although there will always be variations. I was born in the 60's in the USA but both my parents were British citizens, but for me to obtain British citizenship I could only obtain it if my father was British. If it was the other way around through my mother I would not have been granted the citizenship. This has now changed from 1983 where its either parent. But if a child was to be born in the U.K or France of foreign parents the parents would have to remain and become nationalised for the child to be eventually nationalised also.

I think this is a stupid move and just to please the masses and make headlines. However, as we all know, the masses are uneducated and find this awesome and cheer for it. Important to understand is, when you are born in the US but your parents aren't US citizens, the child still would have to leave the US as soon as the parents have to leave. Furthermore, it would take 18 years, till the child is legally an adult to go back to the US and bring the parents to get into the process of naturalization of family members of a US citizen.

This gonna piss many Trumpit's O MAGA voters, but my entire family brothers and sisters with just B1/B2 visa tourist visa went from my home country the Dominican Republic and have given birth to all of their children(25 in total new americans). We are somewhat of medium to high class family compared to most dominicans who are having rough time, we also have Spains citizenship so we all have 3 passports, the USA(EASY), The Dominican(By Blood) and the spaniard by spains grandchildren law to restore lost European citizenship because of Franco and the troubled times of Spain in the early 1900's(also by blood and complicated). Just 1 of my sister's children got her child stuck in the birth canal and ended up spending US$27,000 for an unplanned C-section, all the other children were just US13,000 via natural birth, so yes giving birth is freaking easy in the USA with a tourist visa, all my sisters huge pregnant belly's entered your borders and the border agent said absolutely nothing, they did not even asked them if they were gonna give birth on US soil, they all have given birth in Orlando, I think the hospital was called Winnie Palmer in Orlando that specializes in women giving birth. Orlando international airport is freaking easy to enter, the border agents are mostly women and they don't ask questions or how much you gonna stay in the USA. Birth citizenship should be just as the Dominican Republic, just by blood, or a mother or father or both should be Dominican before the kid comes out of the womb, US citizens should help Trump look for a legal way to stop this craziness, in other words, even i get it, it's so easy, your system/constitution is broken, getting a 10 year US tourist VISA is easy as hell, i don't remember the last time i ever heard of a Dominican friend or colleague that their VISA request at the consulate was denied, those guys just give VISA's like cookies, as i said your constitution on that side of things is broken.

Parents can convey their citizenship to a child wherever it is born. If a country doesn’t allow dual citizenship it may be required to choose at adulthood.

In my opinion, if US soldier had a child or was a father of a child in a different country than the United States then the child should still be an American and not a citizen of that country where the baby happened to be born. The baby would have no ties to the country, would not speak the language, and would not know anybody in the country because the parents would be transferred back

Overall good video. However you don't understand the meaning of "subject to the jurisdiction." It means are you permanently domiciled in the country, and without loyalty to another country. The meaning was thoroughly debated in the passing of the 14A and can be read in the Congressional record. The case you referenced US v Wong had to do with Wong's domicile, in addition to the fact that he was born in the USA. Wong won the case because he proved he was in fact subject to the jurisdiction of the USA.

You are mistaken. Trump is correct. America is (now was) the only country who allows birthright citizenship to people born to non citizen parents who were in the country ILLEGALLY. All the other countries that have birth right citizenship require that you be there legally for your baby to get that birthright citizenship. For example, If a couple who both only had us citizenship were to sneak over the southern border and give birth in Mexico and then tried to claim Mexican citizenship for their baby what they would get would be deportation back to the US for both themselves and the baby and the baby would still only have US citizenship.

This is false. In this case the child borned in Mexico will hold Mexican Citizenship. It doesn't matter the legal status of the parents. Many Venezuelans who could not enter the US are having children in Mexico for this reason

Andrew: Enjoy your content, but you are promoting gross misinformation here. So-called “birthright citizenship” has been since Day One a set of lies agreed upon. 14A citizenship clause, as drafted and as passed was and always has been on the basis that it applied to former Slaves and their children, Period. The Wong Kim Ark case, as you incorrectly cite, held that children born here to LEGAL PERMANENT RESIDENT aliens are subject to the citizenship clause of 14A. It in no way shape or form held that children of illegals or tourists were citizens under 14A. Moreover, under existing federal law, children of diplomats born here are NOT subject to 14A citizenship clause precisely because they are not subject to the jurisdiction of the U.S. I feel like our fake news media is promoting this misinformation to incite violence once our Supreme Court correctly affirms what many of us already knew, That 14A citizenship clause does not apply to tourists or to children of illegal aliens. Thank you.

I’m so conflicted with this. Did the founding fathers know it would be abused with pregnancy trips? Then if the children is born with disabilities the parent can apply for SSI even though they never contributed to the pool?

Since they founding fathers anyone born in the US was considered a citizen. It wasn't considered a bad thing until a fraud like Trump, said it was and his low iq supporters swallowed it up without thinking

I think the downsides of changing away from birthright will create more problems that it solves. Most Americans are Americans because they were born here. If we don't have birthright citizenship then what is every parent going to need to do to register their child for citizenship? It would be a bigger mess.
